- Civil Law (Miscellaneous Provisions) Act 2021: Motion (16 Nov 2021)
Brendan Howlin: I have a short five minutes to respond to the Minister of State in relation to this motion. As the Minister of State said, we had a long debate on the legislation when it was enacted. This is simply a roll-over for it, as it were. I think it appropriate to use the phrase "sunset clause", since we are talking about outdoor dining as we head into the winter. The sun has well set on outdoor...
- Sex Offenders (Amendment) Bill 2021: Second Stage (16 Nov 2021)
Brendan Howlin: I welcome this legislation. In recent years, we have come to a much better understanding of the nature of and enormous damage done by sex offenders. After decades of weak or ineffective legislation, we have incrementally moved to strengthen our laws and to develop supports for victims. It is an ongoing process as our understanding and knowledge deepens and we still have a long way to go,...
- Written Answers — Department of Finance: Insurance Coverage (16 Nov 2021)
Brendan Howlin: 210. To ask the Minister for Finance the options available a couple in full-time employment with the clear expectation of being able to repay the mortgage over a lifetime of work in circumstances in which they require life insurance to secure a mortgage for a home loan and such insurance is unavailable due to a congenital illness; if there is a requirement for the insurance industry to offer...
- Select Committee on Justice and Equality: Criminal Justice (Mutual Recognition of Custodial Sentences) Bill 2021: Committee Stage (10 Nov 2021)
Brendan Howlin: I had not intended to speak but I will ask one question. It is not particularly germane but is a general question on the number of prisoners who have been repatriated under the agreements in place. I understand that, as we discussed on Second Stage, nobody has been transferred in the last five years. Does that remain the case and are there any prospective transfers?
- Select Committee on Justice and Equality: Criminal Justice (Mutual Recognition of Custodial Sentences) Bill 2021: Committee Stage (10 Nov 2021)
Brendan Howlin: Is it envisaged that there will be a substantial change in the numbers? If we review this Act in, say, two years' time, will the Minister of State and his Department envisage that there would, at that stage, have been a number of prisoners transferred into this jurisdiction from other jurisdictions? In terms of where we stand with the United Kingdom being outside the European Union, how...
- Select Committee on Justice and Equality: Criminal Justice (Mutual Recognition of Custodial Sentences) Bill 2021: Committee Stage (10 Nov 2021)
Brendan Howlin: I have a general question on the ongoing discussions with the Government of the United Kingdom. There is a certain frisson of difficulty between the European Union and the UK Government right now. Is this particular matter - and other justice-related matters - being pursued bilaterally by the Department with the Ministry of Justice in the United Kingdom right now? Is it the Minister of...
- Select Committee on Justice and Equality: Criminal Justice (Mutual Recognition of Custodial Sentences) Bill 2021: Committee Stage (10 Nov 2021)
Brendan Howlin: Has the Minister of State bilateral contacts directly with the newly appointed Secretary of State for Justice in the United Kingdom? Is that the way business is currently transacted between Ireland and the UK?
- Select Committee on Justice and Equality: Criminal Justice (Mutual Recognition of Custodial Sentences) Bill 2021: Committee Stage (10 Nov 2021)
Brendan Howlin: I thank the Minister of State.
- Select Committee on Justice and Equality: Criminal Justice (Mutual Recognition of Custodial Sentences) Bill 2021: Committee Stage (10 Nov 2021)
Brendan Howlin: Can I again ask a question for clarity?
- Select Committee on Justice and Equality: Criminal Justice (Mutual Recognition of Custodial Sentences) Bill 2021: Committee Stage (10 Nov 2021)
Brendan Howlin: In relation to the trade and co-operation agreement and the impact of that on a European arrest warrant, would the Minister of State give us the reassurance that it would be possible to execute a warrant, either a European arrest warrant or similar, under these arrangements notwithstanding the fact that the United Kingdom is no longer part of the European Union?
- Land and Conveyancing Law Reform Bill 2021 [Seanad]: Second Stage (17 Nov 2021)
Brendan Howlin: I am glad to have an opportunity to say a few words on this rather unusual legislation. First, I must refer to the Minister's final scripted sentence, which was, "Time is short – we have just under two weeks." I welcomed her back yesterday but, in her absence, I raised on numerous occasions with the Minister of State, Deputy James Browne, the fact that a series of Bills was...

- Land and Conveyancing Law Reform Bill 2021 [Seanad]: Second Stage (17 Nov 2021)
Brendan Howlin: We now move back to the Government speaking slot. I do not see anybody offering.
- Land and Conveyancing Law Reform Bill 2021 [Seanad]: Second Stage (17 Nov 2021)
Brendan Howlin: No, this is the balance of the Social Democrats slot. The Deputy's slot is yet to come.
- Land and Conveyancing Law Reform Bill 2021 [Seanad]: Second Stage (17 Nov 2021)
Brendan Howlin: We are now moving to the Sinn Féin speaking slot and I call Deputy Tully who has three minutes.
- Land and Conveyancing Law Reform Bill 2021 [Seanad]: Second Stage (17 Nov 2021)
Brendan Howlin: As there is no Sinn Féin speaker offering, I move on to Solidarity-People Before Profit. Deputy Boyd Barrett has 20 minutes.
- Ceisteanna - Questions - Ceisteanna ar Sonraíodh Uain Dóibh - Priority Questions: Humanitarian Access (18 Nov 2021)
Brendan Howlin: 2. To ask the Minister for Foreign Affairs and Trade the action taken to address the humanitarian crisis developing on the Belarus-Poland and Belarus-Lithuania borders in particular to bring relief to the thousands of migrants stuck in makeshift camps on the borders of the EU; and if he will make a statement on the matter. [56502/21]
- Ceisteanna - Questions - Ceisteanna ar Sonraíodh Uain Dóibh - Priority Questions: Humanitarian Access (18 Nov 2021)
Brendan Howlin: Will the Minister set out the action he and his EU colleagues have taken to date, and, more importantly, will take, to address the growing humanitarian crisis on the border of the EU and Belarus where, as everybody will be aware, thousands of men, women and children are trapped in dreadful conditions?
- Ceisteanna - Questions - Ceisteanna ar Sonraíodh Uain Dóibh - Priority Questions: Humanitarian Access (18 Nov 2021)
Brendan Howlin: I thank the Minister for his reply. It is well and good to denounce the dreadful Lukashenko regime in Belarus. He is clearly a tyrant with no democratic legitimacy, but the problem is for the thousands of people who are now, as one migrant described, a football being kicked between Lukashenko and the border protectors of the EU. The Minister is right to increase the pressure and...
- Ceisteanna - Questions - Ceisteanna ar Sonraíodh Uain Dóibh - Priority Questions: Humanitarian Access (18 Nov 2021)
Brendan Howlin: It is perfectly understandable. The EU did not bring those people there. However it is disingenuous for the Minister to say that they are on the Belarusian side. They are standing looking at coils of barbed wire, yards away from the European Union. The Union cannot say that they are not ours and we have no responsibility there.
