Seanad: Order of Business (18 Nov 2014)

Feargal Quinn: I follow the words of Senator Mullins, who referred to Senator Zappone's balanced words that I heard on the radio the other day following what we had seen in Jobstown. The Senator was just one of those who brought a balance to the words and expressions made. If there is to be a change tomorrow in regard to Irish Water - I hope there will be - it will come about because of the strength of...

Seanad: Horizon 2020: Statements (18 Nov 2014)

Feargal Quinn: The Minister of State is very welcome. We worked together on the Oireachtas Joint Committee on Jobs, Enterprise and Innovation. He will be pleased to know that last week we visited Belfast again and had a very fruitful trip. We spoke about some of the issues mentioned by the Minister of State, such as InterTradeIreland working with us and seeing what can be achieved. I congratulate the...

Joint Oireachtas Committee on Jobs, Enterprise and Innovation: General Scheme of Industrial Relations (Amendment) Bill 2014: Discussion (Resumed) (18 Nov 2014)

Feargal Quinn: I did not hear the consumer mentioned. Ms McElwee seems to be saying that the construction industry is different from everything else. I grew up in the grocery business and almost everything Ms McElwee said about the construction industry applies to the grocery business. There are family businesses, with sons and daughters working in the business, and huge international competitors. In...

Seanad: Order of Business (19 Nov 2014)

Feargal Quinn: I notice the British have just announced they have found a new dye with which to overcome the problem of diesel laundering. This matter has been brought up a number of times in this House and Senator Brennan has spoken of the huge clashes that are ongoing in that north Louth-south Armagh area. However, if the British have come across a new dye they believe cannot be removed and which they...

Feargal Quinn: I congratulate her.

Seanad: Report of Commission for the Economic Development of Rural Areas: Statements (19 Nov 2014)

Feargal Quinn: I welcome the Minister of State. I am delighted to have her in the House. It was great to hear about the enthusiasm with which she has grabbed hold of this challenge. She said earlier that "rural areas are not looking for a hand-out but they most definitely need a hand-up". We need to hear those sorts of words. Before I was elected to this House, I was a member of a partnership in a...

Seanad: Access to Finance for SMEs: Statements (19 Nov 2014)

Feargal Quinn: I too welcome the Minister of State, Deputy Nash to the House. I am delighted to see him in this Chamber. One of my major concerns about cash for small businesses comes from the Construction Contracts Act 2013, which was signed by the President 480 days ago. It was not the Minister of State's baby until last week, but it is now his baby. In the past 480 days nothing has happened. I would...

Seanad: Order of Business (20 Nov 2014)

Feargal Quinn: I congratulate the Government on making the move yesterday not only with regard to water but a particular aspect, which the fact Irish Water was demanding PPS numbers from its customers, the citizens. Yesterday the Government accepted the point Irish Water will not have the right to demand PPS numbers. Not only this, but it will be made illegal for it to hold on to the information it...

Feargal Quinn: I was not sure how it was to be done.

Seanad: Valuation (Amendment) (No. 2) Bill 2012: Report and Final Stages (20 Nov 2014)

Feargal Quinn: I move amendment No. 2: In page 6, between lines 21 and 22, to insert the following:"(i) a decrease in profitability of the company located within the relevant property as evidenced by the owner or occupier of the relevant property to the Commissioner through company records (as per the Companies Acts);",".I welcome the Minister of State to the House. I have never seen a Bill with so many...

Seanad: Valuation (Amendment) (No. 2) Bill 2012: Report and Final Stages (20 Nov 2014)

Feargal Quinn: I thank the Minister of State for his explanation. I understand his concerns that profitability can depend on other items. I know, however, of a case where a property was valued in 2005 but its next revaluation will not take place until 2018. The world will change in that time and profitability could be a factor. However, I accept the danger of taking profitability as the only measurement...

Seanad: Valuation (Amendment) (No. 2) Bill 2012: Report and Final Stages (20 Nov 2014)

Feargal Quinn: I second the amendment.

Seanad: Valuation (Amendment) (No. 2) Bill 2012: Report and Final Stages (20 Nov 2014)

Feargal Quinn: I move amendment No. 4: In page 7, between lines 20 and 21, to insert the following: “Amendment of section 12 of Principal Act 5. Section 12 of the Principal Act is amended by substituting for subsection (5) the following:“(5) The Tribunal shall consist of valuers who have not been involved in the matter previously.”.”.I understand this amendment’s provision...

Seanad: Valuation (Amendment) (No. 2) Bill 2012: Report and Final Stages (20 Nov 2014)

Feargal Quinn: I understand the point the Minister of State makes. The concern here is the length of time it takes for something to happen, for example after a bypass is built. I should not be talking about a specific petrol station all the time. There are many other instances. It is a typical example and is very easily understood. The difficulty is that reviews of any kind do not happen quickly enough...

Seanad: Valuation (Amendment) (No. 2) Bill 2012: Report and Final Stages (20 Nov 2014)

Feargal Quinn: I second the amendment. The aim is to bring clarity to the area, to ensure that any person or company that has an interest in the property has a right to appeal to the tribunal. The word "person" may be understood to be a company, but this amendment aims to clear this up. I think it makes sense to have it.

Seanad: Valuation (Amendment) (No. 2) Bill 2012: Report and Final Stages (20 Nov 2014)

Feargal Quinn: The Minister of State has explained that very well. I still have a concern over it and I think it would have been better to have "any interested party", but I understand the position the Minister of State has taken, so I withdraw the amendment.

Seanad: Valuation (Amendment) (No. 2) Bill 2012: Report and Final Stages (20 Nov 2014)

(a) The Minister may introduce a legislative mechanism for a review of rates based on changes to value of a property from any cause.(b) The Minister may make regulations in relation to the...
