Paschal Mooney: He will have to be nice.

Seanad: Social Welfare Bill 2012: Fifth Stage (20 Dec 2012)

Paschal Mooney: On a point of order, this is a very serious development. In all of my time in the House I cannot remember where a verbal amendment was made. I am not saying that attempts have not been made. Under Standing Orders, as far as our reading and interpretation goes, in absolutely clear and simple English it says that "without notice" a verbal amendment can be made.

Seanad: Social Welfare Bill 2012: Fifth Stage (20 Dec 2012)

Paschal Mooney: It is a point of order because there is a ruling.

Seanad: Social Welfare Bill 2012: Fifth Stage (20 Dec 2012)

Paschal Mooney: With respect, the Leas-Chathaoirleach cannot make a ruling without explaining his reason to the House.

Seanad: Social Welfare Bill 2012: Fifth Stage (20 Dec 2012)

Paschal Mooney: You cannot adopt that view. With due respect, you cannot make a ruling unilaterally without explaining it to the House.

Seanad: Social Welfare Bill 2012: Fifth Stage (20 Dec 2012)

Seanad: Social Welfare Bill 2012: Fifth Stage (20 Dec 2012)

Paschal Mooney: I would be grateful if the Cathaoirleach would consider putting the issue that came before the House earlier - that is, the tabling of verbal amendments - to the Committee on Procedure and Privileges to bring clarity to that particular Standing Order. The Bill is before the House at a time when the whole concept of austerity measures is being questioned internationally. The Minister will be...

Joint Oireachtas Committee on Health and Children: Implementation of Government Decision Following Expert Group Report into Matters Relating to A, B and C v. Ireland (9 Jan 2013)

Paschal Mooney: I echo all the justified compliments paid to both witnesses. I thank them for the clarity they have provided in response to our questions. I have a question for Mrs. Justice McGuinness. It is not unconstitutional for the Supreme Court to revisit its own decisions. It has happened infrequently. I ask Mrs. Justice McGuinness to outline under what circumstances the Supreme Court would...

Seanad: Local Government Reform: Statements (22 Jan 2013)

Paschal Mooney: I welcome the Minister and share the view that he is a reformer who, as someone who came from the local authority system, knows the various structures intimately. However, even a cursory reading of the excellent briefing document prepared by the Oireachtas Library and Research Service would give pause for thought and, I am sure, some concern on the part of the Minister. It conducted a...

Paschal Mooney: According to the information provided to me it is investigating the serious implications of any attempt to change the criteria unless it is acceptable in Europe.

Seanad: Local Government Reform: Statements (22 Jan 2013)

Paschal Mooney: The Minister is aware that Leader funds come from Europe and that Europe initiated this concept. I would be more than happy to hear a clarification from the Minister because he is obviously more aware of the facts. I am merely pointing out that concerns have been expressed. As somebody who served as a councillor on the old partnership boards I genuinely believe they are doing a valuable...
