- Seanad: Regulation of Lobbying Bill 2014: Committee Stage (5 Feb 2015)
Trevor Ó Clochartaigh: My party is opposing this section. We can see no valid reason to protect from public scrutiny the lobbying of public officials with respect to public policy, legislative or funding decisions on the basis of adverse effect on the financial interests of the State, business interests generally or particularly, or potential material financial loss to, prejudice to the competitive position of, or...
- Seanad: Regulation of Lobbying Bill 2014: Committee Stage (5 Feb 2015)
Trevor Ó Clochartaigh: I move amendment No. 43: In page 22, line 11, to delete "paragraph (a), (e)or (f)of".We do not agree that Deputies, Senators, MEPs and councillors should be exempt from these restrictions and the requirement to obtain pre-authorisation by way of application to SIPO if they want to take up employment as a lobbyist within two years of leaving public office. They can possess influence and...

- Seanad: Commencement Matters: Wild Atlantic Way Project (11 Feb 2015)
Trevor Ó Clochartaigh: Cuirim céad fáilte roimh an Aire Stáit agus táim thar a bheith buíoch dó as am a thógáil teacht isteach arís go dtí an Seanad, ar cheist a bhaineann le cúrsaí turasóireachta ach atá ceangailte le Údarás na Gaeltachta agus an ról atá aige. Tá fáilte coitianta curtha roimh an fhorbairt atá...
- Seanad: Commencement Matters: Wild Atlantic Way Project (11 Feb 2015)
Trevor Ó Clochartaigh: Fáiltím go mór roimh an méid atá ráite faoi Theach an Phiarsaigh agus faoin obair atá ar siúl ansin. Táimid ar fad ag súil go mbeidh sé críochnaithe in am do Cháisc 2016. Tuigim ón Aire Stáit mar sin go bhfuil scéim faoi leith, nó fócas faoi leith, le bheith ag Údarás na Gaeltachta ar...
- Seanad: Order of Business (11 Feb 2015)
Trevor Ó Clochartaigh: Cuireann sé alltacht agus iontas orm cuid de na ráitis atá déanta ag an Aire Airgeadais san Eoraip ar maidin maidir le muintir na Gréige agus é ag cur an mhilleáin ar na gnáth daoine ó thaobh na fiacha atá ar an tír sin. I find quite flabbergasting the statements that have been made by the Minister for Finance, Deputy Michael Noonan, to...
- Seanad: Garda Síochána (Amendment) (No. 3) Bill 2014: Second Stage (11 Feb 2015)
Trevor Ó Clochartaigh: Ba mhaith liom fáilte a chur roimh an mBille seo agus muid ar bhealach fanacht píosa fada leis an mBille céanna. I am pleased to welcome this Bill today. It is fair to say that we have been waiting for it for quite a while. It has been a very disturbing period in terms of the administration and application of justice in this State. Public confidence has been fundamentally...
- Joint Oireachtas Committee on Public Service Oversight and Petitions: Equality and Fairness of State Pension: (Resumed) Discussion (11 Feb 2015)
Trevor Ó Clochartaigh: I thank Mr. Whelan for his presentation which echoes much of what was in the original petition which, I imagine, he got sight of from Mr. Henry Gaynor. One of the points raised by Mr. Gaynor towards the end of his presentation which was interesting - I wonder if ICTU has done an analysis of this - was that the net cost-benefit to the Exchequer is actually very small. He suggested that the...
- Joint Oireachtas Committee on Public Service Oversight and Petitions: Equality and Fairness of State Pension: (Resumed) Discussion (11 Feb 2015)
Trevor Ó Clochartaigh: Mr. Whelan has reminded me of something with his reference to legitimate expectation. Some years ago the case was made that we should cut the pensions of judges. However, the argument of legitimate expectation was used in that scenario.
- Joint Oireachtas Committee on Public Service Oversight and Petitions: Equality and Fairness of State Pension: (Resumed) Discussion (11 Feb 2015)
Trevor Ó Clochartaigh: Are we suggesting that the petitioner has highlighted the issue again and that there could be legal grounds on the basis of legitimate expectation?
- Joint Oireachtas Committee on Public Service Oversight and Petitions: Equality and Fairness of State Pension: (Resumed) Discussion (11 Feb 2015)
Trevor Ó Clochartaigh: My question is a follow-up to what Deputy Aengus Ó Snodaigh referred to, where someone is forced into unemployment but would prefer to stay in employment. From the point of view of industrial relations, is there a case of unfair dismissal that can be taken to the Employment Equality Tribunal? If so, what are the chances of winning?
- Seanad: Order of Business (12 Feb 2015)
Trevor Ó Clochartaigh: Bhí cuid mhaith Seanadóirí, Teachtaí Dála agus Airí inné ag déanamh gaisce as an bplean jabanna atá fógraithe ag an Rialtas. The Government's plan on jobs which was announced yesterday seems to be a question of reheating the chicken, when one delves into the detail. The targets therein were supposed to have been delivered on and the plan...
- Seanad: Order of Business (12 Feb 2015)
Trevor Ó Clochartaigh: Senator Leyden suggested that every eastern European coming into this country should be profiled on his or her way in and I certainly would not agree with those comments. It has been an up and down week for An Garda Síochána. We have seen more arrests this morning, including that of a 15 year old boy and a man in his 50s, in connection with the protests in Jobstown. Many people...
- Seanad: Order of Business (12 Feb 2015)
Trevor Ó Clochartaigh: Other people do that who are on social welfare.
- Joint Oireachtas Committee on Agriculture, Food and the Marine: Promoting Sustainable Rural Coastal and Island Communities: Discussion (17 Feb 2015)
Trevor Ó Clochartaigh: Cuirim fáilte roimh na finnéithe freisin. Tá sé an-tábhachtach go mbeadh siad ag teacht inár láthair agus go mbeadh deis cur agus cúiteamh faoin tuairisc seo. I welcome the delegates back to the committee. I am not a full member of this committee. However, I think it is important that we keep on top of this issue. I share the delegates'...
- Joint Oireachtas Committee on Agriculture, Food and the Marine: Promoting Sustainable Rural Coastal and Island Communities: Discussion (17 Feb 2015)
Trevor Ó Clochartaigh: That is why I am keen to raise the Leader issue - because it is a major issue for the islands.
- Joint Oireachtas Committee on Agriculture, Food and the Marine: Promoting Sustainable Rural Coastal and Island Communities: Discussion (17 Feb 2015)
Trevor Ó Clochartaigh: I am unsure whether this is something we should consider supporting, because there is a unique scenario on the islands. I know from talking to islanders in the Galway area that there was no logic to changing the system as it was. It may be helpful, if the committee was of a mind, to write to the Minister and ask him to consider examining the situation from an island perspective.
- Joint Oireachtas Committee on Agriculture, Food and the Marine: Promoting Sustainable Rural Coastal and Island Communities: Discussion (17 Feb 2015)
Trevor Ó Clochartaigh: That would sit with the recommendations that have been made and the CEDRA report.
- Joint Oireachtas Committee on Agriculture, Food and the Marine: Promoting Sustainable Rural Coastal and Island Communities: Discussion (17 Feb 2015)
Trevor Ó Clochartaigh: The point Mr. Conneely made about the Wild Atlantic Way is very important. I came across a case recently involving a shellfish producer who has been selling at a stall on the side of the road at a scenic location in Connemara for several years. Now that this location has been officially designated, however, he has been moved on by the local authority engineer for some strange reason. We...
