Committee on Finance, Public Expenditure and Reform: Joint Sub-Committee on Global Corporate Taxation: Base Erosion and Profit Sharing: Discussion with Trinity College (17 Sep 2013)

Dara Murphy: Can Professor Barry identify or has he any fear of imminent unilateral tax moves that might be made by some of the larger countries individually or within the EU tax family or in the United States? Are clear proposals being brought forward that might get cross-party support in the United States, or has it not arrived at that stage yet?

Committee on Finance, Public Expenditure and Reform: Joint Sub-Committee on Global Corporate Taxation: Base Erosion and Profit Sharing: Discussion with Trinity College (17 Sep 2013)

Dara Murphy: Ireland takes first place in the table in terms of its effective and actual corporation tax rates. There is a gap of a few percentage points to the next country. The Government - in which I am happy to serve as a backbench Member - puts great stock in the fact that our rate is so solidly banked at 12.5%. How important would it be for Ireland not to be seen to start an upward movement in...

Committee on Finance, Public Expenditure and Reform: Joint Sub-Committee on Global Corporate Taxation: Base Erosion and Profit Sharing: Discussion with Trinity College (17 Sep 2013)

Dara Murphy: I thank Professor Barry.

Committee on Finance, Public Expenditure and Reform: Joint Sub-Committee on Global Corporate Taxation: Base Erosion and Profit Sharing: Discussion with Trinity College (17 Sep 2013)

Dara Murphy: Professor Barry is being consistent. It does not matter how often the argument to the contrary is made; a country with a population of 4.5 million cannot change global taxation to make it fairer. We must be selfish in this regard. The Government has made clear it would like the global architecture changed. Until then, however, the current architecture will remain in place. In light of...

Committee on Finance, Public Expenditure and Reform: Joint Sub-Committee on Global Corporate Taxation: Base Erosion and Profit Sharing: Discussion with Trinity College (17 Sep 2013)

Dara Murphy: The Apple corporation is extremely valuable to the economy and my constituency. There is no suggestion that any of the corporations in question are breaking the law. The responsibility for the flaw in the system lies with policymakers around the world. We must make that important distinction. Deputy Boyd Barrett cited a number of figures. We have not discussed in detail the difference...

Committee on Finance, Public Expenditure and Reform: Joint Sub-Committee on Global Corporate Taxation: Base Erosion and Profit Sharing: Discussion with Trinity College (17 Sep 2013)

Dara Murphy: I am aware of that. However, the officials will be able to give an opinion from an Irish perspective, whereas I am asking Professor Barry to make an international comparison.

Mortgage Arrears: Motion [Private Members] (18 Sep 2013)

Dara Murphy: My colleague very capably pointed out the hypocrisy of parts of this motion from Fianna Fáil. Having attended last week's finance committee hearings as a member, there was cross-party frustration with the banks. They came in and they had all achieved their targets. One of the main criticisms I have of this motion, and even this debate which, as the Minister said, is ongoing, is that...

Written Answers — Department of Social Protection: National Internship Scheme Eligibility (18 Sep 2013)

Dara Murphy: 643. To ask the Minister for Social Protection the reason persons on a blind pension are not eligible for the JobBridge scheme; and if she will make a statement on the matter. [37872/13]

Written Answers — Department of Environment, Community and Local Government: Motor Tax Evasion (18 Sep 2013)

Dara Murphy: 960. To ask the Minister for Environment, Community and Local Government the best available figure or estimate of the number of vehicles that are being driven in breach of current car tax legislation here; and if he will make a statement on the matter. [38514/13]

Written Answers — Department of Health: Health Services Staff Recruitment (18 Sep 2013)

Dara Murphy: 1275. To ask the Minister for Health when recruitment will begin within the Health Service Executive for speech and language therapists; and if he will make a statement on the matter. [37063/13]

Written Answers — Department of Health: Health Insurance Levy Issues (18 Sep 2013)

Dara Murphy: 1440. To ask the Minister for Health if the current practise of the Government in-patient levy on private health insurers and the new charge on private health insurers for the full cost of a public hospital bed will be reviewed; and if he will make a statement on the matter. [37841/13]

Written Answers — Department of Health: Proposed Legislation (18 Sep 2013)

Dara Murphy: 1487. To ask the Minister for Health if he intends to progress the passage of the Public Health (Availability of Defibrillators) Bill 2013; and if he will make a statement on the matter. [38125/13]

Committee on Finance, Public Expenditure and Reform: Joint Sub-Committee on Global Corporate Taxation: Base Erosion and Profit Shifting: Discussion with Department of Finance and Revenue (18 Sep 2013)

Dara Murphy: I thank the officials from both parties for coming to the meeting. They will be aware that representatives of a number of groups have appeared before the committee. Officials from the OECD attended a meeting in July and Mr. Frank Barr of Trinity College Dublin was here yesterday. The allegation that our tax structure is somehow flawed and benefits multinationals has not been proved to...

Committee on Finance, Public Expenditure and Reform: Joint Sub-Committee on Global Corporate Taxation: Base Erosion and Profit Shifting: Discussion with Department of Finance and Revenue (18 Sep 2013)

Dara Murphy: I just wanted to clarify whether there was a buffer between the two. Mr. Tobin has mentioned that a great deal of work has historically been done on the issue of double taxation. There is no doubt that there is now a move towards reaching the point at which no tax is paid. From a selfish Irish point of view, we have been extremely successful with the rate. What ongoing work is taking...

Committee on Finance, Public Expenditure and Reform: Joint Sub-Committee on Global Corporate Taxation: Base Erosion and Profit Shifting: Discussion with Department of Finance and Revenue (18 Sep 2013)

Dara Murphy: When some of those who make this allegation which is completely unproven softly suggest no law is being broken, there is implicit criticism of the corporations. This is a matter for policymakers. Mr. Tobin states in his report that the OECD and the larger countries will drive it. I would like to ask the representatives of the Revenue Commissioners a question in that context. One rarely...

Committee on Finance, Public Expenditure and Reform: Joint Sub-Committee on Global Corporate Taxation: Base Erosion and Profit Shifting: Discussion with Department of Finance and Revenue (18 Sep 2013)

Dara Murphy: It was interesting to hear Professor Barry from Trinity yesterday supporting the view that it is not damaging to our international reputation. I refer to an article in one of the American newspapers - it could be The Washington Post. Some people might make the point that this is actually advertising to a continent that we have a very competitive tax regime in Ireland. One area where there...

Committee on Finance, Public Expenditure and Reform: Joint Sub-Committee on Global Corporate Taxation: Base Erosion and Profit Shifting: Discussion with Department of Finance and Revenue (18 Sep 2013)

Dara Murphy: I think that is the view expressed by Professor Barry. To be clear, since 1990, almost one quarter of a century ago, there are no special deals between the Revenue Commissioners or the Department of Finance with respect to Irish tax law.

Committee on Finance, Public Expenditure and Reform: Joint Sub-Committee on Global Corporate Taxation: Base Erosion and Profit Shifting: Discussion with Department of Finance and Revenue (18 Sep 2013)

Dara Murphy: I appreciate that "special deal" or "grandfathering" are the wrong terms, but no matter how it is defined on whatever side of the argument, since 1990, 23 years ago, none of them applies, no matter what one's definition. It is now the same for everyone. One of the key elements is the OECD's definition of "tax haven" which is particularly loose. Are the witnesses absolutely satisfied that...

Committee on Finance, Public Expenditure and Reform: Joint Sub-Committee on Global Corporate Taxation: Base Erosion and Profit Shifting: Discussion with Department of Finance and Revenue (18 Sep 2013)

Dara Murphy: On a point of order, we have not named any corporation to date and immediately, a very large employer in my constituency is being named again by Sinn Féin. This is totally unacceptable. The Revenue Commissioners have said they will not discuss cases. I ask the Vice Chairman to deal with this point of order.

Committee on Finance, Public Expenditure and Reform: Joint Sub-Committee on Global Corporate Taxation: Base Erosion and Profit Shifting: Discussion with Department of Finance and Revenue (18 Sep 2013)

Dara Murphy: I suggest we all abide by that.
