- Joint Oireachtas Committee on Disability Matters: Younger People in Nursing Homes: Discussion (24 Jun 2021)
Holly Cairns: Congregated settings are a clear example of a State failure to enable individuals to choose to live independently and be part of a community, as required under Article 19 of the United Nations Convention on the Rights of Persons with Disabilities, UNCRPD. This report highlights that the people concerned have no option but to live in nursing homes due to the lack of support from the State....
- Joint Oireachtas Committee on Disability Matters: Younger People in Nursing Homes: Discussion (24 Jun 2021)
Holly Cairns: I have a quick follow-up query. A funding issue was referred to in explaining why only 18 people are part of this scheme, out of a total of more than 1,300 people. That issue needs to be rectified. This congregated settings issue arises repeatedly in the work of this committee. We are aware of the extent of this massive issue, but what is being proposed as a way to start addressing it is...

- Joint Oireachtas Committee on Disability Matters: Younger People in Nursing Homes: Discussion (24 Jun 2021)
Holly Cairns: Is there anything we can do as Oireachtas Members and as a committee to get the funding to speed this process up? It is not acceptable it is 18 transitions out of 1,300. How might this be achieved much faster?
- Joint Oireachtas Committee on Children and Youth Affairs: Pre-Legislative Scrutiny of the General Scheme of the Birth Information and Tracing Bill 2021 (29 Jun 2021)
Holly Cairns: I am in Leinster House. I thank everybody for coming before the committee. I have two questions and I would like brief responses to both. The first one is for Ms Ryan-O'Brien of Aitheantas and the representatives of the Adoption Rights Alliance and The Clann Project. All their statements highlight how this proposed Bill does not meet the threshold of unconditional access to birth...

- Joint Oireachtas Committee on Children and Youth Affairs: Pre-Legislative Scrutiny of the General Scheme of the Birth Information and Tracing Bill 2021 (29 Jun 2021)
Holly Cairns: I thank Mr. O'Brien. I am interested to hear from the witnesses regarding head 40 of the Bill, which references the disapplication of the GDPR. I hope they can shed some light on the implications for unfettered access to birth information.
- Joint Oireachtas Committee on Children and Youth Affairs: Pre-Legislative Scrutiny of the General Scheme of the Birth Information and Tracing Bill 2021 (29 Jun 2021)
Holly Cairns: Yes, and their not having a clear statutory right in that regard. Given all of Ms Hennessy's experience with birth mothers, in particular, she might be able to shed some light on the implications of that.
- Joint Oireachtas Committee on Children and Youth Affairs: Pre-Legislative Scrutiny of the General Scheme of the Birth Information and Tracing Bill 2021 (29 Jun 2021)
Holly Cairns: Would Ms Hennessy say it is crucial that it be included in the legislation that mothers have unrestricted access to that information? Other speakers touched on the need for siblings to have that access but, based on what Ms Hennessy is saying, it sounds like mothers definitely need it as well.
- Joint Oireachtas Committee on Disability Matters: Institutionalisation and the Inappropriate Use of Congregated Settings: Discussion (1 Jul 2021)
Holly Cairns: I thank all the witnesses for appearing before the committee. The dignity and rights of those individuals affected is at the heart of this subject for me and for this committee. Our systems still have a kind of paternalistic attitude that views people with intellectual disabilities as requiring care, rather than enabling them to live as independently as possible and appropriate. Choices in...

- Joint Oireachtas Committee on Disability Matters: Institutionalisation and the Inappropriate Use of Congregated Settings: Discussion (1 Jul 2021)
Holly Cairns: My next question is for Professor Gulati, who spoke about the disproportionate number of people with intellectual disabilities in emergency homeless accommodation. I presume much of that is to do with the fact we do not have enough builds for independent supported living. Can Professor Gulati give us any insights into what other structural and bureaucratic barriers there are in that regard?
- Joint Committee On Children, Equality, Disability, Integration And Youth: General Scheme of the Birth Information and Tracing Bill 2021: Discussion (Resumed) (13 Jul 2021)
Holly Cairns: I have a couple of questions and if there is time I will come back in with more depending on how long the answers are, if that is okay. Head 40 sets out a list of requirements for when or if the Government wants to restrict GDPR rights. Is that compliant with Article 23 of the GDPR, which sets out when member states can make those exemptions? Is it permissible at present for the...
