Committee on Infrastructure and National Development Plan Delivery: Judicial Review and Appeals Process: Engagement with Courts Service (9 Jul 2025)

Patricia Stephenson: Admitted to the planning and environment list.

Committee on Infrastructure and National Development Plan Delivery: Judicial Review and Appeals Process: Engagement with Courts Service (9 Jul 2025)

Patricia Stephenson: I have a follow-up question. I think the answer is probably "No". Does Ms Denning have data on who is submitting those judicial reviews?

Committee on Infrastructure and National Development Plan Delivery: Judicial Review and Appeals Process: Engagement with Courts Service (9 Jul 2025)

Patricia Stephenson: The collation of that data into something that is easier to access rather than going through every single individual list is a policy decision that would sit outside the scope of the Courts Service's remit.

Committee on Infrastructure and National Development Plan Delivery: Judicial Review and Appeals Process: Engagement with Courts Service (9 Jul 2025)

Patricia Stephenson: Where would that policy decision sit?

Committee on Infrastructure and National Development Plan Delivery: Judicial Review and Appeals Process: Engagement with Courts Service (9 Jul 2025)

Patricia Stephenson: When it comes the whole thing around judicial review, is anyone responsible for presenting that data in a way that is actually accessible to the public?

Committee on Infrastructure and National Development Plan Delivery: Judicial Review and Appeals Process: Engagement with Courts Service (9 Jul 2025)

Patricia Stephenson: In the context of planning, I mean.

Committee on Infrastructure and National Development Plan Delivery: Judicial Review and Appeals Process: Engagement with Courts Service (9 Jul 2025)

Patricia Stephenson: Yes, maybe that is an issue we can discuss as a committee. I feel like there is a real gap there in terms of the public interest around judicial review and understanding what is driving that, and without that data, we cannot do that. I recognise that it is all available if one goes and looks, but that is not easily accessible. There is a level of public interest linked to that. We should...

Committee on Infrastructure and National Development Plan Delivery: Judicial Review and Appeals Process: Engagement with Courts Service (9 Jul 2025)

Patricia Stephenson: I thank Ms Denning very much.

Committee on Infrastructure and National Development Plan Delivery: Judicial Review and Appeals Process: Engagement with Courts Service (9 Jul 2025)

Patricia Stephenson: It exists, surely. That type of disaggregated data does exist somewhere in the submissions, surely.

Seanad: Planning and Development (Amendment) Bill 2025: Committee and Remaining Stages (15 Jul 2025)

Patricia Stephenson: The Minister of State is asking to us support a Bill that erodes basic human dignity and environmental protections and basically gives carte blanche to developers to hide the fact that his Government is a serial failure when it comes to housing. We are asked to support a Bill that will lower housing standards at a time people are struggling to find homes that support basic well-being. He...

Seanad: Planning and Development (Amendment) Bill 2025: Committee and Remaining Stages (15 Jul 2025)

Patricia Stephenson: On amendment No. 1 to amendment No. 13., I am going to double-check this and let the Minister of State know later, but this might have been slightly reformatted from my original submission. Maybe it was something to do with the renumbering but anyway, I will speak to the essence of the amendment. The purpose of this amendment is to limit the potentially negative effect of the specified...

Seanad: Planning and Development (Amendment) Bill 2025: Committee and Remaining Stages (15 Jul 2025)

Patricia Stephenson: If it is better for the Minister of State, maybe I should speak to all the amendments as opposed to-----

Seanad: Planning and Development (Amendment) Bill 2025: Committee and Remaining Stages (15 Jul 2025)

Patricia Stephenson: I propose to withdraw the amendment to amendment No. 16. Amendment No. 14, to delete “varied.”.” and substitute “varied.”, is to deal with a punctuation issue. I am sure the officials will pick up on that on another Stage of the Bill. The purpose of the amendment to amendment No. 25 is to ensure that extraordinary and worrying new powers under the 2024...

Seanad: An tOrd Gnó - Order of Business (16 Jul 2025)

Patricia Stephenson: I wish to raise the issue of the escalating violence against Palestinian communities in the West Bank, how these communities face escalating violence every day and how that has intensified dramatically over the last 21 months under the cover of war but, in reality, stems from a long-standing and deliberate campaign of displacement. Just a few weeks ago, I had the privilege of meeting two...

Seanad: An tOrd Gnó - Order of Business (16 Jul 2025)

Patricia Stephenson: On Palestine and the West Bank.

Seanad: Draft Commission of Investigation (Handling of Historical Child Sexual Abuse in Day and Boarding Schools) Order 2025: Motion (16 Jul 2025)

Patricia Stephenson: Last week's announcement of a commission of investigation into historical abuse is welcome, but it is not enough. The scope of the inquiry is too narrow and by design it risks repeating the mistakes of the past. Sexual abuse is one part, a truly devastating part, of a much wider, darker history in our State. It is a history that includes physical violence, emotional cruelty, forced family...

Committee on Infrastructure and National Development Plan Delivery: Judicial Review and Appeals Process: Engagement with Courts Service (9 Jul 2025)

Patricia Stephenson: Deputy Neville spoke a little bit about judicial reviews being used in an obstructive way. He touched on the point I was making around the data and trying to figure out if that is indeed the case. In response to him, I think Ms Denning said there has been an increase in developers taking out judicial reviews.

Committee on Infrastructure and National Development Plan Delivery: Judicial Review and Appeals Process: Engagement with Courts Service (9 Jul 2025)

Patricia Stephenson: Ms Denning touched on this already but I want to put on record that people have a right to challenge decisions. I know she knows that but there can be quite a negative narrative as well around judicial reviews. Obviously, people have a right to challenge planning decisions and we do have planning decisions which are sometimes bad for communities. It is really important to highlight that...

Committee on Infrastructure and National Development Plan Delivery: Judicial Review and Appeals Process: Engagement with Courts Service (9 Jul 2025)

Patricia Stephenson: Absolutely, yes. I suppose a degree of flexibility is provided.
