Seanad: Seanad Electoral (University Members) (Amendment) Bill 2020: Committee Stage (5 Jul 2023)

Lynn Ruane: Hear, hear.

Seanad: Seanad Electoral (University Members) (Amendment) Bill 2020: Committee Stage (5 Jul 2023)

Lynn Ruane: These first amendments are not about expanding the register. A lot of time was spent talking about this aspect. We put a lot of work into scrutinising legislation and proposing amendments, trusting it reflects what we are about to do. It feels like there is a desire here, though, to say things on the record concerning what is being done on reform and what has happened already in this...

Seanad: Seanad Electoral (University Members) (Amendment) Bill 2020: Committee Stage (5 Jul 2023)

Lynn Ruane: That gives me much more comfort. There was far more detail there regarding the process that are needed. I am happy to withdraw the amendment and resubmit it on Report Stage. I would not have been able to do so if the Bill had gone through the Houses sooner. I did not graduate from Trinity until 18 months after I became a Senator, so I would not be here to debate the legislation had such...

Seanad: Seanad Electoral (University Members) (Amendment) Bill 2020: Committee Stage (5 Jul 2023)

Lynn Ruane: I move amendment No. 3: In page 3, lines 18 and 19, to delete “as determined by the Minister” and substitute “as provided for by law”. Amendment No. 2 is a technical amendment to insert ""Act of 1947" means the Seanad Electoral (Panel Members) Act 1947;" into the definitions section. I will come to my amendments in this grouping in due course. If we are...

Seanad: Seanad Electoral (University Members) (Amendment) Bill 2020: Committee Stage (5 Jul 2023)

Lynn Ruane: I am not sure whether the other elements of the Bill will come up in discussion of the amendments. If they will they can come up then, but if not-----

Seanad: Seanad Electoral (University Members) (Amendment) Bill 2020: Committee Stage (5 Jul 2023)

Lynn Ruane: To respond to what the Minister said, I feel much more comfortable about how the legislation will be in relation to this constituency. I am happy to withdraw this amendment at this point. It would be beneficial to hear what the other concerns are because they will inform later amendments.

Seanad: Seanad Electoral (University Members) (Amendment) Bill 2020: Committee Stage (5 Jul 2023)

Lynn Ruane: In drafting its legislation, I urge the Government to engage with those of us in the Civil Engagement Group, CEG, who have been championing this issue since we were elected in 2016. Doing some of the heavy lifting and ensuring that legislation addresses all concerns before it even hits the Chamber is always welcome. I accept the Minister’s comments. We look forward to engaging and...

Seanad: Seanad Electoral (University Members) (Amendment) Bill 2020: Committee Stage (5 Jul 2023)

Lynn Ruane: I will withdraw the amendment but reserve the right to resubmit it.

Joint Oireachtas Committee on Assisted Dying: Legal Protections and Sanctions: Discussion (4 Jul 2023)

Lynn Ruane: I thank Professor Huxtable. I have time to ask a question of Mr. Kelly. There are two things in his paper that interest me. If I do not have time to address the second one in this round, I will come back to it. The paper refers to having to meet the medical criteria to avail of assisted dying in the case of it being regulated and that being set out, but it makes the point that persons who...

Joint Oireachtas Committee on Assisted Dying: Legal Protections and Sanctions: Discussion (4 Jul 2023)

Lynn Ruane: I have one question for Dr. Huxtable and one for Dr. Mills. Dr Huxtable spoke about the ethical position on dying and some of the arguments that may be put forward. He emphasised the importance of consistency in relation to legal systems which already permit practices that rest on identical or similar justifications. I would like him to elaborate on that. My question for Dr. Mills, and...

Joint Oireachtas Committee on Justice, Defence and Equality: General Scheme of the Defamation (Amendment) Bill: Discussion (Resumed) (4 Jul 2023)

Lynn Ruane: With regard to SLAPPs, are such lawsuits always taken after the fact of publication or speech? Can they be taken at an earlier point in time when someone becomes aware of an issue or is asked for comment or when an academic has a draft of a book? SLAPPs can stop things reaching the public realm as well as comprising suits when they have already reached the public realm. Is that correct?

Joint Oireachtas Committee on Justice, Defence and Equality: General Scheme of the Defamation (Amendment) Bill: Discussion (Resumed) (4 Jul 2023)

Lynn Ruane: It is very hard to include retrospective provisions in legislation. I have not looked at Dr. Eoin O'Dell's proposal specifically. Does it only apply to live cases or would it undo all cases that have not made it into the public domain for as long as they have existed? Does it apply only to cases that are currently live before the courts or would there be a retrospective removal of...

Joint Oireachtas Committee on Justice, Defence and Equality: General Scheme of the Defamation (Amendment) Bill: Discussion (Resumed) (4 Jul 2023)

Lynn Ruane: With regard to juries, I am in favour of keeping juries involved in court proceedings but I understand people's concerns. The witnesses last week were very much against the idea that juries are what is holding up cases. It is about more than judges; it is also about court space and various other issues. I wonder about a couple of issues. Last week, one of the contributors - I forget who -...

Joint Oireachtas Committee on Justice, Defence and Equality: General Scheme of the Defamation (Amendment) Bill: Discussion (Resumed) (4 Jul 2023)

Lynn Ruane: Perhaps he could reply to my comments first and then he can reply to the earlier questions.

Joint Oireachtas Committee on Justice, Defence and Equality: General Scheme of the Defamation (Amendment) Bill: Discussion (Resumed) (4 Jul 2023)

Lynn Ruane: It is in the public interest.

Joint Oireachtas Committee on Justice, Defence and Equality: General Scheme of the Defamation (Amendment) Bill: Discussion (Resumed) (4 Jul 2023)

Lynn Ruane: I want to clarify something. With regard to the very poor, I understand the point with regard to the other side's costs, but is legal aid granted to take cases?

Joint Oireachtas Committee on Justice, Defence and Equality: General Scheme of the Defamation (Amendment) Bill: Discussion (Resumed) (4 Jul 2023)

Lynn Ruane: Then it would probably be a non-starter in the first place.

Joint Oireachtas Committee on Assisted Dying: Developing a Legal Framework for Assisted Dying: Discussion (11 Jul 2023)

Lynn Ruane: I thank the witnesses for their presentations. My first question is for Professor Jones. I found the phrase "have accepted that some lives are unworthy of life" that Senator O'Loughlin picked up on to be quite problematic. It is quite stigmatising to people who have had to face difficult decisions. I am not a practising Catholic but nor would I consider myself to be an atheist as I have...

Joint Oireachtas Committee on Assisted Dying: Developing a Legal Framework for Assisted Dying: Discussion (11 Jul 2023)

Lynn Ruane: Okay.
