- Written Answers — Department of Justice and Equality: Judicial Appointments (3 Dec 2020)
Helen McEntee: I have given a full account of all matters related to the filling of the Supreme Court vacancy during the Statements and Questions and Answers on Judicial Appointments held in the Dáil on 26 November last. During the debate, I informed the House, that in line with the Cabinet handbook, between 11 and 14 July I informed the Taoiseach, the Tánaiste, the Minister for Transport,...
- Written Answers — Department of Justice and Equality: Closed-Circuit Television Systems (3 Dec 2020)
Helen McEntee: As the Deputy will be aware, community-based CCTV is governed by section 38(3)(c) of the Garda Síochána Act 2005 and the Garda Síochána (CCTV) Order 2006. This legal framework requires that any proposed community CCTV scheme must: - be approved by the local Joint Policing Committee, - have the prior support of the relevant Local Authority, which must also act as data...
- Written Answers — Department of Justice and Equality: Cyberbullying Issues (3 Dec 2020)
Helen McEntee: I remain concerned at the deeply harmful effects which cyber-bullying can have on persons who experience that or other harmful online behaviours. These experiences can be devastating for those affected. Harassment and abuse in any form, whether online or otherwise, is utterly unacceptable and has no place in Irish society. I am, along with my Government colleagues, fully committed to...
- Written Answers — Department of Justice and Equality: Deportation Orders (3 Dec 2020)
Helen McEntee: The person concerned has instituted Judicial Review proceedings on 10 October 2020. These Judicial Review proceedings are ongoing at present and as the matter is sub judice, it would not be appropriate for me to make any further comment at this time. Queries in relation to the status of individual Immigration cases may be made directly to my Department by e-mail using the Oireachtas Mail...
- Written Answers — Department of Justice and Equality: Immigration Policy (3 Dec 2020)
Helen McEntee: My Department is currently finalising the amendment of the European Communities (Free Movement of Persons) Regulations 2015, to bring them in line with the ruling of the European Court of Justice (ECJ) in the Chenchooliah case. As soon as the Regulations are amended and the appropriate procedure has been finalised, the Immigration Service will be in contact with the various persons and their...
- Written Answers — Department of Justice and Equality: Visa Applications (3 Dec 2020)
Helen McEntee: As a person who was accepted as being a family member of an EU citizen who was exercising EU Treaty Rights in the State, the immigration case of the person concerned falls within the parameters of the European Court of Justice Ruling in the Chenchooliah case. In light of that situation, the Immigration Service of my Department has been engaging with the person concerned with a view to having...
- Written Answers — Department of Justice and Equality: Judicial Appointments (3 Dec 2020)
Helen McEntee: Judicial appointments are made in accordance with Articles 13.9 and 35.1 of the Constitution, by the President acting on the advice of the Government. As with all judicial vacancies, a request is made to the Judicial Appointments Advisory Board (JAAB) for a list of suitable candidates for appointment and the names of all those who applied. The JAAB recommendations, along with any expressions...
- Written Answers — Department of Justice and Equality: Immigration Status (3 Dec 2020)
Helen McEntee: The permission to remain of the person referred to by the Deputy expired on 22 September 2019. This permission was granted on the basis of being the parent of an Irish Born Child. As this permission has lapsed for over a year, the person concerned should write to Unit 4, Domestic Residence and Permissions Division, Immigration Service Delivery, 13/14 Burgh Quay, Dublin 2, D02 XK70 and provide...
- Written Answers — Department of Justice and Equality: Naturalisation Applications (3 Dec 2020)
Helen McEntee: The application for a certificate of naturalisation from the person referred to by the Deputy, continues to be processed. The granting of Irish citizenship through naturalisation is a privilege and an honour which confers certain rights and entitlements not only within the State but also at European Union level and it is important that appropriate procedures are in place to preserve the...
- Seanad: Withdrawal of the United Kingdom from the European Union (Consequential Provisions) Bill 2020: Committee Stage (3 Dec 2020)
Helen McEntee: I thank the Senators for their comments. Section 115 is connected with sections 116 and 117, the sections they oppose. Given that these are all integral parts of the functioning of Part 18, I might outline the reasons behind it. We are trying, inasmuch as possible in respect of this legislation in its entirety, not just of the justice parts, is to mirror arrangements we have with the UK....
- Seanad: Withdrawal of the United Kingdom from the European Union (Consequential Provisions) Bill 2020: Committee Stage (3 Dec 2020)
Helen McEntee: The Bill sets out a clear set of criteria in accordance with EU law that we are requiring the UK to adhere to. Therefore, in order for us to assign it as a safe third country, it will have to fulfil those criteria. We are very clear that it is not just a blanket because we are trying to keep everything the same. That set of criteria still exists and we will expect it to adhere to it.
- Seanad: Withdrawal of the United Kingdom from the European Union (Consequential Provisions) Bill 2020: Committee Stage (3 Dec 2020)
Helen McEntee: The reason we have the age of 14 is that under EURODAC, which is the European database for international protection and comparisons of fingerprints for applicants for international protection, the age is 14. We are complying with this EURODAC regulation from 2013. Therefore, it is the case at a European level but it is also the same within the UK, so, again, we are mirroring what we had...
- Seanad: Withdrawal of the United Kingdom from the European Union (Consequential Provisions) Bill 2020: Committee Stage (3 Dec 2020)
Helen McEntee: It is an issue we can discuss in more detail later. This part is an integral part, and the overall Part 18 would not work without it.The amendment would delete a provision whereby an application for international protection is admissible if a person arrives from a safe third country and it is important that we have that provision within this legislation. It is necessary to provide the basis...
- Seanad: Withdrawal of the United Kingdom from the European Union (Consequential Provisions) Bill 2020: Committee Stage (3 Dec 2020)
Helen McEntee: I will speak to the three amendments together and re-stress that we are trying to mirror what we currently have. I take the points that the Senators are making and apologise for not being able to take the Commencement matter to which the Senator referred. I hope to be in the House next week for the wider debate on the Private Members' Bill that has been put down. We are following EU...
- Seanad: Withdrawal of the United Kingdom from the European Union (Consequential Provisions) Bill 2020: Committee Stage (3 Dec 2020)
Helen McEntee: I will come back to the Senator on the issue of family reunification. What we trying to do is mirror the existing process for family reunification. We must have a system whereby, if somebody is granted protection in a safe country, we continue to adhere to the regulations that have been set out. It might not necessarily be the Dublin regulation if the transition period ends without the...
- Seanad: Withdrawal of the United Kingdom from the European Union (Consequential Provisions) Bill 2020: Committee Stage (3 Dec 2020)
Helen McEntee: What we are trying to do is mirror what we currently have in that sense. I will come back with more details, if that is acceptable.
- Seanad: Withdrawal of the United Kingdom from the European Union (Consequential Provisions) Bill 2020: Committee Stage (3 Dec 2020)
Helen McEntee: There is a view that this perhaps is not necessary. What the Senator is trying to do, as she outlined, is put in place protections. The amendment would insert a new section 51A requirement to inform a person, who is the subject of a return order, of that legal assistance. However, a person who is the subject of a return order already should have received the information required under...
- Seanad: Withdrawal of the United Kingdom from the European Union (Consequential Provisions) Bill 2020: Committee Stage (3 Dec 2020)
Helen McEntee: Yes, that is my understanding.
- Seanad: Withdrawal of the United Kingdom from the European Union (Consequential Provisions) Bill 2020: Committee Stage (3 Dec 2020)
Helen McEntee: I will speak to the three amendments together. Senator Higgins has touched on a number of points in her comments. We have quite a clearly set out process for people going through the international protection application process. It is very distressing and can be very difficult for people to get a letter saying they have a number of days to make services aware of what they intend to do....
- Seanad: Withdrawal of the United Kingdom from the European Union (Consequential Provisions) Bill 2020: Committee Stage (3 Dec 2020)
Helen McEntee: I, too, appreciate where Senator Higgins is coming from and when it comes to dealing with children, we need to take every precaution. We always need to be sure that we are treating them, and every individual, in the way that they deserve, and that is with respect. Insofar as possible, and I hate to repeat this point, but what we are trying to do is to mimic and to essentially put in place a...
