Seanad: Criminal Justice (Illicit Traffic by Sea) Bill 2000: Committee and Remaining Stages. (11 Jun 2003)

Joanna Tuffy: I would like to retable amendment No. 1 because I did not discuss it on Committee Stage.

Seanad: Criminal Justice (Illicit Traffic by Sea) Bill 2000: Committee and Remaining Stages. (11 Jun 2003)

Joanna Tuffy: Do I understand that I am not allowed to move it on Report Stage?

Seanad: Criminal Justice (Illicit Traffic by Sea) Bill 2000: Committee and Remaining Stages. (11 Jun 2003)

Joanna Tuffy: The Labour Party tabled amendment No. 1 on Committee Stage because we do not consider it is necessary to prevent communication with the owner of a vessel. Surely it is sufficient to merely delay such communication to ensure the investigation proceeds properly. We consider this provision in the section is excessive in that it prevents such communication. While it is probably too late at this...

Seanad: Dublin Traffic Congestion: Motion. (11 Jun 2003)

Joanna Tuffy: In relation to the motion before the House, there should be significant investment in Dublin Bus. I note the reference to investment in a new bus fleet, but that follows a reference to enabling new operators to enter the market. I wonder what is meant by that. Investment in Dublin Bus is very important. The current policy in relation to Dublin Bus and Bus Éireann seems to be to make them...

Seanad: Order of Business. (12 Jun 2003)

Joanna Tuffy: I support the call for a debate on the Israel-Palestine situation. I called for such a debate a couple of weeks ago. While I welcome yesterday's debate on the humanitarian aid to Iraq, we need to monitor the situation in the Middle East following the war in Iraq. It is imperative to achieve peace in the region and ensure secure states of Israel and Palestine. I condemn the actions of Israel...

Seanad: Intoxicating Liquor Bill 2003: Second Stage. (18 Jun 2003)

Joanna Tuffy: I thank the Minister for coming before the House and for his contribution. I am unhappy with the speed with which the Bill is being dealt with. We need time to review legislation of this nature in order to see what improvements we might suggest and for the Minister to consider those suggestions properly, rather than having to do so hastily. We should take Second Stage one week and deal with...

Seanad: European Convention on Human Rights Bill 2001: Report and Final Stages. (24 Jun 2003)

Joanna Tuffy: I move amendment No. 1: In page 3, after line 37, to insert the following: "(e) Protocol No. 13 to the Convention concerning the abolition of the death penalty in all circumstances, done at Vilnius on the 3rd day of May, 2002;" This amendment was also discussed on Committee Stage. I have tabled it again because, as Protocol No. 13 will come into force in less than two weeks – on 1 July –...

Seanad: European Convention on Human Rights Bill 2001: Report and Final Stages. (24 Jun 2003)

Joanna Tuffy: The Minister of State is wrong in this regard. The introduction of the legislation and the coming into force of the protocol are simultaneous events. However, I will withdraw my amendment. Amendment, by leave, withdrawn. Amendment No. 2 not moved.

Seanad: European Convention on Human Rights Bill 2001: Report and Final Stages. (24 Jun 2003)

Joanna Tuffy: I move amendment No. 7: In page 6, to delete lines 2 to 4. We propose this amendment to delete subsection (2)(a) of section 5. If there is a declaration of incompatibility by the courts, this subsection would seem to reinstate the validity of the provision being ruled incompatible by the court. The section is not necessary and my colleague, Senator Ryan, made a very strong argument against...

Seanad: European Convention on Human Rights Bill 2001: Report and Final Stages. (24 Jun 2003)

Joanna Tuffy: I move amendment No. 8: In page 6, lines 11 and 12, to delete "after the making of the order" and substitute "after a copy thereof is transmitted to him or her in accordance with such rules of court as may be made in respect of proceedings under this Act". A similar amendment to amendment No. 8 was discussed on Committee Stage. This amendment has been tabled because the Labour Party believes...

Seanad: European Convention on Human Rights Bill 2001: Report and Final Stages. (24 Jun 2003)

Joanna Tuffy: I will withdraw the amendment. Section 5(3) states that "the Taoiseach shall cause a copy of any order containing a declaration of incompatibility to be laid before each House of the Oireachtas within the next 21 days on which that House has sat after the making of the order", but I do not believe that will be possible in certain cases. It can take six weeks for an order to be drawn up and...

Seanad: European Convention on Human Rights Bill 2001: Report and Final Stages. (24 Jun 2003)

Joanna Tuffy: I move amendment No. 9: In page 6, between lines 30 and 31 to insert the following: "(6) Where as a result of an incompatibility between a statutory provision or rule of law and a Convention provision, or a failure to act in a manner compatible with a Convention provision, a person has been convicted of a criminal offence in circumstances where but for the incompatibility or failure the...

Seanad: European Convention on Human Rights Bill 2001: Report and Final Stages. (24 Jun 2003)

Joanna Tuffy: Yes, I second the amendment.

Seanad: European Convention on Human Rights Bill 2001: Report and Final Stages. (24 Jun 2003)

Joanna Tuffy: I second the amendment. Amendment put and declared lost.

Seanad: European Convention on Human Rights Bill 2001: Report and Final Stages. (24 Jun 2003)

Joanna Tuffy: I second the amendment.

Seanad: European Convention on Human Rights Bill 2001: Report and Final Stages. (24 Jun 2003)

Joanna Tuffy: I move amendment No. 13: In page 6, lines 43 to 45, to delete "the Convention provision within the meaning of the European Convention on Human Rights Act 2003;" and substitute "the Convention within the meaning of the European Convention on Human Rights Act 2003 and the protocols thereto". The purpose of this amendment is to ensure a declaration of incompatibility could be made in relation to...

Seanad: European Convention on Human Rights Bill 2001: Report and Final Stages. (24 Jun 2003)

Joanna Tuffy: I thank the Minister of State for being present in the Chamber and his contribution to the debate. I also thank other Senators for their contributions. While I welcome the Bill, issues raised today and on Committee Stage need to be revisited. As Senator Terry said, we need to incorporate the convention more fully into our law.

Seanad: Offences Against the State (Amendment) Act 1998: Motion. (24 Jun 2003)

Joanna Tuffy: I compliment the Minister of State on his presentation. The Labour Party accepts and supports the need for the legislation following the atrocity of the Omagh bombing. We also accept there is still a threat to our democracy from the Continuity IRA and the Real IRA, in particular. While I agree it is important that this emergency legislation should be monitored and revisited annually, at the...

Seanad: Order of Business. (25 Jun 2003)

Joanna Tuffy: I support the call for a debate on rural housing. An Taisce has been mentioned. There are opposing views on the issue. However, while I do not agree with its views, the fault does not lie with An Taisce but in how our development plans are framed, which prohibits rural housing.

Seanad: Order of Business. (25 Jun 2003)

Joanna Tuffy: As I said, I am opposed to the views of An Taisce. However, the answer is not on the opposite side but somewhere in the middle. We need a formula which allows for rural housing, while protecting the environment and ensuring sustainability. The way to achieve this is through the inclusion of a formula in our development plans. An Taisce wins its cases because of the way they are currently framed.
