Seanad: Intoxicating Liquor Bill 2003 [ Seanad Bill amended by the Dáil ] : Report and Final Stages. (4 Jul 2003)

Sheila Terry: I thank the Minister and ask him to consider, when working on the codification Bill, the possibility that we might re-examine the late closing on Fridays and Saturdays if, in the meantime, it continues to be a problem. I thank the staff and the Minister in particular for the work they put into the Bill.

Seanad: Intoxicating Liquor Bill 2003 [ Seanad Bill amended by the Dáil ] : Report and Final Stages. (4 Jul 2003)

Sheila Terry: Is there a doubt? Question put and agreed to.

Seanad: Criminal Justice (Temporary Release of Prisoners) Bill 2001: Second Stage. (8 Oct 2003)

Sheila Terry: I welcome this Bill. It is clear and concise legislation which puts on a statutory footing the powers the Minister formerly exercised under statutory instrument. If this legislation is implemented wisely, with a couple of changes I intend to propose, it could have a good effect. Giving temporary release to prisoners should help their rehabilitation, something we all aim to achieve.

Seanad: Criminal Justice (Temporary Release of Prisoners) Bill 2001: Second Stage. (8 Oct 2003)

Sheila Terry: I accept that I should have referred to the previous Minister but that is irrelevant now. Deputy McDowell is the Minister.

Seanad: Criminal Justice (Temporary Release of Prisoners) Bill 2001: Second Stage. (8 Oct 2003)

Sheila Terry: Was the Government exposed in terms of damages?

Seanad: Order of Business. (9 Oct 2003)

Sheila Terry: As some of the other Senators present have called for a debate on transport, I ask the Leader if she will organise a specific debate on transport in the Dublin area. As we have seen and heard over the past week, the Minister does not seem able to keep in touch with the grass roots regarding other organisations and units which provide public transport in the Dublin area. Given the fact that...

Seanad: Adjournment Matter. - Occupational Pension Schemes. (9 Oct 2003)

Sheila Terry: I have been asked to raise this on the Adjournment as a number of Departments have been unable to reply to my question on whether it is constitutional to compel people to take out a private sector pension. First, I asked my colleague, Deputy McGinley, to raise the matter with the Minister for Justice, Equality and Law Reform by way of parliamentary question. The Ceann Comhairle replied: "The...

Seanad: Adjournment Matter. - Occupational Pension Schemes. (9 Oct 2003)

Sheila Terry: I am extremely disappointed with the reply. It now seems the only recourse open to these people is to go to the courts. That is a shame. The Seanad adjourned at 11.50 a.m. until 10.30 a.m. on Wednesday, 15 October 2003.

Seanad: Order of Business. (15 Oct 2003)

Sheila Terry: I would like the Leader to invite the Minister for Justice, Equality and Law Reform to come into the House to outline how he is going to counter the gangland warfare that is operating in Dublin and Limerick and other parts of the country at the moment. Recently there was a sixth murder in as many months in Finglas in Dublin. Residents in that area live in fear. The investigations of these...

Seanad: Criminal Justice (Temporary Release of Prisoners) Bill 2001: Committee Stage. (15 Oct 2003)

Sheila Terry: I move amendment No. 2: In page 3, lines 17 to 19, to delete "such person as is specified in the direction (being a person who is serving a sentence of imprisonment)" and substitute the following "a person who is serving a sentence of imprisonment". I welcome the Minister of State. I propose the deletion of the words "such person as is specified in the direction (being a person who is serving...

Seanad: Criminal Justice (Temporary Release of Prisoners) Bill 2001: Committee Stage. (15 Oct 2003)

Sheila Terry: I am disappointed that the Minister will not accept my amendment. He knows that the Law Reform Commission previously criticised the wording of legislation and asked that legislators keep this point in mind when drafting legislation. This particular wording is a classic case and I would expect the commission to point out that this is not the wording it would have preferred. I have to accept...

Seanad: Criminal Justice (Temporary Release of Prisoners) Bill 2001: Committee Stage. (15 Oct 2003)

Sheila Terry: I support Senator Tuffy's amendments. It is time that legislation accurately reflected our laws in terms of equality and accuracy and "person" would describe either male or female. That is how we should deal with legislation and I ask the Minister to accept the amendments.

Seanad: Criminal Justice (Temporary Release of Prisoners) Bill 2001: Committee Stage. (15 Oct 2003)

Sheila Terry: It might be better to discuss the other amendments first as it will be easier to deal with amendment No. 17 depending on the outcome of the other amendments.

Seanad: Criminal Justice (Temporary Release of Prisoners) Bill 2001: Committee Stage. (15 Oct 2003)

Sheila Terry: I move amendment No. 9: In page 4, between lines 19 and 20, to insert the following new paragraph: "(d) any representations made by the victim or next-of-kin of the victim on the proposal to direct the release of the person from prison,". On Second Stage I discussed the need to strike a balance between the rights of victims as against those of the criminal. I suggested that I would bring...

Seanad: Criminal Justice (Temporary Release of Prisoners) Bill 2001: Committee Stage. (15 Oct 2003)

Sheila Terry: Following what the Minister of State said, he is certainly tipping the balance in favour of criminals. He indicated that he would be open to accepting an amendment. If that is the case, I am disappointed he will not accept my amendment. If he believes in balancing the rights of victims with those of criminals, why did he not table an amendment to provide for these rights? If he does not...

Seanad: Criminal Justice (Temporary Release of Prisoners) Bill 2001: Committee Stage. (15 Oct 2003)

Sheila Terry: I move amendment No. 17: In page 5, between lines 23 and 24, to insert the following: "(5) Notice of a direction under this section shall be given to the person (or next-of-kin of that person) against whom the offence was committed.". This amendment would ensure that the family or the victim would be informed of a decision to grant temporary release to a prisoner. I accept that the Minister...

Seanad: Criminal Justice (Temporary Release of Prisoners) Bill 2001: Committee Stage. (15 Oct 2003)

Sheila Terry: I accept that many victims do not want to be informed and that there are avenues for certain victims to be informed of a release, whether temporary or otherwise. We should have a blanket decision to inform all victims. The Minister of State has said that victims may not want to know but how can he know which victims do not want to be informed of the release of a prisoner? That is taking...

Seanad: Criminal Justice (Temporary Release of Prisoners) Bill 2001: Committee Stage. (15 Oct 2003)

Sheila Terry: But we do not know who those victims are.

Seanad: Criminal Justice (Temporary Release of Prisoners) Bill 2001: Committee Stage. (15 Oct 2003)

Sheila Terry: I move amendment No. 19: In page 6, subsection (2), line 22, to delete "shall come" and substitute "comes". This is a very simple amendment. It proposes to use the active voice in drafting legislation as recommended by the Law Reform Commission. We should adopt the commission's recommendations to use best practice and strive to ensure that the public can read our legislation by not writing it...

Seanad: Criminal Justice (Temporary Release of Prisoners) Bill 2001: Committee Stage. (15 Oct 2003)

Sheila Terry: I am surprised that the Minister of State does not know what is happening in other Departments. My party tabled a similar amendment to the Containment of Nuclear Weapons Bill in the Dáil recently which the Minister of State at the Department of the Environment, Heritage and Local Government, Deputy Gallagher, accepted. Perhaps the Minister of State should discuss the matter with his...
