Seanad: Employment Permits Bill 2003: Committee Stage. (1 Apr 2003)

Terry Leyden: I disagree with Senator Tuffy's amendment. I am quite surprised that the Labour Party wants this section deleted because I thought it would want the fines to be increased.

Seanad: Employment Permits Bill 2003: Committee Stage. (1 Apr 2003)

Terry Leyden: It is going to be tough, but we have to have controls in this regard. Permits are important and there would be no point in having the system if people were to be employed without proper certification. The Minister is right to have retained that in the Bill.

Seanad: Employment Permits Bill 2003: Committee Stage. (1 Apr 2003)

Terry Leyden: All applicant states may not have completed their agreements with the European Union before the relevant date, so we should stick to the numbers currently on the list without expanding it any further. It would be easy to amend the legislation and it would also present an opportunity to review it.

Seanad: Employment Permits Bill 2003: Committee Stage. (1 Apr 2003)

Terry Leyden: I reiterate that I am very much in favour of having the triple mechanism in place from day one. I hope I am getting this message across, although perhaps I am not.

Seanad: Employment Permits Bill 2003: Committee Stage. (1 Apr 2003)

Terry Leyden: This is an important section. I note Senator Tuffy is saying that there should be no safeguard in place and that the Department and the Minister should have no way of checking the position to ascertain the numbers coming here. From day one there should be a careful assessment of the numbers applying for permits. That is all I am saying. Perhaps I am wrong but time will tell. Nobody can...

Seanad: Employment Permits Bill 2003: Committee Stage. (1 Apr 2003)

Terry Leyden: No, I voted for it.

Seanad: Employment Permits Bill 2003: Committee Stage. (1 Apr 2003)

Terry Leyden: I welcome this amendment, which goes a long way towards satisfying my concerns about the Bill. It is interesting that Germany and Austria, two very strong economies, have concerns that are not shared by any other Members of the Seanad. I may be in good company with Germany and Austria, two excellent countries and great trading partners. They want no freedom of access after enlargement, with...

Seanad: Employment Permits Bill 2003: Report and Final Stages. (1 Apr 2003)

Terry Leyden: Do Senators Tuffy and Coghlan want to reward employers? They have made no provision to restrict employers taking on employees without work permits.

Seanad: Employment Permits Bill 2003: Report and Final Stages. (1 Apr 2003)

Terry Leyden: The amendment proposes to delete the most important provision in the section which addresses penalties. Does the Senator propose to reward employers who take on employees without a permit?

Seanad: Employment Permits Bill 2003: Report and Final Stages. (1 Apr 2003)

Terry Leyden: The proposed lines to be deleted—

Seanad: Employment Permits Bill 2003: Report and Final Stages. (1 Apr 2003)

Terry Leyden: I ask the Senator to clarify the proposal to delete lines 13 to 16 on page 4.

Seanad: Employment Permits Bill 2003: Report and Final Stages. (1 Apr 2003)

Terry Leyden: The amendment proposes to delete lines 13 to 16.

Seanad: Employment Permits Bill 2003: Report and Final Stages. (1 Apr 2003)

Terry Leyden: I was seeking clarification. The section is very important.

Seanad: Employment Permits Bill 2003: Report and Final Stages. (1 Apr 2003)

Terry Leyden: Yes. Senator Quinn made a good point. If an employer unknowingly employed a person on the basis of a good quality hoax permit, he would have a good defence. The Government and the Department are not seeking to trap employers. The section amounts to a stark warning to employers not to employ people without proper permits. It is vital these restrictions are enforced. Otherwise we can throw out...

Seanad: Employment Permits Bill 2003: Report and Final Stages. (1 Apr 2003)

Terry Leyden: This matter was dealt with adequately on Committee Stage. It is better not to anticipate the views of applicant countries. Many steps have to be taken before we increase the number of countries involved and there will be ample opportunity to bring forward amending legislation to allow for that expansion. There will also be an opportunity for the Department to review the operation of the Bill...

Seanad: Employment Permits Bill 2003: Report and Final Stages. (1 Apr 2003)

Terry Leyden: I thank the Minister of State and his staff for the excellent work they put into the Bill. I also thank the Ministers of State, Deputies Michael Ahern and John Browne, who were involved in the Second Stage debate. I compliment the Minister of State and his officials on bringing forward the Committee Stage and Report Stage amendments so promptly. I may have reservations in regard to particular...

Seanad: Humanitarian Crisis in Iraq: Statements. - Regulatory Reform: Motion. (2 Apr 2003)

Terry Leyden: I move: That Seanad Éireann, –recalls the commitment in the Programme for Government 2002-2007 to vigorously pursue a programme of regulatory reform with particular emphasis on removing unwarranted constraints on competition in all sectors of the economy and placing the consumer at the top of the policy agenda; –congratulates the Competition Authority on the recently published report...

Seanad: Humanitarian Crisis in Iraq: Statements. - Regulatory Reform: Motion. (2 Apr 2003)

Terry Leyden: Due to the Senator's training.

Seanad: Order of Business. (3 Apr 2003)

Terry Leyden: I support the request made by Senator Dardis for a debate on the strategic rail review. The report was commissioned by the Leader of the House when she was Minister. It is appropriate that the report be debated by the House as quickly as possible. It is an important document and the Seanad should have a detailed discussion of it and have its observations noted by the Government in advance of...

Seanad: Order of Business. (3 Apr 2003)

Terry Leyden: Yes, and it has been signed by the leaders.
