- Seanad: Criminal Law (Sexual Offences) Bill 2015: Committee Stage (11 Dec 2015)
Trevor Ó Clochartaigh: Yes, I have been asked by Senator van Turnhout to move her amendment. I move amendment No. 35:In page 22, line 27, after “in this section” to insert “and in section 19B”. The purpose of amendment No. 36 in my name is to restrict the availability of therapy notes in criminal proceedings to those which have a direct bearing on the offence in question. We have...
- Seanad: Criminal Law (Sexual Offences) Bill 2015: Committee Stage (11 Dec 2015)
Trevor Ó Clochartaigh: I welcome the Minister of State’s contribution. It is important these issues are taken on board. We will take the Minister of State at his word that amendments will be introduced on Report Stage. As we tend to get amendment lists quite late, would it be possible to get these amendments at an earlier stage after they have been drafted to ensure we can get sight if they cover the...

- Seanad: Criminal Law (Sexual Offences) Bill 2015: Committee Stage (11 Dec 2015)
Trevor Ó Clochartaigh: On a point of information, recently there has been a very lengthy court case in Britain on this issue.
- Seanad: Criminal Law (Sexual Offences) Bill 2015: Committee Stage (11 Dec 2015)
Trevor Ó Clochartaigh: It was found that this scenario had happened. A person impersonated somebody else and the defendant won the case.

Trevor Ó Clochartaigh: Yes, it was.
- Seanad: Criminal Law (Sexual Offences) Bill 2015: Committee Stage (11 Dec 2015)
Trevor Ó Clochartaigh: We will give the Senator the salacious details later.
- Seanad: Assisted Decision-Making (Capacity) Bill 2013: Report and Final Stages (15 Dec 2015)
Trevor Ó Clochartaigh: Cuirim céad fáilte roimh an Aire Stáit arís. It is a good day to be debating the Bill and I hope we will get through it in an expedient manner.I concur with Senator Jillian van Turnhout on the issues she is raising because I note that a number of organisations, such as Inclusion Ireland, have raised this as a particular issue. The thought of placing the decision support...
- Seanad: Assisted Decision-Making (Capacity) Bill 2013: Report and Final Stages (15 Dec 2015)
Trevor Ó Clochartaigh: It is corrected now.
- Seanad: Assisted Decision-Making (Capacity) Bill 2013: Report and Final Stages (15 Dec 2015)
Trevor Ó Clochartaigh: In principle this group of amendments make a lot of sense. The only concern I would raise is that as we have seen with the Legal Aid Board, there is a huge backlog and the resources available for free legal aid are grossly underfunded. There is a huge waiting list and people find it very hard to access. The principle is good but the resources have to be made available if it is to work....
- Seanad: Assisted Decision-Making (Capacity) Bill 2013: Report and Final Stages (15 Dec 2015)
Trevor Ó Clochartaigh: It has more to do with the free legal aid service itself.
- Seanad: Assisted Decision-Making (Capacity) Bill 2013: Report and Final Stages (15 Dec 2015)
Trevor Ó Clochartaigh: I thank the Minister of State for her explanation. We were moving the amendment because the UN Committee on the Rights of Persons with Disabilities has stated in general comment No. 1 that "[u]nder article 12 of the Convention, perceived or actual deficits in mental capacity must not be used as justification for denying legal capacity". Since this Bill is being developed as part of...

Trevor Ó Clochartaigh: They are always good. Senator Keane just does not see the merit in them often enough.
- Seanad: Assisted Decision-Making (Capacity) Bill 2013: Report and Final Stages (15 Dec 2015)
Trevor Ó Clochartaigh: I thank Senator Conway. It is a very important amendment and we appreciate that the Minister of State has taken it on board. We will not be pressing amendment No. 33.
- Seanad: Assisted Decision-Making (Capacity) Bill 2013: Report and Final Stages (15 Dec 2015)
Trevor Ó Clochartaigh: I support Senator van Turnhout's comments. This mirrors a debate held on Committee Stage about advance health care directives being legally binding. I will not repeat all the comments but a strong argument was put forward and some of the organisations represented in the Visitors Gallery tonight are still calling for that. Senators have been contacted again by those groups in light of that...
- Seanad: Assisted Decision-Making (Capacity) Bill 2013: Report and Final Stages (15 Dec 2015)
Trevor Ó Clochartaigh: Ba mhaith liom aontú leis an méid atá ráite roimhe seo. Is lá iontach tábhachtach go deo é seo, go háirithe dóibh siúd a úsáideann na seirbhísí seo agus atá ag fanacht na céadta bliain leis an lá seo. This is a wonderful day. It is a proud day for everyone in the House. We have to remember that the most...

- Seanad: Commencement Matters: Rural Social Scheme Administration (16 Dec 2015)
Trevor Ó Clochartaigh: Cuirim fáilte roimh an Aire Stáit. Tá na saoistí ar na scéimeanna sóisialta tuaithe ag obair an-mhaith ar fud na tíre. Dar leo, tá easpa cothromaíochta idir na coinníollacha oibre ata acu féin agus na coinníollacha atá ag saoistí ar na scéimeanna eile. I am sure the Minister of State will be well aware of the...
