Joint Oireachtas Committee on Housing, Planning and Local Government: General Scheme of the Planning and Development Bill 2022: Discussion (Resumed) (14 Feb 2023)

Cian O'Callaghan: I have a question for the representatives of Property Industry Ireland. In the annexe to their opening statement, they talk about wanting An Bord Pleanála to retain its powers to grant permission for developments that may materially contravene development plan policy or objectives. In the rest of their contribution, they have been talking about the importance of certainty and reducing...

Select Committee on Housing, Planning and Local Government: Nagoya Protocol: Motion (19 Jan 2023)

Cian O'Callaghan: I also thank the Minister of State for his work in this area and for bringing this matter before the committee. While it is late; it is welcome to see this happening. In practical terms, what does all of this mean? When we talk about users, for example, who, in an Irish context, are typical users and what legal obligations are being put on them? In practical terms, what does this mean...

Select Committee on Housing, Planning and Local Government: Nagoya Protocol: Motion (19 Jan 2023)

Cian O'Callaghan: Before Mr. Moore comes in I have a question. The obligations of public bodies acting in the public interest are one thing but private bodies with their own interests are another. How far will these obligations go for private bodies? Does this have to be worked out? I would like some insight into this.

Select Committee on Housing, Planning and Local Government: Nagoya Protocol: Motion (19 Jan 2023)

Cian O'Callaghan: The legislation we have in place ensures a pharmaceutical or medical company operating in Ireland that is using genetic resources from a country such as Peru is legally obliged to go through the process. Will it share information with the country of origin of the genetic information or resources or will it share it universally?

Select Committee on Housing, Planning and Local Government: Nagoya Protocol: Motion (19 Jan 2023)

Cian O'Callaghan: It is then shared universally.

Select Committee on Housing, Planning and Local Government: Nagoya Protocol: Motion (19 Jan 2023)

Cian O'Callaghan: Some of the intent is that the provider country will have the most rights to access. This is what we are doing in practical terms with the protocol and the legislation in place.

Select Committee on Housing, Planning and Local Government: Nagoya Protocol: Motion (19 Jan 2023)

Select Committee on Housing, Planning and Local Government: Nagoya Protocol: Motion (19 Jan 2023)

Cian O'Callaghan: There is a monitoring role to ensure no one is pulling a fast one or using economic influence to put undue pressure to make a poor agreement. There will be an ongoing monitoring role for us to be satisfied that the standards are being met. This will be the important ongoing work.

Joint Oireachtas Committee on Housing, Planning and Local Government: General Scheme of the Planning and Development Bill 2022: Discussion (Resumed) (21 Feb 2023)

Cian O'Callaghan: I thank everyone who came in for their opening statements. I wish to ask the CCMA representatives about the part in their statement about taking estates in charge. They talked about how this is included in the draft Bill and how this is welcome. Are there differences between what is in this draft Bill and what is in the existing legislation? If they could explain a bit about that, that...

Joint Oireachtas Committee on Housing, Planning and Local Government: General Scheme of the Planning and Development Bill 2022: Discussion (Resumed) (21 Feb 2023)

Cian O'Callaghan: I do not think that section of the Bill has timelines in it. Does it? Is the lack of timelines an issue or potentially a weakness in it? For example, I was talking to people on Saturday in an area of my constituency that was built 18 years ago and is not taken in charge. They are waiting 18 years to be taken in charge. As they are waiting, public areas are deteriorating. This...

Joint Oireachtas Committee on Housing, Planning and Local Government: General Scheme of the Planning and Development Bill 2022: Discussion (Resumed) (21 Feb 2023)

Cian O'Callaghan: Head 83 in section 2(g), which relates to conditions on planning permissions, is about requiring bonds and is connected to the issue of taking in charge. If it is not built to the standard it should, the local authority can have recourse to using the bond. An issue that frequently comes up when it gets to that situation is that local authorities will say there is insufficient money in the...

Cian O'Callaghan: Head 156 relates to some of the issues about refusals of planning permission for past failure to comply but I understand it has never been used by a local authority and that has to be addressed.
