- Joint Oireachtas Committee on Justice, Defence and Equality: General Scheme of the Policing, Security and Community Safety Bill: Discussion (15 Feb 2022)
Barry Ward: I totally agree that is wrong. There is no defence for that. I am talking more about when somebody is under investigation and he or she does not know it. That does not pose a problem for me. I do not know what Mr. McAnenly thinks about that.
- Joint Oireachtas Committee on Justice, Defence and Equality: General Scheme of the Policing, Security and Community Safety Bill: Discussion (15 Feb 2022)
Barry Ward: I agree. However, if a garda has been under investigation by GSOC for a period and does not know it, that in and of itself is not a problem. Would Mr. McAnenly disagree with me?
- Joint Oireachtas Committee on Justice, Defence and Equality: General Scheme of the Policing, Security and Community Safety Bill: Discussion (15 Feb 2022)
Barry Ward: That is something that would not necessarily be accorded to a member of the public who was under investigation for some wrongdoing. He or she would not necessarily be aware that he or she was under investigation, up to a certain point. Obviously, a conclusion could not be drawn under the investigation until such time as that person's point of view had been canvassed one way or the other....
- Joint Oireachtas Committee on Justice, Defence and Equality: General Scheme of the Policing, Security and Community Safety Bill: Discussion (15 Feb 2022)
Barry Ward: Let us say that I am being investigated for fraud by An Garda Síochána. All of the investigations would take place. My bank accounts might be examined, there might be surveillance and whatever else might happen by An Garda Síochána, and rightly. It would not want to tip me off to the fact it is on to my wrongdoing. Obviously, before the Garda sends its file to the...
- Joint Oireachtas Committee on Justice, Defence and Equality: General Scheme of the Policing, Security and Community Safety Bill: Discussion (15 Feb 2022)
Barry Ward: Mr. McAnenly and I are agree on the cases mentioned. I do not know if Ms Cunningham wants to come in on that.
- Joint Oireachtas Committee on Justice, Defence and Equality: General Scheme of the Policing, Security and Community Safety Bill: Discussion (15 Feb 2022)
Barry Ward: Would Ms Cunningham agree, though, that an investigation could evolve and that-----
- Joint Oireachtas Committee on Justice, Defence and Equality: General Scheme of the Policing, Security and Community Safety Bill: Discussion (15 Feb 2022)
Barry Ward: If I have time, Chair, may I just mention the Civil Service aspect as well?
- Joint Oireachtas Committee on Justice, Defence and Equality: General Scheme of the Policing, Security and Community Safety Bill: Discussion (15 Feb 2022)
Barry Ward: I make a distinction between civil servants in ordinary Civil Service roles, if we can call them that, and those who are engaged in An Garda Síochána. There is a higher standard required of them. I wonder, in respect of the regulation of those people, if it is not fair they are subject to greater regulation and greater transparency in their activities. What was described earlier...
- Joint Oireachtas Committee on Justice, Defence and Equality: General Scheme of the Policing, Security and Community Safety Bill: Discussion (15 Feb 2022)
Barry Ward: Would Mr. Mullen accept Civil Service members working within An Garda Síochána are in a different category from somebody working within even the Department of Justice or the Department of Agriculture, Food and the Marine or wherever it might be, and there is a basis on which they should be subject to more stringent regulation in the context of the sensitive material to which they...
- Seanad: An tOrd Gnó - Order of Business (22 Feb 2022)
Barry Ward: Like others, I join in welcoming Dolkun Isa, president of the World Uyghur Congress, to Ireland. Some of us had a chance to meet him today and to acknowledge what he said. It is important to speak to people like him and to hear what they have to say. The European directive for transparent and predictable working conditions, which is due to be transposed in this jurisdiction by 1 August,...
- Seanad: Citizens' Assemblies: Motion (23 Feb 2022)
Barry Ward: I thank Senator Currie for sharing her time. I welcome the motion. I believe in the concept of a directly elected mayor. That idea of subsidiarity and democratic accountability at local level is tremendously important. In that regard, there is a big gap in the motion. Nothing in the motion will actually empower councillors to any greater extent than they are currently empowered. I have...
- Seanad: National Lottery (Amendment) Bill 2021: Committee Stage (24 Feb 2022)
Barry Ward: In response to what the Minister of State said, I join him in acknowledging the considerable funding that has been made available this year in the form of sports capital grants. Every one of us sees the impact that this kind of funding can have on local organisations, clubs and associations in our areas. It is very plain to see. I am thinking of places in my area such as Kilbogget Park,...
- Seanad: National Lottery (Amendment) Bill 2021: Committee Stage (24 Feb 2022)
Barry Ward: I wish to make a few points. Senator Carrigy has highlighted that there are other lottery products offered that cost less. I acknowledge that there are people who use this facility through bookmakers and book with much smaller stakes. I am not sure that they are such a massive proportion of the market that it is a significant disadvantage of this legislation, but it is a fair point. At...
- Seanad: National Lottery (Amendment) Bill 2021: Committee Stage (24 Feb 2022)
Barry Ward: It has been invested in Irish advertising firms.
- Seanad: National Lottery (Amendment) Bill 2021: Committee Stage (24 Feb 2022)
Barry Ward: I do not want to make this into a back and forth all day and I have probably had more than my fair say. I do not want to interrupt the Minister of State if he has comments on what has been said.
- Seanad: National Lottery (Amendment) Bill 2021: Committee Stage (24 Feb 2022)
Barry Ward: Progress reported; Committee to sit again.
- Seanad: An tOrd Gnó - Order of Business (1 Mar 2022)
Barry Ward: I want to briefly mention an issue I have raised in the House previously relating to the Irish Thalidomide Association. I want to put on record my thanks to the Minister for Health, Deputy Stephen Donnelly, for agreeing to meet the association. While it was somewhat delayed, that meeting took place yesterday. Having spoken to Ms Finola Cassidy this morning, I believe there are the green...
- Seanad: Situation in Ukraine: Statements (1 Mar 2022)
Barry Ward: I join other Senators in expressing my abhorrence at what is happening in Ukraine. It is obvious to see. I am tremendously proud of Ireland's reaction. I would say we are hamstrung on one level because of our military neutrality and non-alignment. That is actually appropriate. I do not want Ireland to shed its military non-alignment. It is a tremendously important part of our polity....
- Seanad: An tOrd Gnó - Order of Business (2 Mar 2022)
Barry Ward: I want to raise the issue of fees for barristers in criminal defence cases. I recognise that when people hear this there is little enough sympathy for barristers. There is a misperception abroad that barristers are all very well paid. This is true of some of them. Those who engage in criminal defence work are paid through the legal aid scheme at the very bottom of the scale. To give...
- Joint Oireachtas Committee on Justice, Defence and Equality: Antisocial Behaviour: Discussion (22 Feb 2022)
Barry Ward: I am sorry I had to step out. I wanted to make a couple of acknowledgements. I have been following the debate online. I welcome the massive breadth of experience and expertise before us. I also welcome the fact that many commentators said this is not an issue for a single agency, body or group to solve. Everybody must come together to solve antisocial behaviour. It is very easy sometimes...
