Martin Ferris: Infecting an animal with tuberculosis or any other disease is a criminal offence. Has the Minister or any of his predecessors made a determination on an official's report without criminal action being taken against the individual in question?

Martin Ferris: I expect the Minister is aware of a case where a credible officer from the Irish Farmers Association gave evidence on behalf of a certain farmer who was denied all his entitlements. Because that farmer was not in a position to go to the courts, he lost his compensation.

Martin Ferris: I have concerns about this as well. We spoke earlier about people being afraid to go to court because of the cost. If there is an allegation or suspicion that a person is committing an offence and he or she has a fixed fine or payment notice served upon him or her, he or she could find himself or herself under pressure to pay the fine or fixed payment rather than go through due process even...

Martin Ferris: The Minister says the option exists but it is weighted in so far as people will pay rather than go through the courts even though it is only an allegation. Deputy Ó Cúiv mentioned that other aspects of the law are black and white in that they are based on facts. Many cases relating to animal welfare come down to interpretation by the person observing.
