Section 13(6) states: "In subsection (3) “jointly certify”, in relation to the review committee, means that all of the members of the committee make the section 13 certification concerned." Kieran O'Donnell: I am not seeking that. I am just raising the technical point. Section 13(3) provides that the committee shall, subject to section 19, jointly certify, and subsection (6) states what jointly certify means. If that paragraph was also included in sections 7, 8 and 9 it would give absolute clarity about what "jointly certify" means in those sections as well.

There appears to be an inconsistency in this regard....

I cannot see where it is set out in the Bill that notifications for the registration of medical practitioners who will carry out procedures under the reviews will be provided to the Minister. Can the Minister tell me where that is provided for in the Bill?

Kieran O'Donnell: If a medical procedure was carried out by a hospital following a review, the hospital would be required automatically under the Act to send a notification to the Minister, similar to the notification we are inserting in section 18. There will be no need to reiterate in amendment No. 83 that this will be in sections 7, 8, 9 and 13.

Kieran O'Donnell: Taking up Deputy McNamara's point, could it be taken that section 22(4) could prove to be inconsistent with section 22(1), which states it shall be an offence to intentionally destroy unborn human life? For the avoidance of doubt or any conflicts or inconsistencies, should section 22(4) be deleted? Does it cause more confusion than clarity when the primary section is section 22(1)?
