Public Accounts Committee: Special Report No. 94 of the Comptroller and Auditor General: National Asset Management Agency Sale of Project Eagle (Resumed) (10 Nov 2016)

David Cullinane: Exactly. However, we have evidence that NAMA gave us in which it referenced discussions between the Department of Finance and the Comptroller and Auditor General regarding the discount rate. We will go back and correct that with NAMA that it never happened.

Public Accounts Committee: Special Report No. 94 of the Comptroller and Auditor General: National Asset Management Agency Sale of Project Eagle (Resumed) (10 Nov 2016)

David Cullinane: Ms Nolan talked about a different set of pressures, NAMA talked about a different set of pressures but everybody is talking about pressures that NAMA was under to sell. The claim does not stack up, as no evidence has been presented to the board.

David Cullinane: Mr. Daly understands that it is also one of NAMA's functions and roles. Mr. McDonagh would understand that as well, that integrity in the process is as important as the commercial aspect of it in terms of what NAMA gets. Would he accept it is as important?

Public Accounts Committee: National Asset Management Agency: Financial Statements 2016 and 2017

(20 Sep 2018)

David Cullinane: Has NAMA done that analysis and Mr. McDonagh just does not have the data with him, or is it something NAMA would not have done?

Written Answers — Department of Finance: National Asset Management Agency (8 Nov 2022)

David Cullinane: 250. To ask the Minister for Finance his views on a matter raised in correspondence (details supplied) regarding apartments held by NAMA in need of remediation; if he will seek an explanation from NAMA; and if he will make a statement on the matter. [54258/22]

Public Accounts Committee: Special Report No. 94 of the Comptroller and Auditor General: National Asset Management Agency Sale of Project Eagle (29 Sep 2016)

David Cullinane: ...General's report and the 58 findings. I want to try to establish on what basis those findings were made and whether they were findings based on facts, documentary evidence and experience within NAMA; apologies, experience within the Comptroller and Auditor General's office which NAMA disputes. It is fair that we have to interrogate the findings of Mr. McCarthy's report, which I am sure...

Public Accounts Committee: Special Report No. 94 of the Comptroller and Auditor General: National Asset Management Agency Sale of Project Eagle (29 Sep 2016)

David Cullinane: The problem with NAMA's world view on this is that Mr. Daly said in his opening statement that - and he spoke about the success fee, Mr. Cushnahan and all of the conflicts of interest, which is fair enough - that NAMA had to weigh up the potentially serious costs and consequences for the agency if it were to withdraw from the process, for other State-owned banks and for the sovereign of...

Public Accounts Committee: Special Report No. 94 of the Comptroller and Auditor General: National Asset Management Agency Sale of Project Eagle (29 Sep 2016)

David Cullinane: ...General goes on to state, "The allegations of Mr Cushnahan's involvement in an arrangement to share fees with Brown Rudnick and Tughans (or the managing partner of Tughans) warranted more action by NAMA ...". Did NAMA ask at any point what further action that would have involved?

Public Accounts Committee: Special Report No. 94 of the Comptroller and Auditor General: National Asset Management Agency Sale of Project Eagle (Resumed) (24 Nov 2016)

David Cullinane: I will be seeking the assistance of Mr. Daly and Mr. McDonagh to better understand two sets of minutes of the NAMA board. I will go through one set of the board minutes line by line because I want the witnesses to address my confusion over them. Before doing so, I seek clarification on one issue on the sale price before I get back to the conflict of interest. At any point in the NAMA...

David Cullinane: Number 7 reads: "There is no indication that NAMA or its Board had given consideration to a bulk sale of either its loan collateral in Northern Ireland or of the loans of the debtors based in Northern Ireland prior to Brown Rudnick’s correspondence in June 2013." Number 8 states that "NAMA has stated that, although not recorded formally, it considered and rejected alternative...

Public Accounts Committee: Special Report No. 94 of the Comptroller and Auditor General: National Asset Management Agency Sale of Project Eagle (Resumed) (18 Oct 2016)

David Cullinane: To follow up on the matter, it would be valuable to write back to NAMA to say a number of presentations were given prior to the 2014 presentation that it cites that NAMA failed to mention in its letter. It is in the documentation. In 2012 and 2013, detailed presentations were given about the Ulster University's study.

Public Accounts Committee: Special Report No. 94 of the Comptroller and Auditor General: National Asset Management Agency Sale of Project Eagle (Resumed) (25 Oct 2016)

David Cullinane: The letter of compliance was from Cerberus in which it confirmed it was not paying money to anybody associated with NAMA. My understanding of the Comptroller and Auditor General's criticism is that we do not know if Tughans and Brown Rudnick were making payments to others. Was that ever highlighted as a concern by NAMA legal?

Public Accounts Committee: Business of Committee (13 Jun 2019)

David Cullinane: Does NAMA accept that it was a failure on its part that the disclosure was not made in the annual financial statements and that the audit committee was not informed, or is that just Mr. McCarthy's opinion? Has he received a response from NAMA on this point and is it an ongoing issue for his office?

Public Accounts Committee: Special Report No. 94 of the Comptroller and Auditor General: National Asset Management Agency Sale of Project Eagle (Resumed) (22 Nov 2016)

David Cullinane: I thank Mr. Long. I will be the judge of that and we will ask the NAMA representatives those questions when they come in. Paragraph 4.10 states:The paper presented by the NAMA executive for the Board meeting on 8 January 2014 proposed a plan that involved the immediate appointment of loan sale advisors. I assume that was Lazard.

Public Accounts Committee: Special Report No. 94 of the Comptroller and Auditor General: National Asset Management Agency Sale of Project Eagle (Resumed) (10 Nov 2016)

David Cullinane: What is interesting about this is that this was in November 2013. It talks about 70% of the North of Ireland's portfolio being completed property and income-producing; that NAMA has approved €140 million in new money advances; a small number of cases had to be enforced in the North; that the agency's enforcement was proportionate to the scale of its exposure in the North and was not...

Public Accounts Committee: Business of Committee (24 Nov 2016)

David Cullinane: On behalf of the members - if the members agree - Chairman, you should forcibly make the point to NAMA that we need whatever documentation it has not provided or information that was heavily redacted. NAMA has offered a justification as to why it cannot provide it but we need to be robust in asking again for information. Are you agreeable to taking such an approach, Chairman?
