Joint Oireachtas Committee on Agriculture, Food and the Marine: Systems, Governance and Procedures in Horse Racing Ireland: Discussion (7 Mar 2017)

Michael D'Arcy: To clarify, the documentation we have showed that on two occasions, the board received legal opinion that Mr. Kavanagh was likely to have had a strong case for a contract of indefinite duration. Was Mr. Kavanagh aware of that information?

Joint Oireachtas Committee on Agriculture, Food and the Marine: Systems, Governance and Procedures in Horse Racing Ireland: Discussion (7 Mar 2017)

Michael D'Arcy: A document from 24 October 2016 from Mr. Kavanagh to the chairman stated that he was writing to confirm the provisions of clause two of his contract, that there would be no further contract at the end of this one and that his employment with HRI would cease at that point. This was agreed and minuted at the HRI board meeting on 21 July. Was that matter raised and minuted in the correct manner?

Select Committee on Agriculture, Food and the Marine: Estimates for Public Services 2017
Vote 30 - Department of Agriculture, Food and the Marine (Revised)
(21 Mar 2017)

Michael D'Arcy: On the same point, it is important that the Minister and his officials understand that the banks are not making this money available for a term of six years. It is ranging from two to four years. Numerous people have come to me who would like to have the opportunity to avail of a six year term, but the banks have tried to split the amount into a number of different timeframes for different...

Select Committee on Agriculture, Food and the Marine: Estimates for Public Services 2017
Vote 30 - Department of Agriculture, Food and the Marine (Revised)
(21 Mar 2017)

Michael D'Arcy: The Minister said AIB has allocated all of its funding. Has he requested an analysis in respect of how many people were refused? If he does not have that information, I believe he should get it and give it to the committee as quickly as possible. It is also important that we find out how many people were refused by SBCI and how many did not meet the criteria, given that there were...

Select Committee on Agriculture, Food and the Marine: Estimates for Public Services 2017
Vote 30 - Department of Agriculture, Food and the Marine (Revised)
(21 Mar 2017)

Michael D'Arcy: There was a form to be sent to SBCI and it was to sanction the bank to go ahead with the application. I am pretty sure there was. We need to do as much analysis as we can. There is no point having the analysis in four months' time.

Select Committee on Agriculture, Food and the Marine: Estimates for Public Services 2017
Vote 30 - Department of Agriculture, Food and the Marine (Revised)
(21 Mar 2017)

Michael D'Arcy: To clarify, we all know it is an unsecured loan, and that is in the terms and conditions. However, there are farmers getting much greater loans at much higher interest rates for machinery, and with one quarter of the paperwork and effort that is going into this loans process from the same banks. Somebody has complicated this nicely in order for the banks to benefit.

Select Committee on Agriculture, Food and the Marine: Estimates for Public Services 2017
Vote 30 - Department of Agriculture, Food and the Marine (Revised)
(21 Mar 2017)

Michael D'Arcy: The Minister is misunderstanding me. What I am saying is that the banks have made it overburdensome.

Select Committee on Agriculture, Food and the Marine: Estimates for Public Services 2017
Vote 30 - Department of Agriculture, Food and the Marine (Revised)
(21 Mar 2017)

Michael D'Arcy: In all likelihood, what would have happened is that they took a figure of three years and decided that would be the average term for the loans. Every 1% subsidy the banks get paid, and this is how it would have happened going back to the 1980s and 1990s, is €1.5 million, so instead of it being 2.9% it should be 5.9%. That 3% is close to €5 million per annum. That is where the...

Select Committee on Agriculture, Food and the Marine: Estimates for Public Services 2017
Vote 30 - Department of Agriculture, Food and the Marine (Revised)
(21 Mar 2017)

Michael D'Arcy: This is a subject that is a little raw for me at the moment. In terms of plant, I am using this example to make a general plea and I ask the Chairman to allow me some scope in that regard. The usage of quads on farms is becoming very dangerous. The number of people killed or paralysed per annum is far too high. I spoke to a health and safety specialist who made the valid point that if...
