Michael D'Arcy: I will ask Mr. Clarken about the base erosion and profit shifting, BEPS, process. Was it he who stated that the BEPS process will probably not be a success?

Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: EU State Aid Investigations into Tax Rulings (resumed) (7 Feb 2017)

Michael D'Arcy: If the US is not prepared to play ball on country to country reporting, is it Mr. Clarken's position that it cannot work?

Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: EU State Aid Investigations into Tax Rulings (resumed) (7 Feb 2017)

Michael D'Arcy: We were the first country to move on the BEPS process. Some other countries within the OECD still have not moved. It was budget 2014 when we moved ahead of everybody else and we were told by the Department of Finance that there would be first-mover benefit. Did any first-mover benefit accrue to ourselves?

Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: EU State Aid Investigations into Tax Rulings (resumed) (7 Feb 2017)

Michael D'Arcy: Could the US leave the BEPS process?

Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: EU State Aid Investigations into Tax Rulings (resumed) (7 Feb 2017)

Michael D'Arcy: I will discuss the Apple case with Mr. Keegan and Mr. Redmond and then the hypotheticals. Mr. Tim Cook stated in the statement in August of last year that Apple had taken a Revenue opinion on how the taxes would be applied and acted in accordance with that opinion. The Revenue Commissioners have also said that is the case, that they gave an opinion of how the law should be applied to the...

Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: EU State Aid Investigations into Tax Rulings (resumed) (7 Feb 2017)

Michael D'Arcy: I am putting it hypothetically.

Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: EU State Aid Investigations into Tax Rulings (resumed) (7 Feb 2017)

Michael D'Arcy: What about the prospect of a case taken against the State on the basis that the information is given by the Revenue Commissioners to a company and subsequently a state aid case is taken?

Written Answers — Department of Agriculture, Food and the Marine: Basic Payment Scheme Payments (8 Feb 2017)

Michael D'Arcy: 239. To ask the Minister for Agriculture, Food and the Marine when a 2015 BPS payment will issue to a person (details supplied) who has had entitlements transferred to them and land leased; and if he will make a statement on the matter. [6273/17]

Hospital Waiting Lists: Statements (9 Feb 2017)

Michael D'Arcy: I compliment the vast majority of the staff who work in the HSE. They do a good job and many people get a good service from this country's health sector. This is something that goes unsaid too often. To be honest, I am not surprised that issues and problems have developed. The country was bankrupt. There is always a lag or a delay in such circumstances. This is what happens after a...

Commission of Investigation relating to disclosures by members of An Garda Síochána: Statements (9 Feb 2017)

Michael D'Arcy: It is sad that we are discussing these issues today. When the Garda Commissioner was appointed, we were led to believe there would be all sorts of sweeping changes. In reality, unfortunately, she has acted in much the same manner as previous Commissioners. Nothing has changed. In fact, things have got a lot worse. We are going back to the days of the early 1980s when the acronym GUBU,...

(16 Feb 2017)

Michael D'Arcy: According to the figures the Taoiseach has outlined, more than €300 million has been allocated for the tribunals for this period. I previously put it to him that on each occasion we establish a tribunal or commission of investigation, people come in to do the work, the tribunal ends, the investigation ends and we let all those people go. The question I have - I have put it to the...

(16 Feb 2017)

Michael D'Arcy: The previous Administration enacted the whistleblowers legislation. With that legislation in place it is likely that there will be a more consistent flow of issues of this nature. The papers relating to this were produced prior to the enacting of that legislation. There are more than 200,000 public servants so I believe it is something that should be considered again.

Michael D'Arcy: I will move on to Brexit. The Secretary General of the Department of Finance, Mr. Moran, appeared before the committee and he did not fill us with confidence when he informed us that four members of staff within the Department are dedicated to Brexit. How many of the staff in the Department of the Taoiseach are dedicated to Brexit?

Michael D'Arcy: Were they redeployed or were they brought in from outside? If they were redeployed, from what areas were they redeployed? Is there now an area potentially under-staffed because the 31 staff have been allocated to Brexit?

(16 Feb 2017)

Michael D'Arcy: There have been reports in the last number of days relating to a Brexit fund of some type. Has consideration been given to a Brexit fund? Business is more capable and faster moving than Government, perhaps, in terms of difficulty with Brexit, the reallocation of resources or maybe even reducing the size of a business. However, the area business is unable to influence will be the potential...

(16 Feb 2017)

Michael D'Arcy: I will look back to 2016 and the commemorative events throughout that year. This might appear to be trivial but it is something that was done particularly well, that is, the retrieval of the national flag from the ultra-nationalists. There were a number of flag raising ceremonies and there was the construction of flag poles. A little booklet was issued from the Taoiseach's office outlining...

Michael D'Arcy: My last point relates to the Taoiseach's attention towards the north inner city, an area that has been left behind. One of the disappointing things is that this is as a result of a decade or so in which we were not capable of investing. There is a version of the north inner city in every county in the country at the moment. The local authorities now have a role in economic development,...
