Joint Oireachtas Committee on Justice, Defence and Equality: Garda Reform and Related Issues: Discussion (26 Jun 2019)

Donnchadh Ó Laoghaire: As I said, it is great but it seems there is a similarity to elements of GSOC.

Written Answers — Department of Justice and Equality: Garda Síochána Ombudsman Commission (5 Jul 2018)

Donnchadh Ó Laoghaire: 143. To ask the Tánaiste and Minister for Justice and Equality further to Parliamentary Question No. 147 of 10 May 2018, if the strategic information request received by GSOC relating to the incident outlined that there had been a single discharge of a firearm or if there had been more than one discharge. [29869/18]

Joint Oireachtas Committee on Justice, Defence and Equality: Garda Oversight and Accountability: Garda Síochána Ombudsman Commission (8 May 2019)

Donnchadh Ó Laoghaire: Due to a lack of resources and so on, it has been difficult to investigate every complaint and the process has been slow. Has there ever been an incident where, following an investigation, GSOC intended to seek a conviction but the Statute of Limitations of the petty sessions Act meant that was not possible?

Joint Oireachtas Committee on Justice, Defence and Equality: Garda Oversight and Accountability: Garda Síochána Ombudsman Commission (28 Feb 2018)

Donnchadh Ó Laoghaire: ...on that point, but I wish to return to an issue because I was not fully satisfied with the answer given. I will frame my question differently. In the course of an investigation is it possible for GSOC to visit a Garda station as part of an investigation without giving prior notice?

Written Answers — Department of Justice and Equality: Garda Síochána Ombudsman Commission (10 May 2018)

Donnchadh Ó Laoghaire: 146. To ask the Tánaiste and Minister for Justice and Equality if allegations have been made since 2014 of serious misconduct against staff based in or undertaking duties in the southern region of GSOC; if so, if those allegations have been investigated; the position regarding those allegations; and if members of staff have been disciplined since that point. [20739/18]

Other Questions: Garda Reports (17 Apr 2018)

Donnchadh Ó Laoghaire: The Minister spoke of allegations but what I quoted are statements of fact outlined in the Garda's report. The Minister has repeatedly made reference to GSOC. It is stating very clearly that it does not have the resources or the capability to reach this. That is not a satisfactory answer for the family or with respect to the matters of public interest. This is clearly an issue that needs...

Joint Oireachtas Committee on Justice, Defence and Equality: Garda Oversight and Accountability: Garda Síochána Ombudsman Commission (28 Feb 2018)

Donnchadh Ó Laoghaire: ...there is an issue of almost triaging cases, and identifying ones that are more appropriate for local resolution at a Garda district level, for example, as opposed to perhaps being more suitable for GSOC? Does she think that is a considerable issue? Would resolution of that make a considerable difference in terms of her workload?

Joint Oireachtas Committee on Justice, Defence and Equality: Garda Oversight and Accountability: Garda Síochána Ombudsman Commission (28 Feb 2018)

Donnchadh Ó Laoghaire: I suppose that is central to the reason I ask the question, namely, that there is a concern that the time it is taking GSOC to get through the cases is quite long. What is being said is that approximately half of the complaints that are reached - if I understand correctly that is 1,000 cases - that are received are disposed of within the year.

Joint Oireachtas Committee on Justice, Defence and Equality: Garda Oversight and Accountability: Garda Síochána Ombudsman Commission (8 May 2019)

Donnchadh Ó Laoghaire: ...and poor. However, I hope the additional resources will mean we see things expedited. When she was before the committee last year, Ms Justice Ring said approximately half of the cases GSOC received could be disposed of within a year. Is that still more or less the case?

Joint Oireachtas Committee on Justice, Defence and Equality: Garda Oversight and Accountability: Garda Síochána Ombudsman Commission (28 Feb 2018)

Donnchadh Ó Laoghaire: ...Síochána Ombudsman Commission should have full independence in the matter. While the circumstances are not the same as in the case of section 103, would access to information be improved if GSOC's ability to access the PULSE system was strengthened and perhaps placed on a statutory footing?

Saincheisteanna Tráthúla - Topical Issue Debate: Public Inquiries (20 Feb 2019)

Donnchadh Ó Laoghaire: ...the approach of examining the elements that have not already been investigated, notwithstanding the fact that the family is dissatisfied with a number of those investigations, in particular the GSOC investigation. This is a piecemeal approach. Terms 1 and 2 are focused on those areas of failure that have not already been examined while terms 3 to 6, inclusive, hinge on those first two...

Joint Oireachtas Committee on Justice, Defence and Equality: Garda Oversight and Accountability: Garda Síochána Ombudsman Commission (8 May 2019)

Donnchadh Ó Laoghaire: ...riachtanaisí atá ann. I thank the delegation. The meeting has been very useful and insightful in outlining the needs that exist. Deputy Daly has very clearly outlined that many of the requirements have been identified by GSOC and others as having existed for a long time and, unfortunately, they were not acted upon. Let me pick up on one of the previous questions. Ms...

Questions on Promised Legislation (30 May 2018)

Donnchadh Ó Laoghaire: ...and it took six years but it was not an investigation. I would be glad to take the Taoiseach through the individual failures in the report. It is clear to me that it should never have been a matter for GSOC because it went beyond An Garda Síochána. It is also clear to me that it is now time for a public inquiry to investigate the failures of An Garda Síochána, the...

Garda Síochána (Amendment) Bill 2017: Second Stage [Private Members] (9 Nov 2017)

Donnchadh Ó Laoghaire: ...to enter, inspect and review any Garda Síochána station or premises without prior notification to any member of the Garda. Sinn Féin also supports giving a similar power to the Garda Síochána Ombudsman Commission. The strength and powers of GSOC are characterised by failings and weaknesses. While we need to return to this issue, GSOC requires the power provided...

Inquiry into the death of Shane O’Farrell: Motion [Private Members] (12 Nov 2019)

Donnchadh Ó Laoghaire: .... That they were flawed does not seem to be possible in the eyes of the Department and in any of the positions that have been adopted. It seems clear to me and many other parties, including many independent observers, that the GSOC report was significantly flawed as well as delayed. The independent review mechanism was also not adequate to bring the answers to light in regard to the...
