- Seanad: Water Services (Amendment) Bill 2011: Committee Stage (Resumed) (24 Nov 2011)
Trevor Ó Clochartaigh: That is why they were not available; they had not even been drawn up.
- Seanad: Oifig an Choimisinéara Teanga (24 Nov 2011)
Trevor Ó Clochartaigh: Ba mhaith liom fáilte a chur roimh an Aire Stáit agus tá mé thar a bheith buÃoch dó as bheith chomh foighdeach agus as fanacht linn. Tá ceist fÃor-thábhachtach ardaithe againn, ceist atá ag déanamh tinnis do phobal na Gaeilge agus na Gaeltachta maidir leis an scéal a cuireadh amach an tseachtain seo caite faoi na hathruithe sa seirbhÃs poiblÃ, go háirithe an t-athrú atá...
- Seanad: Oifig an Choimisinéara Teanga (24 Nov 2011)
Trevor Ó Clochartaigh: Gabhaim buÃochas leis an Aire Stáit as ucht an fhreagra a thug sé. TreisÃonn an méid atá ráite aige an imnà atá orm. Dúirt sé go soiléir "nach ndeachaigh" an Roinn Caiteachais Phoiblà agus Athchóirithe i dteagmháil le hOifig an Ombudsman nó Oifig an Choimisinéara Teanga. Tá sé sin dochreidte nuair atá an Rialtas ag caint ar cónascadh a dhéanamh. Cén eolas a bhà sé...
- Seanad: Oifig an Choimisinéara Teanga (24 Nov 2011)
Trevor Ó Clochartaigh: Labhair an Aire Stáir mar gheall ar an athbhreithniú atá á dhéanamh ar Acht na dTeangacha Oifigiúla 2003. Tá mé iontach mÃshásta leis an bhfreagra a fuair mé. Nà aontaÃm leis an cur chuige atá ag an Rialtas. Má léirÃonn an aiseolas a fhaigheann an Rialtas ón bpobal i leith Oifig an Choimisinéara Teanga, i gcomhthéacs an athbhreithniú atá ar siúl i leith Acht 2003,...
- Seanad: Oifig an Choimisinéara Teanga (24 Nov 2011)
Trevor Ó Clochartaigh: Tá mé ag iarraidh a bheith soiléir go dtuigeann an Aire Stáit an méid atá i gceist agam. Faoi láthair, tá Oifig an Choimisinéara Teanga neamhspleách ón Ombudsman. Tá an choimisinéir ábalta seasamh ar a chosa féin. Má léirÃonn an aiseolas a fhaigheann an Rialtas maidir leis an athbhreithniú ar an Acht go gceaptar go bhfuil sé nÃos fearr go bhfanfadh Oifig an...

- Seanad: Oifig an Choimisinéara Teanga (24 Nov 2011)
Trevor Ó Clochartaigh: Má léirÃonn an t-aiseolas gur cheart go bhfanfadh Oifig an Choimisinéara neamhspleách an mbeidh an Rialtas sásta athbhreithniú a dhéanamh ar an gcinneadh?
- Seanad: Water Services (Amendment) Bill 2011: Report and Final Stages (28 Nov 2011)
Trevor Ó Clochartaigh: I move amendment No. 1a: In page 3, between lines 24 and 25, to insert the following: "4.âThe Principal Act is amended by inserting after section 8(4) the following: "(5) Where a member of the Garda SÃochána, or an appointed person for the purposes of this Act, finds a person and has reasonable grounds for believing that such person is committing or has committed an offence to which...
- Seanad: Water Services (Amendment) Bill 2011: Report and Final Stages (28 Nov 2011)
Trevor Ó Clochartaigh: We are quite worried that it leaves the onus completely on the owners, some of whom will be well able to understand that but there might be a lot of people who will not. I am not sure what the information campaign to indicate to people what they must do will be. We would have expected that it would have at least included a letter from a local authority to anybody with a septic tank.
- Seanad: Water Services (Amendment) Bill 2011: Report and Final Stages (28 Nov 2011)
Trevor Ó Clochartaigh: In light of what the Minister said, we will take it in good faith and withdraw the amendment because we want to spend time on the other amendments.
- Seanad: Water Services (Amendment) Bill 2011: Report and Final Stages (28 Nov 2011)
Trevor Ó Clochartaigh: We will not move amendment No. 7 because it is ostensibly the same motion and we would like to debate some of the other amendments.
- Seanad: Water Services (Amendment) Bill 2011: Report and Final Stages (28 Nov 2011)
Trevor Ó Clochartaigh: I move amendment No. 8: In page 6, to delete lines 46 to 48 and substitute the following: "(12) A person who fails to comply with a request under subsection (11) within 10 days, shall receive a warning notification and must produce within 90 days.". Táimid ag bualadh leis an leasú moltach seo. We were just looking at the time allocated being ten days for someone who fails to comply with...
- Seanad: Water Services (Amendment) Bill 2011: Report and Final Stages (28 Nov 2011)
Trevor Ó Clochartaigh: That is why he was seeking for Cavan to be exempt.
- Seanad: Water Services (Amendment) Bill 2011: Report and Final Stages (28 Nov 2011)
Trevor Ó Clochartaigh: I thank the Minister for taking into consideration our constructive proposal and I thank Senator Keane for supporting it, as it is important. We suggest that 90 days is a reasonable amount of time. I also thank the Minister for his clarification that failure to register will not be a criminal offence, although whether that will follow through the full legal system is unknown. Somebody may...
- Seanad: Water Services (Amendment) Bill 2011: Report and Final Stages (28 Nov 2011)
Trevor Ó Clochartaigh: There might be many who cannot. The issue we have had from day one is that many people are not in a position to pay even if they want to.
- Seanad: Water Services (Amendment) Bill 2011: Report and Final Stages (28 Nov 2011)
Trevor Ó Clochartaigh: There is no inability-to-pay clause anywhere in this Bill which would apply if a citizen was in negative equity or in circumstances in which he or she could not pay even if she wanted to. We are opposed to anyone ending up in prison as a result of this process. The State should back people up. If we are able to pay â¬26,000 a day in fines to Europe, surely we should be able to help...
- Seanad: Water Services (Amendment) Bill 2011: Report and Final Stages (28 Nov 2011)
Trevor Ó Clochartaigh: I move amendment No. 10: In page 7, between lines 10 and 11, to insert the following: "(c) that if it can be shown by reference to the owner of the domestic waste water treatment system's income, that they do not have the means to pay the fine, in the opinion of the inspector, that the fee be waived;". The amendment is related to the point I have just made. There was a lot of debate last...
- Seanad: Water Services (Amendment) Bill 2011: Report and Final Stages (28 Nov 2011)
Trevor Ó Clochartaigh: We are disappointed that the Minister refuses to take on board our suggestions. The Ombudsman has intervened in regard to the waste waivers that have been introduced by some county councils but not others. She believes it would be preferable to implement a national policy on waivers. This is why we suggest this should be introduced at a national level. We completely disagree on the...
