Joint Oireachtas Committee on Arts, Heritage, Regional, Rural and Gaeltacht Affairs: National Famine Commemoration Day Bill 2017: Discussion (28 Nov 2018)

Fintan Warfield: Is there a reason the Taoiseach should-----

Joint Oireachtas Committee on Arts, Heritage, Regional, Rural and Gaeltacht Affairs: National Famine Commemoration Day Bill 2017: Discussion (28 Nov 2018)

Fintan Warfield: As members will be aware, Ireland has only nine public holidays whereas the standard number across the European Union is 11. Will the Government run with and take ownership of this by perhaps setting a public holiday that could bring many other benefits to the commemoration?

Joint Oireachtas Committee on Arts, Heritage, Regional, Rural and Gaeltacht Affairs: National Famine Commemoration Day Bill 2017: Discussion (28 Nov 2018)

Fintan Warfield: It would not be St. Patrick's Day.

Joint Oireachtas Committee on Arts, Heritage, Regional, Rural and Gaeltacht Affairs: National Famine Commemoration Day Bill 2017: Discussion (28 Nov 2018)

Fintan Warfield: I am interested in hearing the thoughts of the witnesses on the title of the commemoration. It has been suggested that we run with the title as Gaeilge. It is somewhat outrageous of Deputy Brophy to suggest that if we have a public holiday, everyone will go on the piss.

Joint Oireachtas Committee on Arts, Heritage, Regional, Rural and Gaeltacht Affairs: National Famine Commemoration Day Bill 2017: Discussion (28 Nov 2018)

Fintan Warfield: Deputy Brophy said he is concerned that it might become like St. Patrick's Day.

Seanad: Order of Business (29 Nov 2018)

Fintan Warfield: World Aids Day, which will take place on Saturday, presents an opportunity for the global community to evaluate or fight to eradicate HIV and AIDS. This time last year, when we had statements to mark the occasion, this House was in unison in stating that rising HIV transmission rates are unacceptable and our current responses inadequate. While accessible antiretroviral therapy in the form...

Seanad: Order of Business (4 Dec 2018)

Fintan Warfield: The Seanad reform implementation group first met on 9 May. On Tuesday next, I hope, the group will sign off on a report and a Bill. During Taoiseach's questions earlier in the Dáil, the long running saga in Irish politics that is Seanad reform was discussed by all of the group leaders. Some suggested that there are Members in this House who do not believe that we will ever see reform...

Seanad: Employment (Miscellaneous Provisions) Bill 2017: Committee Stage (4 Dec 2018)

Fintan Warfield: Sinn Féin considers the provision in writing of the core terms of employment before employment commences to be sufficiently important to merit the provision of a criminal sanction as a possible enforcement mechanism. We would only consider dropping the offence and the sanction of imprisonment if they were to be replaced by a direct route to compensation for workers, in line with other...

Seanad: Employment (Miscellaneous Provisions) Bill 2017: Committee Stage (4 Dec 2018)

Fintan Warfield: We do not support the amendment proposing to remove section 6B(1) and part of section 6B(3), which currently uphold an offence and penalisation of imprisonment, if I read it right, for failure to comply with workers' rights legislation.

Seanad: Employment (Miscellaneous Provisions) Bill 2017: Committee Stage (4 Dec 2018)

Fintan Warfield: I do not agree with the Minister's suggestion that the report will be fruitless and I support Senator Ardagh's amendment to section 10, calling for a review to be carried out within 12 months. I am not aware of any need to amend the Bill after 12 months have passed, and I see a lot of ancient detail in many pieces of legislation.

Seanad: Employment (Miscellaneous Provisions) Bill 2017: Committee Stage (4 Dec 2018)

Fintan Warfield: I accept that the numbers are the same but if one was in band B originally, which is from six hours or more to less than 11 hours, the achievement of the bands as they are currently drafted is that they are quite narrow and they provide workers with certainty of hours within whichever band they are given. The proposed change to section 16 seeks to remove the wording "or more" and "less than"...

Seanad: Employment (Miscellaneous Provisions) Bill 2017: Committee Stage (4 Dec 2018)

Fintan Warfield: There is no doubt that bogus self-employment is a major issue across many sectors. An estimated 50% of Ryanair pilots are in bogus self-employment situations -----

Seanad: Employment (Miscellaneous Provisions) Bill 2017: Committee Stage (4 Dec 2018)

Fintan Warfield: As a result, Ryanair does not have to pay PRSI contributions for those pilots, the pilots do not have employment rights such as maternity or paternity leave and they have no rights to collective bargaining or industrial action. Senator Ardagh mentioned the work undertaken by Deputy O'Dea. His amendment is well intended. Sinn Féin has acknowledged this issue must be dealt with and done...

Seanad: Commencement Matters: Commencement of Legislation (5 Dec 2018)

Fintan Warfield: I thank the Minister of State for coming to the House. I know this does not relate to his own brief. I do not intend to pre-empt his response, but far too often we are left a bit unsatisfied with the responses. We have just had a discussion on that issue. I suggest we really need to look at the slot for Commencement matters because many are not satisfied with the responses received. It...

Seanad: Commencement Matters: Commencement of Legislation (5 Dec 2018)

Fintan Warfield: I have some concerns. There is also a Social Welfare, Pensions and Civil Registration Bill 2018, which I understand will appear on Committee Stage in the Seanad next week. There are significant problems with the 2017 Bill and it is unclear to us whether it can be enacted any time soon or whether there will be support in the Oireachtas to do so, but we will examine the 2018 Bill in the...

Seanad: Commencement Matters: Commencement of Legislation (5 Dec 2018)

Fintan Warfield: I will speak on the issue again.

Seanad: Order of Business (6 Dec 2018)

Fintan Warfield: I offer Sinn Féin's support to the proposal that we sit on Monday afternoon as it would allow Senators to travel from their respective areas. I welcome the passing of the legislation in the Dáil last night and I hope we can have a respectful debate. We should not forget that, since the decisive vote on 25 May, more than 1,600 people have travelled overseas for an abortion, and 550...

Joint Oireachtas Committee on Arts, Heritage, Regional, Rural and Gaeltacht Affairs: Network of Regional and Local Museums: Discussion (12 Dec 2018)

Fintan Warfield: I welcome all of the witnesses. My first question is to Ms Scarff. My boyfriend passed on to me an article from last weekend's Financial Times. It states: "As collections cannot be dissociated from the historic crime of colonialism, whether actually looted or not, there is just one appropriate course of action, the authors insist: restitution, the return of works to their rightful owners."...

Joint Oireachtas Committee on Arts, Heritage, Regional, Rural and Gaeltacht Affairs: Network of Regional and Local Museums: Discussion (12 Dec 2018)

Fintan Warfield: We are uniquely positioned to have that conversation because of our place in the world. Did Ms Scarff say we could expect a publication?

Joint Oireachtas Committee on Arts, Heritage, Regional, Rural and Gaeltacht Affairs: Network of Regional and Local Museums: Discussion (12 Dec 2018)

Fintan Warfield: I thank Ms Scarff. On storage, the 2040 plan has been mentioned a lot. Is there space within the plan for a national storage site or where are we at with Swords? That question is open to anyone. Is it fit for purpose and are any of our collections at permanent risk because of Swords?
