Seán Fleming: On local government, I understand elected members are entitled to make their own decisions. They are entitled to be right or wrong.

Seán Fleming: However, the Minister has suggested nobody should be entitled to second guess them. The Ombudsman does not have legal authority to overturn decisions, but it would be a nice forum for members of the public who might not be happy with decisions taken by elected members. The local authority and its members are not legally obliged to accept a decision of the Ombudsman, although they normally do so.

Seán Fleming: The Ombudsman expresses a view which can be accepted or rejected. As the Minister said, it is a democratic decision and there should be no second guessing. If the elected members do not come to a conclusion within 104 weeks, the manager has the legal power to finish a development plan over their heads. He or she is entitled to second guess something they have not concluded.
