- Joint Oireachtas Committee on Housing, Planning and Local Government: Referendum on Right to Housing: Discussion (3 Nov 2020)
Cian O'Callaghan: We do not know whether the Constitution is actually a barrier or whether it is a matter of political will and the Constitution is used as a cover. If this is brought in, we would have clarity as to how far the Oireachtas wants to go or not when it comes to housing initiatives. It would remove the constitutional argument as a barrier and something that is used to delay progress. It would be...

Cian O'Callaghan: I understood we were rotating the meeting so it should be Senator Moynihan.
- Joint Oireachtas Committee on Housing, Planning and Local Government: General Scheme of the Water Environment (Abstractions) Bill 2020: Discussion (Resumed) (5 Nov 2020)
Cian O'Callaghan: That is fine, but in general every second meeting was what was agreed between Senator Moynihan and me.
- Joint Oireachtas Committee on Housing, Planning and Local Government: General Scheme of the Water Environment (Abstractions) Bill 2020: Discussion (Resumed) (5 Nov 2020)
Cian O'Callaghan: I have two questions for the EPA and I will ask the representatives of SWAN for a comment if I have time. SWAN believes that the risk-based assessment is done only on the water framework directive and that appears to be the case based on comments from the EPA. Is the risk-based assessment done on the water framework directive or does it look at wider issues and impacts on habitats and...
- Joint Oireachtas Committee on Housing, Planning and Local Government: General Scheme of the Water Environment (Abstractions) Bill 2020: Discussion (Resumed) (5 Nov 2020)
Cian O'Callaghan: I thank Ms Gurrie for that reply. In my ten years as a councillor, I served on the management committee of the Howth special area amenity order. Within that is a special area of conservation. We did extensive work in that ten years on a range of issues. The changes in groundwater and drainage as well abstractions had major impacts on the habitats and the biodiversity in the area....

- Joint Oireachtas Committee on Housing, Planning and Local Government: General Scheme of the Water Environment (Abstractions) Bill 2020: Discussion (Resumed) (5 Nov 2020)
Cian O'Callaghan: I will make one point and then the EPA can quickly come in on this. On the risk assessment and how it is being looked at for water abstraction, I refer to the other changes with water courses around drainage and what is going to be happening around climate change. Has all of that been included in the risk assessment and analysis that has been done on this?
- Joint Oireachtas Committee on Housing, Planning and Local Government: General Scheme of the Water Environment (Abstractions) Bill 2020: Discussion (Resumed) (5 Nov 2020)
Cian O'Callaghan: Is there not a concern that there is often not enough information at a local level on these different aspects, including changes to the drainage of water courses and water bodies, to inform this properly?
- Ceisteanna ar Reachtaíocht a Gealladh - Questions on Promised Legislation (10 Nov 2020)
Cian O'Callaghan: I want to ask specifically about social housing. The programme for Government commits to ensuring that public procurement of social housing is cost-effective and that there are strong value-for-money protections in that regard. Given the report published last week by the Department of Housing, Local Government and Heritage showing that direct build by local authorities is much more...
- Joint Oireachtas Committee on Housing, Planning and Local Government: Strategic Housing Developments: Discussion (10 Nov 2020)
Cian O'Callaghan: I thank the representatives of An Bord Pleanála and the Department for coming before the committee. Their attendance is appreciated. From the conversations I have had with planners in particular, I know they can be among the most critical voices on this issue. It is worth noting that many planners working in the system are not able to have a public voice on the matter. That comes...
- Joint Oireachtas Committee on Housing, Planning and Local Government: Strategic Housing Developments: Discussion (10 Nov 2020)
Cian O'Callaghan: As it is in front of us, it is valid to raise it. I was quoting from it.
- Joint Oireachtas Committee on Housing, Planning and Local Government: Strategic Housing Developments: Discussion (10 Nov 2020)
Cian O'Callaghan: I have given some details that they might comment on. My specific question concerns the claim in the submission that there has been policy capture of the State by developers. What is the Department's view on that with respect to the SHD process?
- Joint Oireachtas Committee on Housing, Planning and Local Government: Strategic Housing Developments: Discussion (10 Nov 2020)
Cian O'Callaghan: It is significant that the board has indicated a view on the review as not being a form of appeals process. It is the view I take as well. It means the SHD process is in contravention of the Aarhus Convention as people do not have an appeals process. When an SHD application goes to the board and decisions are made, how many people on the board are involved? Is it always three?
