Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: Central Bank of Ireland: Discussion (26 Mar 2019)

Rose Conway Walsh: If there is blanket rejection the Central Bank has had an interpretation of it and is standing over it. If that were to be tested in a court of law the Central Bank will stand over it. It has received its own advice and it will provide us with that. There is the issue of the banks trying to apply retrospectively commercial common sense. There is the issue of contract law.

Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: Central Bank of Ireland: Discussion (26 Mar 2019)

Rose Conway Walsh: This tells us when the Central Bank did it. Surely in contract law it would be when the contract was drawn up regardless of when the money was drawn down. Surely it should relate to the date of the original contract. We have a situation where the only variable in the contract is the ECB rate. The margin is the constant. I am trying to get the rationale for assessing this.

Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: Central Bank of Ireland: Discussion (26 Mar 2019)

Rose Conway Walsh: I need to get this clear. Does the rate apply to when the contract was actually signed?

Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: Central Bank of Ireland: Discussion (26 Mar 2019)

Rose Conway Walsh: Ms Rowland agrees with the statement that that applies to coming off the fixed mortgage and going onto the tracker and not to the original contract?

Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: Central Bank of Ireland: Discussion (26 Mar 2019)

Rose Conway Walsh: It is important that the Central Bank has a position on the matter. Where the bank acknowledges a failure, it does not acknowledge a breach of contract. Does Ms Rowland believe there was a systemic breach of contract by the banks?

Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: Central Bank of Ireland: Discussion (26 Mar 2019)

Rose Conway Walsh: Does the Central Bank believe that the banks have tried to apply commercial common sense retrospectively in many of these cases, which obviously goes against the contracts?

Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: Central Bank of Ireland: Discussion (26 Mar 2019)

Rose Conway Walsh: That is true and is why I believe that the two most important words from here on are "the" and "then", that is, "the then" and what that means.

Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: Central Bank of Ireland: Discussion (26 Mar 2019)

Rose Conway Walsh: I wanted to ask the opinion of the witnesses on the insurance companies. As Professor Lane leaves, is he satisfied enough is being done by the insurance companies to reverse the upward trend in insurance costs? I am mindful of his predecessor's comments about the low interest rate environment having challenged the Irish industry over the past five years. That was in 2015. As a result, a...

Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: Central Bank of Ireland: Discussion (26 Mar 2019)

Rose Conway Walsh: I understand all that in the wider context. At the time, Professor Honohan said there were cases where the Central Bank was given false or misleading information by regulated entities or individuals in regulated entities, often in the form of information designed to cover serious shortcomings or inadequacy. Has that happened during Professor Lane's tenure? Has false or misleading...

Seanad: An tOrd Gnó - Order of Business (27 Mar 2019)

Rose Conway Walsh: We will take up Senator Ó Céidigh's invitation for the event from 26 to 28 April. It is a great initiative and I thank Treasa and Cáit for organising it. It is hugely important that we can all speak our native tongue. I want to challenge the remarks made by the Taoiseach at the weekend when he dismissed out of hand the idea that the ESB and existing infrastructure could be...

Seanad: Period Poverty: Motion (27 Mar 2019)

Rose Conway Walsh: I welcome the young women from Politics Needs Women to the House. It is great to see so many young women and they are all welcome. I hope, before too long, they will be in these seats and the seats in the Dáil. We need more women's voices and this motion is an example of that. It is not just more women that we need across the board but women from different backgrounds with different...

Seanad: Dealing with the Past in Northern Ireland: Statements (27 Mar 2019)

Rose Conway Walsh: I welcome the family of Councillor Patsy Kelly to the Chamber today and I support their campaign for truth and justice. I appreciate the Tánaiste coming to the House today, especially in the context of the ongoing challenges presented by Brexit. To be able to look to the future we have to deal with the past. We know this because we have listened to the families of the Bloody Sunday...

Seanad: Order of Business (28 Mar 2019)

Rose Conway Walsh: I welcome all the students from Cavan. There was a group in earlier also. I hear some of them will be budding politicians. Niamh and Maeve might be Diarmuid's daughters but I hope they do not take any notice of Daddy and join the right party. I wish to say farewell to Donal Hickey and thank him for his exceptional work. I wish him well in the future. I apologise in advance as Kerry will...

Seanad: Civil Liability (Capping of General Damages Bill) 2019: Second Stage (28 Mar 2019)

Rose Conway Walsh: I thank Senator Lawlor for bringing this Bill before the House but would argue that there are lots of limitations around it. When one looks at the insurance industry here one sees protectionism and a fundamental lack of transparency. The figures for car insurance do not add up. On 19 October last, the Government announced the abandonment of its plan to establish a claims register of injury...

Seanad: An tOrd Gnó - Order of Business (2 Apr 2019)

Rose Conway Walsh: I appreciate the Cathaoirleach allowing me to contribute, given that I was delayed at the meeting of the Joint Committee on Finance, Public Expenditure and Reform, and Taoiseach, where we were carrying out scrutiny of the No Consent, No Sale Bill 2019 and trying to convince the Central Bank and the Department of Finance that mortgage holders need to be protected and that our economy and...

Joint Oireachtas Committee on Communications, Climate Action and Environment: Energy Plant Certification: Commission for the Regulation of Utilities (2 Apr 2019)

Rose Conway Walsh: I thank the commission for its presentation. The point has got across to the commission that this is a serious matter for the local economy in Mayo but also for the promoter of the plant which has invested €100 million. Could the same happen today if somebody was in the same situation? Will the commission confirm that the legislative framework has not changed since the original...

Joint Oireachtas Committee on Communications, Climate Action and Environment: Energy Plant Certification: Commission for the Regulation of Utilities (2 Apr 2019)

Rose Conway Walsh: What variables have changed? Could it happen that somebody would invest today but find later that the application would be turned down? The stark difference between 18% and 100% is difficult to understand.

Joint Oireachtas Committee on Communications, Climate Action and Environment: Energy Plant Certification: Commission for the Regulation of Utilities (2 Apr 2019)

Rose Conway Walsh: Is that the cost to the promoter?

Joint Oireachtas Committee on Communications, Climate Action and Environment: Energy Plant Certification: Commission for the Regulation of Utilities (2 Apr 2019)

Rose Conway Walsh: Why would anybody invest if they have to operate on moving sand? For somebody investing today there are no guarantees for a project.

Joint Oireachtas Committee on Communications, Climate Action and Environment: Energy Plant Certification: Commission for the Regulation of Utilities (2 Apr 2019)

Rose Conway Walsh: Was that made clear to the promoter in the first instance and to all of the agencies involved, including Mayo County Council and the EPA? I do not understand why the agencies of the State are operating in a silo and there is no joint input in regard to the granting of permissions.
