Select Committee on Transport, Tourism and Sport: Road Traffic Bill 2016 (Seanad): Committee Stage (30 Nov 2016)

Imelda Munster: I am sorry.

Select Committee on Transport, Tourism and Sport: Road Traffic Bill 2016 (Seanad): Committee Stage (30 Nov 2016)

Imelda Munster: Amendment No. 32 is similar to my amendment, which is amendment No. 33. Amendment No. 33 involves the driving licence number of the policyholder and all named drivers covered under the policy. The amendment aims to ensure the motor insurance industry gives clarity and full information to the Garda.

Select Committee on Transport, Tourism and Sport: Road Traffic Bill 2016 (Seanad): Committee Stage (30 Nov 2016)

Imelda Munster: I move amendment No. 35:In page 16, between lines 8 and 9, to insert the following:"Regulation of Rickshaws 20.The Taxi Regulation Act 2013, is amended in section 20, by the insertion of the following subsection:"(5) (i) The Authority may make regulations, to be known as non-motorised passenger transport regulations, in relation to the operation of non-motorised passenger transporters in...

Select Committee on Transport, Tourism and Sport: Road Traffic Bill 2016 (Seanad): Committee Stage (30 Nov 2016)

Imelda Munster: Can we get a timeframe because in all fairness, the Minister has been aware of this since the beginning of the year? I know it does not happen overnight but it is like everything else. There needs to be a timeframe because here we are discussing the Bill, people are moving amendments we want to see included in the Bill and we are continually asked to hold off. We need a timeframe on this...

Select Committee on Transport, Tourism and Sport: Road Traffic Bill 2016 (Seanad): Committee Stage (30 Nov 2016)

Imelda Munster: It is. If one reads what we seek to insert, it is that the authority may make regulations to be known as non-motorised passenger transport regulations in relation to the operation of non-motorised passenger transporters in towns and cities. There is nothing I can see in that paragraph alone that prohibits its inclusion as a new section in the Bill.

Select Committee on Transport, Tourism and Sport: Road Traffic Bill 2016 (Seanad): Committee Stage (30 Nov 2016)

Imelda Munster: A lot of issues were raised today. They were withdrawn because of the fact that they would delay the Bill. In fairness, I seek a bit of flexibility. A lot of the amendments were withdrawn because they would have delayed the Bill. That point was recognised. The Minister knew full well that this was a serious issue that needed to be addressed.

Select Committee on Transport, Tourism and Sport: Road Traffic Bill 2016 (Seanad): Committee Stage (30 Nov 2016)

Imelda Munster: It would not have taken too much to keep the pressure on and to speed up so that we would have had something prior to this which we could have included in the Bill. We would not then be at this stage. I am not withdrawing it, therefore. I cannot see why that paragraph cannot be included. It at least acknowledges the need for regulation that can be included in the Bill. I would not accept...

Select Committee on Transport, Tourism and Sport: Road Traffic Bill 2016 (Seanad): Committee Stage (30 Nov 2016)

Imelda Munster: I will withdraw the amendment, but I will be resubmit it on Report Stage.

Select Committee on Transport, Tourism and Sport: Road Traffic Bill 2016 (Seanad): Committee Stage (30 Nov 2016)

Imelda Munster: I move amendment No. 38:In page 17, between lines 20 and 21, to insert the following:“Use of a Mobile Phone while driving 22. The Road Traffic Act 2006, is amended in section 3, by the insertion of the following subsection: “(10) It shall be an offence under this subsection to use a mobile phone which is held in a device by the steering wheel or is in a cradle by the...

Select Committee on Transport, Tourism and Sport: Road Traffic Bill 2016 (Seanad): Committee Stage (30 Nov 2016)

Imelda Munster: I am not speaking about hands-free kits but about devices attached to the steering wheel or in the cradle beside the driver's seat into which a mobile phone can be inserted, thereby enabling the driver to text and so on. As it means taking his or her eyes off the road, it is a road safety issue. I am seeking to make it an offence to use a mobile phone held in such a device while driving.

Select Committee on Transport, Tourism and Sport: Road Traffic Bill 2016 (Seanad): Committee Stage (30 Nov 2016)

Imelda Munster: Is the Minister saying the issue which I am seeking to address in the amendment, namely, the use of a mobile phone held in a cradle by the steering wheel, etc, is covered by existing legislation?

Select Committee on Transport, Tourism and Sport: Road Traffic Bill 2016 (Seanad): Committee Stage (30 Nov 2016)

Imelda Munster: I move amendment No. 44:In page 18, between lines 31 and 32, to insert the following: “Learner Driver driving unaccompanied (Owner) 25. The Road Traffic Act 1961, is amended by the insertion of the following section:“35A.(1)It shall be an offence for the owner of a vehicle to allow their vehicle be driven by a learner driver driving unaccompanied.(2) Where a person charged...

Ceisteanna - Questions (Resumed) - Priority Questions: Public Transport Provision (7 Dec 2016)

Imelda Munster: 27. To ask the Minister for Transport, Tourism and Sport his views on the future of public transport here in view of the serious issues raised by the NTA's rail review, concerns regarding the future of the Expressway bus service, ongoing industrial relations issues surrounding a number of national carriers and previous industrial action taken by Dublin Bus and Luas workers; his further views...

Ceisteanna - Questions (Resumed) - Priority Questions: Public Transport Provision (7 Dec 2016)

Imelda Munster: My question on the future of public transport has been topical since the Minister took office and even more so in recent days, the Minister having acknowledged that Bus Éireann is in crisis. Has the Minister considered re-evaluating his approach to public transport and his engagement with the sector?

Ceisteanna - Questions (Resumed) - Priority Questions: Public Transport Provision (7 Dec 2016)

Imelda Munster: The Minister is aware that public transport is the main option available to us to reduce congestion in cities, improve links in economies in regional areas, meet our carbon targets and continue to ensure rural and social inclusion through our public transport network. In fact, it is the main solution to the myriad transport issues we face. I am sure the Minister understands that public...

Ceisteanna - Questions (Resumed) - Priority Questions: Public Transport Provision (7 Dec 2016)

Imelda Munster: I am sure the Minister will acknowledge that continued under-investment has been the root cause of the crisis in which we have found ourselves since 2008. The public transport network receives a much smaller subvention than in many countries across Europe. Cutting off links and services that are failing should not be the automatic response, given the economic and social benefits public...

Imelda Munster: 29. To ask the Minister for Transport, Tourism and Sport the engagement he has had with his Northern counterparts on matters relevant to his portfolio, particularly in the areas of infrastructure and tourism, in view of Britain's intention to leave the EU in the next two years; his plans to maintain and improve current cross-Border engagement with relevant organisations; the interactions he...

Ceisteanna - Questions (Resumed) - Priority Questions: Brexit Issues (7 Dec 2016)

Imelda Munster: In light of Britain's intention to leave the EU in the next two years, what engagement has the Minister had with his Northern counterparts on matters relevant to his portfolio, particularly infrastructure and tourism, his plans to maintain and improve current cross-Border engagement and what interactions, if any, he has with the Assembly in the North on the changes that will come about when...

Ceisteanna - Questions (Resumed) - Priority Questions: Brexit Issues (7 Dec 2016)

Imelda Munster: I welcome the Minister's confirmation of his one-to-one meeting with the Minister, Chris Hazzard. Has the Minister met with cross-Border groups such as Tourism Ireland to discuss Brexit in particular and with a view to ensuring EU funding secured for cross-Border projects remains in place? On the hard Border issue, has the Minister had any discussions on, for example, the need for...

Other Questions: Motor Insurance (7 Dec 2016)

Imelda Munster: 31. To ask the Minister for Transport, Tourism and Sport his views on the current situation regarding motor insurance; the measures he has taken to address it; if he has met the Minister for Finance on the matter; the proposals his Department has on the way to resolve the matter; and if he will make a statement on the matter.
