Joanna Tuffy: I raised the issue of section 3(4) yesterday but the Minister of State did not refer to it in his reply. Will he clarify the reason those parts of the normal Garda legislation do not apply to a seconded person, a matter which relates to paragraphs (a), (b) and (c)?

Joanna Tuffy: My understanding is that the person concerned would not be disciplined by the Garda SÃochána in any case. The disciplinary action would be carried out by the PSNI. I question the value of the subsection but at the same time I appreciate what the Minister of State has outlined.

Joanna Tuffy: I support Senator Ryan's amendment to the Order of Business in order that we can discuss the proposal to reintroduce third level fees. Deputy Batt O'Keeffe admitted in yesterday's Irish Independent that participation at third level by those in lower and middle income groups had increased substantially.
