Written Answers — EU Funding: EU Funding (22 Jun 2010)

Jan O'Sullivan: Question 453: To ask the Tánaiste and Minister for Education and Skills if persons made redundant by a company (details supplied) that were contracted by that company and who lost their jobs as a result of redundancies there can avail themselves of the EU Globalisation Fund; if she has made representations to the EU Commission to have them included; and if she will make a statement on the...

Written Answers — School Enrolments: School Enrolments (22 Jun 2010)

Jan O'Sullivan: Question 459: To ask the Tánaiste and Minister for Education and Skills if she will review the Limerick post-primary enrolment policy in view of the fact that it is in place for more than ten years and is different from the policy in the rest of the country; if she will address the problem for children whose first choice school is over-subscribed; and if she will make a statement on the...

Order of Business. (23 Jun 2010)

Jan O'Sullivan: It is not agreed.

Order of Business. (23 Jun 2010)

Jan O'Sullivan: On behalf of the Labour Party, I also object to the guillotine being used. The legislation is concerned with the files of children who died in the care of the State and the work of the independent review group. It is extraordinary that, while the group was set up by the Minister for Health and Children, the only way it can get the information it requires is via a circuitous route through...

Order of Business. (23 Jun 2010)

Jan O'Sullivan: I strongly object to the time being curtailed. I urge the Ceann Comhairle to ensure adequate time is allowed to deal with this important issue.

Order of Business. (23 Jun 2010)

Jan O'Sullivan: The Tánaiste has offered more time for Committee and Remaining Stages. On behalf of the Labour Party, that would be helpful.

Order of Business. (23 Jun 2010)

Jan O'Sullivan: If that is acceptable to others.

Order of Business. (23 Jun 2010)

Jan O'Sullivan: I have already made the case for more time. The Ombudsman for Children only responded to the Bill in recent days, so I am sure the Minister has not had time to consider the Ombudsman's important opinions. It would be crazy of us to pass this legislation today if the Minister has not considered that important contribution to the debate. We need more time on the Bill.

Health (Amendment) Bill 2010: Second and Remaining Stages (Resumed) (23 Jun 2010)

Jan O'Sullivan: With the permission of the Chair, I wish to share time with Deputy Caoimhghín Ó Caoláin. I will give eight minutes to Deputy Ó Caoláin. Earlier this morning we were endeavouring to get more time allotted for consideration of this legislation and particularly for Committee and Report Stages but we were not successful. I note that Report Stage of the Road Traffic Bill 2009 has been...

Health (Amendment) Bill 2010: Second and Remaining Stages (Resumed) (23 Jun 2010)

Jan O'Sullivan: I am making a general point that the House is able to give more than three hours for Report Stage of a Bill dealing with road traffic and we have been given three quarters of an hour for Committee and Report Stages of a Bill dealing with the welfare of children and children who have died in the care of the State. It seems this is an unbalanced use of parliamentary time. I have to ask which...

Health (Amendment) Bill 2010: Committee and Remaining Stages (23 Jun 2010)

Jan O'Sullivan: Before I move the amendment, will the Ceann Comhairle clarify if this will continue until 5.30 p.m. or 7 p.m.?

Health (Amendment) Bill 2010: Committee and Remaining Stages (23 Jun 2010)

Jan O'Sullivan: We will not have an opportunity to submit Report Stage amendments unless we do so on the hoof.

Health (Amendment) Bill 2010: Committee and Remaining Stages (23 Jun 2010)

Jan O'Sullivan: That does not sound very much like a window of opportunity to me.

Health (Amendment) Bill 2010: Committee and Remaining Stages (23 Jun 2010)

Jan O'Sullivan: I will keep talking because we want to get through as much as we possible can.

Health (Amendment) Bill 2010: Committee and Remaining Stages (23 Jun 2010)

Jan O'Sullivan: I move amendment No. 1: In page 3, after line 32, to insert the following: "(i) any such occurrence of development that is likely to give rise to a significant risk to public health,". Any such occurrence of development that is likely to give rise to a significant risk to public health should be included in the information required of the HSE. It should be the duty of the HSE to furnish such...

Health (Amendment) Bill 2010: Committee and Remaining Stages (23 Jun 2010)

Jan O'Sullivan: There are more important areas in this legislation which we need to discuss, so I do not want to spend too much time on this one. It would be helpful and would add to the Bill if this was specifically included. I understand the Minister of State's point that the wording in section 40B(1) is very general and it can include risk to public health. I will not press the amendment on the basis...

Health (Amendment) Bill 2010: Committee and Remaining Stages (23 Jun 2010)

Jan O'Sullivan: I move amendment No. 2: In page 4, line 14, to delete "guidelines" and substitute "directions". I do not have any difficulty with Deputy Shatter's amendment. My amendment proposes to tighten up the Minister's powers in regard to the furnishing of information and regular reporting of information by the HSE. Amendment No. 2 proposes to use the term "directions" rather than "guidelines"...

Health (Amendment) Bill 2010: Committee and Remaining Stages (23 Jun 2010)

Jan O'Sullivan: I cannot help thinking of the reasons Ms Justice Laffoy resigned from the Commission to Inquire into Child Abuse and was replaced by Mr. Justice Ryan. She could not get information out of the Department of Education and Science even though this was a statutory commission of inquiry. She was so frustrated with the difficulties in getting the information she needed that she decided she needed...

Health (Amendment) Bill 2010: Committee and Remaining Stages (23 Jun 2010)

Jan O'Sullivan: A little like with politicians.
