Victor Boyhan: Ms Minch said leave applications would be made on notice, rather than ex parte, as at present. What is the significance of that? What is her general comment, good, bad or indifferent? Should it remain?

Victor Boyhan: The real issue of concern is that no appeal would lie from the decision of the High Court to the Court of Appeal. That is clearly disturbing and of great concern. Will Mr. Flynn take up that point? We might come back to Ms Minch.

- Joint Oireachtas Committee on Housing, Planning and Local Government: General Scheme of the Planning and Development Bill 2022: Discussion (Resumed) (2 Mar 2023)
Victor Boyhan: It would be very useful to the committee, if they come back to make a submission, were the witnesses to have greater clarity. There is clearly no clarity among either organisation here on this issue. I understand what they have set out, but I get a sense there is no clarity from either on the issue. The committee would be very interested to hear a more definite argument, one way or another.
- Joint Oireachtas Committee on Housing, Planning and Local Government: General Scheme of the Planning and Development Bill 2022: Discussion (Resumed) (2 Mar 2023)
Victor Boyhan: I am sorry for putting the witnesses on the spot as the cameras roll but what we are hearing from them is that a lot of thought must go into that. If the witnesses are having difficulties with the matter, we will have further difficulties. An explanation would be very helpful.
- Seanad: Patient Safety (Notifiable Incidents and Open Disclosure) Bill 2019: Second Stage (7 Mar 2023)
Victor Boyhan: I welcome the Minister. I grasped his brief overview very quickly. I took the time today to read the record of the Dáil and that is exactly as I understood it. I wish to acknowledge the enormous work the Minister has personally committed to driving this legislation. The Minister also mentioned and acknowledged in his speech to the Dáil the importance of his team in the...

- Seanad: An tOrd Gnó - Order of Business (8 Mar 2023)
Victor Boyhan: On the theme of International Women's Day, I wish it a success and join with others in the comments they have made. As I was sitting here thinking about it, I was reminded of the British-Irish Parliamentary Assembly, BIPA. We met in Stormont, unlike so many others who cannot meet there. We met in the Chamber there on Sunday and Monday. On Monday, three women bounced into the Chamber from...
- Joint Oireachtas Committee on Housing, Planning and Local Government: General Scheme of the Planning and Development Bill 2022: Discussion (Resumed) (7 Mar 2023)
Victor Boyhan: I welcome our guests today. They gave very informative presentations. I wish to follow up on what the Cathaoirleach said. He asked how we ensure it is representative. I am not really interested in whether it is representative or not. If it is an observation or an objection, the planning application or observation should be assessed on the merits of proper planning and sustainable...

Victor Boyhan: Regarding Mr. Mandal's letter accompanying his submission, in the second-last paragraph, two points jumped off the page. Mr. Mandal said they are concerned about the roles of both the Office of the Planning Regulator, OPR, and An Bord Pleanála as independent entities. They are also concerned about mission creep in the OPR. Will Mr. Mandal explain that to the committee?

Victor Boyhan: I thank the witnesses. As someone who has been involved in the planning process, it is one of the many things that politicised me. I was exceptionally active in the area. I am reminded of the very successful Central Body for Residents Associations, ACRA. They mobilised. I think it is time for another mobilisation of the citizens in planning. The local elections are next year. I...
