Ciarán Lynch: In the event of a death taking place a death certificate is issued, followed by the lodging of a probate process and then there is the date of the granting of the probate process. Inheritance and gifts can be passed on but in the case of probate there is a time line. What is the impact of the 6 December cut off on that time line?

Ciarán Lynch: There is a secondary issue, if this is retrospectively dated to 6 December if someone receives probate today he or she will not comply with the legislation because he or she would have received it under one tax code and now the code has changed which retrospectively pulls them into paying.
