Seanad: Heritage Bill 2016: Committee Stage (Resumed) (2 Mar 2017)

Heather Humphreys: To clarify something in regard to the cross-Border body and the agreement on which it was set up, we cannot extend the remit of Waterways Ireland. We can legislate within the remit for the South, which is for the Grand Canal, the Royal Canal, the Barrow and the Shannon, but not the Erne part of it. We can do that within the remit of what we have but we cannot extend the remit of Waterways...

Seanad: Heritage Bill 2016: Committee Stage (Resumed) (2 Mar 2017)

Heather Humphreys: That is okay, but not the safety. It is the safety that I am talking about.

Seanad: Heritage Bill 2016: Committee Stage (Resumed) (2 Mar 2017)

Heather Humphreys: I will come back to that because I am not quite sure what the Senator is referring to. I was talking about amendment No. 1h.

Seanad: Heritage Bill 2016: Committee Stage (Resumed) (2 Mar 2017)

Heather Humphreys: Following, "the regulation of the conditions (including conditions as to safety) under which boats may be used on the canals;", the Senator wants to insert, "subject to agreed criteria for safety standards aboard a vessel and adjudicated upon by a suitably qualified person", but what I am saying is that safety standards are a matter for the Department of Transport, Tourism and Sport.

Seanad: Heritage Bill 2016: Committee Stage (Resumed) (2 Mar 2017)

Heather Humphreys: The type of boat is regulated but not safety on the boat. Health and safety issues on the boat are a matter for the Department of Transport.

Seanad: Heritage Bill 2016: Committee Stage (Resumed) (2 Mar 2017)

Heather Humphreys: I will come back to the Senator on it. We are regulating the use of the canals not the use of the boats. In regard to Senator Craughwell's amendments Nos. 1j and a1k, these proposals overly limit the closing of navigation to emergency situations and does not take account of other reasons why a navigation can be closed, such as land drainage, flood management and control, when a loss of...

Seanad: Heritage Bill 2016: Committee Stage (Resumed) (2 Mar 2017)

Heather Humphreys: Yes but the issue is what are "agreed procedures?" We could end up tying ourselves up in knots as to what is an emergency situation. An emergency is an emergency. We do not want to legislate such that if a person is drowning it would be necessary to consider agreed procedures. I accept that is an extreme example.

Seanad: Heritage Bill 2016: Committee Stage (Resumed) (2 Mar 2017)

Heather Humphreys: We can consider that in the context of the by-laws. I think I have covered all of the points raised.

Seanad: Heritage Bill 2016: Committee Stage (Resumed) (2 Mar 2017)

Heather Humphreys: I have already addressed that issue.

Seanad: Heritage Bill 2016: Committee Stage (Resumed) (2 Mar 2017)

Heather Humphreys: It will go out for public consultation. I have a response to Senator Alice-Mary Higgins's earlier question. We can regulate use of boats, for example boats passing each other or the speed of boats, but we cannot regulate for safety on board boats.

Seanad: Heritage Bill 2016: Committee Stage (Resumed) (2 Mar 2017)

Heather Humphreys: I wish to inform the House at this point that I intend to bring an amendment on Report Stage to the proposed section (7)(1)(j) to update the title of the Minister for Communications, Energy and Natural Resources to the current title of Minister for Communications, Climate Action and Environment, as well as to subsection (7)(1)(p). I also intend to bring forward amendments to sections...

Ceisteanna - Questions (Resumed) - Priority Questions: Departmental Expenditure (7 Mar 2017)

Heather Humphreys: My Department has a very broad agenda which includes responsibility for the conservation, preservation, protection, development and presentation of Ireland’s heritage and culture; responsibility for promoting the Irish language; supporting the Gaeltacht and island communities; and facilitating the economic and sustainable development of Ireland's regions and rural communities. A...

Ceisteanna - Questions (Resumed) - Priority Questions: Departmental Expenditure (7 Mar 2017)

Heather Humphreys: The Deputy referred to figures of €8 million out of €10 million. I want to be clear as to why all the capital moneys were not spent in 2016.

Ceisteanna - Questions (Resumed) - Priority Questions: Departmental Expenditure (7 Mar 2017)

Heather Humphreys: Of course at this time of year, bills for projects may not come in until at a later stage. We keep all spending under review and it is monitored closely. To be fair, my officials gave the Deputy a detailed briefing on expenditure in the Department when he was there. We need to be clear that funding is going out and many projects are being funded. Sometimes, the bills for capital...

Ceisteanna - Questions (Resumed) - Priority Questions: Departmental Expenditure (7 Mar 2017)

Heather Humphreys: I can reassure the Deputy that there was no short-changing of anybody. The moneys not spent on Leader last year were vired into other programmes.

Ceisteanna - Questions (Resumed) - Priority Questions: Departmental Expenditure (7 Mar 2017)

Heather Humphreys: Those moneys went out to rural Ireland and were made available in line with the sanctioned receipt from the Department of Public Expenditure and Reform on the basis of funding agreements signed with the local authorities. The moneys are with the local authorities which are spending it. I am conscious of the need to ensure that all funds allocated to local authorities under these schemes...

Ceisteanna - Questions (Resumed) - Priority Questions: National Museum (7 Mar 2017)

Heather Humphreys: I will answer the question put forward to me. Unfortunately, I was not able to pick up all the Deputy said in his introduction, as he well knows. I am advised my Department has not received any allegations of inappropriate sexual behaviour in the National Museum of Ireland, nor has any investigation of such allegations been undertaken. In April 2012, my predecessor was in receipt of...
