Seanad: Protection of Employees (Temporary Agency Work) Bill 2011: Committee Stage (1 Mar 2012)

Seán Sherlock: I am certain there is no prescriptive measure laid down, such as, for example, that employees must be a member of a trade union, by which they can consult under the provisions of section 8.

Seanad: Protection of Employees (Temporary Agency Work) Bill 2011: Committee Stage (1 Mar 2012)

Seán Sherlock: This is a technical amendment which seeks to ensure that for the purposes only of equal treatment of working and employment conditions for agency workers that are part-time employees, it is the provisions of this legislation and not that of the Protection of Employees (Part-Time Work) Act 2001 that applies. In effect, this means that whereas in that Act, the appropriate comparator that is...

Seanad: Protection of Employees (Temporary Agency Work) Bill 2011: Committee Stage (1 Mar 2012)

Seán Sherlock: I understand the rationale behind these amendments. The provision as it stands, however, lists the facilities and amenities intended. While the list is not exhaustive, it is not intended that collective facilities and amenities would include remuneration or expenses. There is a danger in introducing one proposed exclusion as to do so would raise other issues that could be equally proposed...

Seanad: Protection of Employees (Temporary Agency Work) Bill 2011: Committee Stage (1 Mar 2012)

Seán Sherlock: Amendment No. 15 can be addressed in the context of the guidance documentation provided with the Bill. On the other points regarding the august body of employment legislation and the system of joint labour committees and registered employment agreements, it is a surreal experience to hear a Fianna Fáil Party Senator-----

Seanad: Protection of Employees (Temporary Agency Work) Bill 2011: Committee Stage (1 Mar 2012)

Seán Sherlock: -----whose former leader, the great Seán Lemass, was the architect of some of the joint labour committees and registered employment agreements.

Seanad: Protection of Employees (Temporary Agency Work) Bill 2011: Committee Stage (1 Mar 2012)

Seán Sherlock: Senators will forgive me if I sound a little confused. We should not dismantle or raze to the ground the employment protections in place for workers on the basis of the current economic climate. We must strike a balance, which is what we seek to do in the legislation.

Seanad: Protection of Employees (Temporary Agency Work) Bill 2011: Committee Stage (1 Mar 2012)

Seán Sherlock: To be fair, the Government is doing its best to create employment and the conditions for employment. While I note the points made by Senators, I respectfully suggest they should be made on the basis of the amendment under discussion. If someone starts speaking about dismantling the joint labour committee architecture, that is another issue. For the purposes of the discussion of this...

Seanad: Protection of Employees (Temporary Agency Work) Bill 2011: Committee Stage (1 Mar 2012)

Seán Sherlock: On amendment No. 15, the guidance document could clarify the matters raised by Senator Walsh.

Seanad: Protection of Employees (Temporary Agency Work) Bill 2011: Committee Stage (1 Mar 2012)

Seán Sherlock: With due respect, I have made known my views.

Seanad: Protection of Employees (Temporary Agency Work) Bill 2011: Committee Stage (1 Mar 2012)

Seán Sherlock: That is one of the most patronising comments I have heard in a long time. I am a Labour Party Minister of State who shares my Department with a senior colleague from the Fine Gael Party. We are completely ad idem on this issue. I am not here to do my master's bidding. An agreement has been reached as to how these issues are transposed.

Euro Area Loan Facility (Amendment) Bill 2012: Second Stage (Resumed) (7 Mar 2012)

Seán Sherlock: Is the Deputy willing to yield to allow me to make a debating point?

Euro Area Loan Facility (Amendment) Bill 2012: Second Stage (Resumed) (7 Mar 2012)

Seán Sherlock: I thank the Deputy sincerely. While I respect what he is saying, it should be acknowledged that, while in power, his party caused this country to be reduced almost to penury and signed up to a memorandum of understanding. In discussing the situation in Greece, the European Union and the treaty we must not revise our history. The Deputy should acknowledge the factors that lead to the...

Euro Area Loan Facility (Amendment) Bill 2012: Second Stage (Resumed) (7 Mar 2012)

Seán Sherlock: Where was the Deputy's voice in cabinet?

Order of Business (13 Mar 2012)

Seán Sherlock: Deputy Dooley will have to get up a bit earlier in the morning.

Order of Business (13 Mar 2012)

Seán Sherlock: He had his opportunity.

EU Regulations: Motions (13 Mar 2012)

Seán Sherlock: I move the following motions: That Dáil Éireann approves the exercise by the State of the option or discretion under Protocol No. 21 on the position of the United Kingdom and Ireland in respect of the area of freedom, security and justice annexed to the Treaty on European Union and to the Treaty on the Functioning of the European Union, to take part in the adoption and application of the...

Special Educational Needs (13 Mar 2012)

Seán Sherlock: I thank Deputy Michael McGrath for raising this issue. As the Deputy is aware 10,575 special needs assistant posts are available for allocation to schools for the 2012-13 school year. This is the same number of posts available for allocation in the current school year. Therefore, there has been no reduction in the overall number of SNA posts available for allocation in the coming school...

Special Educational Needs (13 Mar 2012)

Seán Sherlock: I thoroughly respect the fact that the Deputy must advocate for the school in his constituency and I do not doubt the veracity of the case made by him in respect of the school and the good work it carries out. However, the Deputy has admitted an overall cap is in place. A process is under way in respect of SNA allocation and we should have regard to this fact. The Deputy's claim that this...

Industrial Disputes (13 Mar 2012)

Seán Sherlock: I thank Deputy Dowds for raising this matter and for the opportunity to respond. Stobart Ireland is part of the Stobart Group which, I understand, operates from over 40 sites across the UK and Europe. Stobart Ireland began operating in 2008 winning the transport services contract with Tesco in 2010 to distribute all of the products it keeps at depots at Ballymun and Donabate in Dublin. On...

Industrial Disputes (13 Mar 2012)

Seán Sherlock: I take the Deputy's point. In response, I contend that the legitimacy of the Labour Relations Commission, which has opened its doors to facilitate a process, is one the State, Irish workers and most employers buy into. That is the right way to proceed on this issue. I hope the Stobart organisation will have due regard to that process.
