- Seanad: Veterinary Practice Bill 2004: Committee Stage (Resumed). (23 Mar 2005)
Feargal Quinn: I congratulate the Minister. This is one of the areas of deep concern to veterinary practitioners and nurses. I do not have a solution to it. I acknowledge the work done by Senators Henry, McCarthy and Coonan. As far as I can see, with the exception of the query from Senator McCarthy, the Minister and her officials seem to have drafted the challenge and come up with answers that seem to have...
- Seanad: Veterinary Practice Bill 2004: Committee Stage (Resumed). (23 Mar 2005)
Feargal Quinn: The Minister has listened carefully to the concerns raised on this section. I welcome the steps she has taken in the amendment.
- Seanad: Veterinary Practice Bill 2004: Committee Stage (Resumed). (23 Mar 2005)
Feargal Quinn: I have a similar point on the section itself. I will hold off until the debate thereon.
- Seanad: Veterinary Practice Bill 2004: Committee Stage (Resumed). (23 Mar 2005)
Feargal Quinn: I am not sure that it stands, but there is a reference on page 78 to a registered person. This term is much used and I suggest it should be very definite and should say a person registered under Part 4 of the Bill. I do not know if there is a need for this, perhaps the Minister has already included a reference to it. The term "registered persons" is mentioned on a number of occasions without...
- Seanad: Veterinary Practice Bill 2004: Committee Stage (Resumed). (23 Mar 2005)
Feargal Quinn: I support this amendment. Such documents are very valuable and can easily be lost. Retail shops must show a licence for selling certain products, and very often a copy is on display while the original is available for inspection. Will the Minister give some thought to this before Report Stage?
- Seanad: Veterinary Practice Bill 2004: Committee Stage (Resumed). (23 Mar 2005)
Feargal Quinn: Regulations have recently been passed which stipulate that drivers must carry their original driving licence in each vehicle they own and that copies are not acceptable. In line with the Minister's suggestion, I have taken a copy of my licence for safe keeping. When I lost my licence last year, I was able to get a replacement easily because I had the copy. There is some sense in the...
- Seanad: Veterinary Practice Bill 2004: Committee Stage (Resumed). (23 Mar 2005)
Feargal Quinn: I am concerned at the powers the State has given to so many inspectors in the past ten years. The first instance related to drugs and the ability to perpetrate a forced entry in searching for illegal substances. Everyone was in agreement with this development. Findings of the first tribunal led to new developments in regard to tax inspectors. Over the decade, authorities in many areas of life...
- Seanad: Veterinary Practice Bill 2004: Committee Stage (Resumed). (23 Mar 2005)
Feargal Quinn: I am satisfied with the Minister's statement that she will re-evaluate this aspect of the Bill. There is an old saying that an Englishman's home is his castle. I do not know what one calls an Irishman's home but it seems that in the past ten years we have passed much legislation affording rights to people to invade one's home. I have argued against it each time. In this case, the Minister...
- Seanad: Finance Bill 2005 [Certified Money Bill]: Committee and Remaining Stages. (23 Mar 2005)
Feargal Quinn: I move recommendation No. 11: In page 132, lines 18 to 31, to delete paragraph (a). I did not believe we would reach this recommendation. I wish to declare an interest. The reason for my doing so can be explained by the explanatory memorandum, which states that the first amendment ensures that the sale of food and drink which has been heated and is above the ambient air temperature when...
- Seanad: Finance Bill 2005 [Certified Money Bill]: Committee and Remaining Stages. (23 Mar 2005)
Feargal Quinn: I welcome an item of information that has been brought into the open. Members of the public will now pay â¬30 million more than they did before becauseââ
- Seanad: Finance Bill 2005 [Certified Money Bill]: Committee and Remaining Stages. (23 Mar 2005)
Feargal Quinn: ââthere has been no VAT on hot food until now. It is clear from the Minister of State's comments that there will be VAT in the future. Why has he singled out this change? He has indicated that this is probably occurring at the behest of restaurant businesses. Those involved in that sector have said it is not fair to compete with garages, petrol stations and shops which sell food, and...
- Seanad: West Link Toll Bridge: Motion. (23 Mar 2005)
Feargal Quinn: I appreciate the opportunity to speak on this topic. I was in Dundalk yesterday and it was a joy to travel there. The Minister spoke about the roads that have been completed. The road to Dundalk is marvellous. As we crossed the bridge over the River Boyne we did not have to slow down. The tolling system seemed to work very well and I thought of the horror I have to endure every time I go...
- Seanad: Expressions of Sympathy on the Death of His Holiness, Pope John Paul II: Motion. (12 Apr 2005)
Feargal Quinn: I thank the House for giving us the opportunity to debate this motion. I regard this occasion as one of celebration of Pope John Paul II's life rather than one of sadness on his death. The memories we have heard expressed today are great reminders of so many of the things he achieved, but not all of them because we cannot do that. There is a Latin phrase, "Si monumentum requiris,...
- Seanad: Statute Law Revision (Pre-1922) Bill 2004: Second Stage. (13 Apr 2005)
Feargal Quinn: What an interesting debate this has been. I welcome the Minister and his officials here today. I particularly welcome the words he used which were repeated by Senator Ormonde. I was impressed by the Minister's reference to the regulatory impact analysis that is to take place, following the publication of a report on this topic last year. What will happen in 100 years time when people look...
- Seanad: Statute Law Revision (Pre-1922) Bill 2004: Second Stage. (13 Apr 2005)
Feargal Quinn: We occasionally make the mistake of rushing legislation through these Houses. The point was made that less law is sometimes better law. We do not automatically believe that because we pass legislation we are doing good. I have no problem with the 90 Acts that are being repealed, but it does raise a question. How many pre-1922 statutes will remain in force after this measure takes effect? I...
- Seanad: Order of Business. (14 Apr 2005)
Feargal Quinn: Hearing the strength of feeling from Senator Ulick Burke, reminds us of the need to have Ministers attend the House. A great feature of our democracy is that Ministers can explain themselves to the House. The strength of feeling over the health service is such that the Tánaiste must attend the House and give an opportunity to Members to express those feelings expressed by Senator Ulick...
- Seanad: Investment Funds, Companies and Miscellaneous Provisions Bill 2005: Second Stage. (14 Apr 2005)
Feargal Quinn: I welcome the Minister of State. I also welcome his comments in introducing the Bill and his emphasis on the Deloitte & Touche report. He referred to making Dublin a major European centre and a world class location, which are phrases I like. I refer to a procedural issue. Yesterday we debated legislation intended to tidy up the Statute Book to make it easily accessible. However, this is not...
- Seanad: Investment Funds, Companies and Miscellaneous Provisions Bill 2005: Second Stage. (14 Apr 2005)
Feargal Quinn: It was a success. From the outset, the Custom House Docks project was marked by the unprecedented readiness of the authorities to fast track legislation to facilitate the broadest range of activities in the centre. They grabbed hold of it and it was a question of moving with the times. Senator White referred to her husband. Whenever a market opportunity was spotted by the IDA or one of the...
- Seanad: Investment Funds, Companies and Miscellaneous Provisions Bill 2005: Second Stage. (14 Apr 2005)
Feargal Quinn: The approach has clearly paid off, and it continues to pay off today. That is why we must remember those days and the activities and need to get things done rather than putting them on the long finger. It is for that reason that I welcome the Bill, the Minister of State and the work that his officials have put into what is before us today. Financial services are a fast-evolving industry, with...
- Seanad: Criminal Law (Insanity) Bill 2002: Report and Final Stages. (19 Apr 2005)
Feargal Quinn: I support Senator Henry. I remember some ten years ago, very early on in my career here, one of the first debates in which I was involved concerned a prison Bill. While speaking off the cuff, I stated that although I was unsure that I had thought out the question as to why people should be sent to prison, among the reasons that I could think of was the protection of society, punishment and...
