Judicial Council Bill 2017 [Seanad]: Committee and Remaining Stages (4 Jul 2019)

Donnchadh Ó Laoghaire: I move amendment No. 6:In page 26, to delete line 36.

Judicial Council Bill 2017 [Seanad]: Committee and Remaining Stages (4 Jul 2019)

Donnchadh Ó Laoghaire: I move amendment No. 7:In page 26, after line 39, to insert the following:“(4) The Public Appointments Service shall have regard to the objective that the Sentencing Guidelines and Information Committee will at all times have knowledge of, and experience in, the promotion of the welfare of the victims of crime.”.

Judicial Council Bill 2017 [Seanad]: Committee and Remaining Stages (4 Jul 2019)

Donnchadh Ó Laoghaire: The amendment derives from an amendment proposed by Senator Lynn Ruane and others in the Seanad. It deals with a review of current statutory mandatory, minimum and presumptive sentencing provisions. There is no difficulty with that. This amendment is simply a redrafting, as I understand it, and those in Senator Ruane's office are happy enough with it. I will support it as I think it is...

Judicial Council Bill 2017 [Seanad]: Committee and Remaining Stages (4 Jul 2019)

Donnchadh Ó Laoghaire: That does not answer the question, which was specific enough. The matter will not affect my support for the Bill as I am reasonably happy with the legislation in any event. Would it constitute misconduct if a judge persistently departed from the sentencing guidelines? It is a technical question but it can be answered.

Judicial Council Bill 2017 [Seanad]: Committee and Remaining Stages (4 Jul 2019)

Donnchadh Ó Laoghaire: That is a concern of mine as well. My concern relates to amendments Nos. 9, 10 and 13. The three sections that are proposed to be deleted will result in the removal of the provision for naming a judge against whom an allegation or complaint has been substantiated. I do not believe that is right. The matter was discussed in the Seanad and the majority of Senators voted in favour of the...

Judicial Council Bill 2017 [Seanad]: Committee and Remaining Stages (4 Jul 2019)

Donnchadh Ó Laoghaire: I might take a second to examine that briefly. While I am doing that, could the Minister respond to the specific query about misconduct that has been asked two or three times now?

Judicial Council Bill 2017 [Seanad]: Committee and Remaining Stages (4 Jul 2019)

Donnchadh Ó Laoghaire: It is valuable legislation in several respects, and it is good that it has finally been brought through this House. As I said before, it is vitally important for the accountability of judges, but also in supporting them and providing structures for education and training. The provisions on insurance are of value, though they are not the entire solution in and of themselves. A key...

Written Answers — Department of Justice and Equality: Legislative Reviews (9 Jul 2019)

Donnchadh Ó Laoghaire: 307. To ask the Tánaiste and Minister for Justice and Equality if the legislative review relating to hate crime and incitement to hatred in the context of integration policy and the EU Framework Decision 2008/913/JHA on combating certain forms and expressions of racism and xenophobia by means of criminal law has been completed; if the review will be made public; and if he will make a...

Written Answers — Department of Health: Hospital Waiting Lists (9 Jul 2019)

Donnchadh Ó Laoghaire: 499. To ask the Minister for Health his views on the waiting lists for pain, MRI, rheumatology and neurology clinics; and the way in which he plans to address the waiting times. [29870/19]

Written Answers — Department of Health: Child and Adolescent Mental Health Services (9 Jul 2019)

Donnchadh Ó Laoghaire: 500. To ask the Minister for Health the steps he is taking to reduce waiting times for children seeking access to CAMHS; and if he will make a statement on the matter. [29871/19]

Written Answers — Department of Health: Medicinal Products (9 Jul 2019)

Donnchadh Ó Laoghaire: 501. To ask the Minister for Health if his attention has been drawn to concerns regarding the prescription of synthetic T4 drugs in response to a diagnosis of hypothyroidism; and if he will make a statement on the matter. [29872/19]

Redress for Women Resident in Certain Institutions (Amendment) Bill 2019 [Seanad]: Second and Subsequent Stages (10 Jul 2019)

Donnchadh Ó Laoghaire: We will be supporting this legislation although we have some reservations about elements of it. The State has a desperate legacy in respect of the women in the Magdalen laundries. It is not an item that can be considered in isolation. It is part of a wider network and system of institutionalisation that extended to mother and baby homes, county homes and other institutions. It really is a...

Coroners (Amendment) Bill 2018: From the Seanad (10 Jul 2019)

Donnchadh Ó Laoghaire: This seems a sensible amendment to valuable and comprehensive legislation. Sinn Féin will support it. I thank the Minister for his remarks and express my appreciation for his engagement and co-operation on a number of issues and across various debates. I also thank his officials in the Department of Justice and Equality who regularly made themselves available.

Coroners (Amendment) Bill 2018: From the Seanad (10 Jul 2019)

Donnchadh Ó Laoghaire: I wish to take the opportunity to acknowledge members of the Elephant Collective who are in the Gallery. They have campaigned for this legislation and I wish to acknowledge their contribution to this debate.

Qualifications and Quality Assurance (Education and Training) (Amendment) Bill 2018 [Seanad]: Committee and Remaining Stages (10 Jul 2019)

Donnchadh Ó Laoghaire: I support the amendment but will await the Minister of State's response on community not-for-profit education. It is reasonable to exempt that sector but it may be the case that it is already accepted under the cover of the ETBs. In any event, it is a reasonable proposition and a good amendment which is supported by Aontas, which is one of the organisations that has been vocal on the issue....

Criminal Justice (International Co-operation) Bill 2019: Second Stage (10 Jul 2019)

Donnchadh Ó Laoghaire: 10 o’clock I am supporting this legislation but, like Deputy O'Callaghan, I regret we are dealing with the legislation in this way. This agreement was reached in excess of four years ago but this legislation will have progressed from publication to being passed in 13 days. The timeline from publication to the first deadline for the submission of amendments was four days. The...

Criminal Justice (International Co-operation) Bill 2019: Committee Stage (10 Jul 2019)

Donnchadh Ó Laoghaire: It is important that Deputy Maureen O'Sullivan has moved this amendment. It is right that this jurisdiction is moving forward with legislation, which is overdue, but there must be accompanying action from Britain. On the text of the amendment, it is not necessarily the case that we should avoid legislating because of the absence of legislation in Britain. However, the lack of action is...

Joint Oireachtas Committee on Justice, Defence and Equality: Spent Convictions: Discussion (10 Jul 2019)

Donnchadh Ó Laoghaire: I will try to pop in occasionally.

Joint Oireachtas Committee on Justice, Defence and Equality: Spent Convictions: Discussion (10 Jul 2019)

Donnchadh Ó Laoghaire: I welcome the Bill. It is good legislation. Like Deputy O'Callaghan, I find people come into my clinic occasionally to ask about their situation and whether the spent convictions legislation would apply to them. Even before the facts of their cases are out of their mouths, I am thinking it probably would not apply to them. When the facts have been put before me, I have found the...

Joint Oireachtas Committee on Justice, Defence and Equality: Spent Convictions: Discussion (10 Jul 2019)

Donnchadh Ó Laoghaire: Has there been much change in that rate over the years? Have we made progress or fallen back?
