Joint Oireachtas Committee on Finance, Public Expenditure and Reform: Mortgage Arrears Resolution Process: (Resumed) Permanent TSB and AIB (9 Apr 2014)

Michael Creed: I welcome our guests. I concur with Deputy Donnelly's comment that those who are not compliant ultimately end up facing legal proceedings. I am sure my constituency experience of the matter is repeated the length and breadth of the country. I often find that a certain cohort of the people involved in legal proceedings with whom I have become familiar through my constituency activities are...

Joint Oireachtas Committee on Finance, Public Expenditure and Reform: Mortgage Arrears Resolution Process: (Resumed) Permanent TSB and AIB (9 Apr 2014)

Michael Creed: MABS would be one option. I appreciate the issues arising in regard to allowing the banks to divulge information to a third party but I am simply wondering if alternatives to the nuclear option have been explored.

Joint Oireachtas Committee on Finance, Public Expenditure and Reform: Mortgage Arrears Resolution Process: (Resumed) Permanent TSB and AIB (9 Apr 2014)

Michael Creed: I note the welcome growth in mortgage lending in 2013. I understand there is a legal obligation on customers to take out life insurance policies before they can be approved for mortgages.

Joint Oireachtas Committee on Finance, Public Expenditure and Reform: Mortgage Arrears Resolution Process: (Resumed) Permanent TSB and AIB (9 Apr 2014)

Michael Creed: Does permanent tsb have a preferred provider for mortgage insurance?

Joint Oireachtas Committee on Finance, Public Expenditure and Reform: Mortgage Arrears Resolution Process: (Resumed) Permanent TSB and AIB (9 Apr 2014)

Michael Creed: Did that situation apply in previous years?

Joint Oireachtas Committee on Finance, Public Expenditure and Reform: Mortgage Arrears Resolution Process: (Resumed) Permanent TSB and AIB (9 Apr 2014)

Michael Creed: In regard to mortgages that are currently in arrears, in respect of which customers took out life assurance policies and, perhaps, payment protection policies, does the bank track payments on those policies? I would like to know the number of people in mortgage arrears who have up to date payment protection policies.

Joint Oireachtas Committee on Finance, Public Expenditure and Reform: Mortgage Arrears Resolution Process: (Resumed) Permanent TSB and AIB (9 Apr 2014)

Michael Creed: If somebody cancels a direct debit or a life assurance policy, does the bank or the provider of the policy pursue that as diligently as it pursues mortgage arrears? The provider would clearly notify the bank given that it has an interest in the policy.

Joint Oireachtas Committee on Finance, Public Expenditure and Reform: Mortgage Arrears Resolution Process: (Resumed) Permanent TSB and AIB (9 Apr 2014)

Michael Creed: Has the Deputy had a lot of pudding in the past few days?

Joint Oireachtas Committee on Finance, Public Expenditure and Reform: Mortgage Arrears Resolution Process: (Resumed) Permanent TSB and AIB (9 Apr 2014)

Michael Creed: I thank Mr. Duffy and his team from AIB. My mood has swung wildly while I have been sitting here. On the one hand, I was very impressed by the presentation, but then, on the other, I keep going back to my constituency experience, with which the presentation jars significantly. There are two main issues, the first of which is the bank's definition of affordability. I appreciate it has...

Joint Oireachtas Committee on Finance, Public Expenditure and Reform: Mortgage Arrears Resolution Process: (Resumed) Bank of Ireland (10 Apr 2014)

Michael Creed: Much of the debate has been on the mortgage side. I refer to the SME sector. Bank of Ireland's presentation referred to sustainable solutions having been put in place for nine out of ten of its SME borrowers who were in arrears. I want to zone in on the 10% of the SME sector for whom no solution is in place. The SME sector is a broad church. Fortunately it is a real engine of our...

Joint Oireachtas Committee on Finance, Public Expenditure and Reform: Mortgage Arrears Resolution Process: (Resumed) Bank of Ireland (10 Apr 2014)

Michael Creed: Does the bank require a different slate of solutions for microenterprises the debt level of which may not be associated with a tangible asset, for example, buy-to-let properties, in which many other SMEs may have invested? The debt may relate to the expansion of the business that did not work out, but a viable core business remains. I can think of a number of such businesses in my area...

Joint Oireachtas Committee on Finance, Public Expenditure and Reform: Mortgage Arrears Resolution Process: (Resumed) Bank of Ireland (10 Apr 2014)

Michael Creed: Is it policy that Bank of Ireland will not close the core business?

Joint Oireachtas Committee on Finance, Public Expenditure and Reform: Mortgage Arrears Resolution Process: (Resumed) Bank of Ireland (10 Apr 2014)

Michael Creed: However, there is an excessive concentration on buy-to-let lending. Businesses have debts on other investments that are no longer tangible assets which are in danger of dragging down the core business. They may have made myriad non-productive investments, but they cannot repay the debts associated with them. Every business did not purchase a buy-to-let property and there are debts not...

Joint Oireachtas Committee on Finance, Public Expenditure and Reform: Mortgage Arrears Resolution Process: (Resumed) Bank of Ireland (10 Apr 2014)

Michael Creed: The representatives might give us the benefit of their experience in operating the scheme, indicating which gatekeepers are superfluous in the process and how it might be streamlined more effectively because it is a good solution which allows people to remain in the house that they call home. There are too many gatekeepers along the line based on what Mr. Mason said and if we can streamline...
