Seán Sherlock: For a criminal case?
- Joint Oireachtas Committee on Children and Youth Affairs: Cyber Security: Discussion (27 Sep 2017)
Seán Sherlock: I have two final questions. I thank the witness for her reply because it was extremely informative. I appreciate her response. In respect of the Professional Development Service for Teachers, PDST, and the Department of Education and Skills, what is the budget for Webwise? How much of the budget is allocated to this endeavour?

- Joint Oireachtas Committee on Children and Youth Affairs: Cyber Security: Discussion (27 Sep 2017)
Seán Sherlock: Is this content included in the mainstream social, personal, health and education, SPHE, curriculum? Is it a de facto part of it? Is it compulsory for students or is it undertaken by choice? Can school principals or teachers say that they have an interest in this area, that they want to take it on board and that they will go for the CPD and teach their pupils about the content? Are the...
- Joint Oireachtas Committee on Children and Youth Affairs: Cyber Security: Discussion (27 Sep 2017)
Seán Sherlock: I appreciate that.
- Joint Oireachtas Committee on Children and Youth Affairs: Cyber Security: Discussion (27 Sep 2017)
Seán Sherlock: It is not a de facto part of the SPHE curriculum, however. If one talks about, for example, student safety, it is very much down to whether a teacher decides to inculcate this programme within his or her SPHE pedagogy or content. If a school or an individual teacher does not want to subsume this into its curriculum, it does not necessarily have to do so. Should we think about making this a...
- Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: Banking Sector in Ireland (Resumed): Permanent TSB and KBC Bank (28 Sep 2017)
Seán Sherlock: I would like to return to the tracker mortgage issue. Under the Central Bank review, as I understand it, where customers made complaints to the Financial Services Ombudsman and where those complaints were actually upheld in Permanent TSB's favour, the complaints were also to become part of this review. Even where the FSO found against the customer, that customer was still to be contacted....
- Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: Banking Sector in Ireland (Resumed): Permanent TSB and KBC Bank (28 Sep 2017)
Seán Sherlock: That is interesting. What does Mr. Mitchell mean when he says that they "are in the process of being contacted"? That suggests to me that not everybody has been contacted.
- Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: Banking Sector in Ireland (Resumed): Permanent TSB and KBC Bank (28 Sep 2017)
Seán Sherlock: Forgive me, I do not want to be too pedantic but I just want to really understand this.
- Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: Banking Sector in Ireland (Resumed): Permanent TSB and KBC Bank (28 Sep 2017)
Seán Sherlock: The very specific case that I have was the subject of an FSO complaint. The individual in question shouldprima faciehave been contacted but has not been. Could I correspond with the bank with regard to this specific case? I am worried that it could perhaps represent a sample of cases. That is my central point here.
- Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: Banking Sector in Ireland (Resumed): Permanent TSB and KBC Bank (28 Sep 2017)
Seán Sherlock: Is Mr. Masding satisfied that Permanent TSB is fulfilling its legal obligations under data protection law? Let me be more specific. I assume the witnesses are aware that banks are legally obliged to retain all communications for six years after the ending of a product. A 30-year mortgage, for example, would result in a bank retaining records for 36 years. Is Mr. Masding satisfied that...
- Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: Banking Sector in Ireland (Resumed): Permanent TSB and KBC Bank (28 Sep 2017)
Seán Sherlock: The witnesses acknowledge, then, that there was a lapse. How systemic was that lapse and how many customers were affected by it? I ask that the witnesses to be specific.
- Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: Banking Sector in Ireland (Resumed): Permanent TSB and KBC Bank (28 Sep 2017)
Seán Sherlock: Absolutely. Again, one suspects that this is symptomatic. It goes back to the tracker mortgage issue where complaints where made to the FSO, where somebody sought records and was unable to obtain them from Permanent TSB. This weakened that individual's case and indeed rights. The bank was clearly in breach of the legislation in not retaining fully the records as per its obligations. The...
- Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: Banking Sector in Ireland (Resumed): Permanent TSB and KBC Bank (28 Sep 2017)
Seán Sherlock: How often does the bank correspond with or meet the regulatory authorities regarding its obligations under the Data Protection Act?
- Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: Banking Sector in Ireland (Resumed): Permanent TSB and KBC Bank (28 Sep 2017)
Seán Sherlock: If the person to whom I am referring requests their records tomorrow, can they be satisfied that those records are retained?
