Joint Oireachtas Committee on Finance, Public Expenditure, Public Service Reform and Digitalisation, and Taoiseach: Engagement with the Minister of State with responsibility for the Office of Public Works (2 Jul 2025)

Shay Brennan: Does that mean I cannot proceed with this line of questioning?

Select Committee on Finance, Public Expenditure, Public Service Reform and Digitalisation, and Taoiseach: Estimates for Public Services 2025.
Vote 13 - Office of Public Works (Revised)
(2 Jul 2025)

Shay Brennan: It is a placeholder for now.

Joint Oireachtas Committee on Foreign Affairs and Trade: General Scheme of Israeli Settlements in the Occupied Palestinian Territory (Prohibition of Importation of Goods) Bill 2025: Discussion (Resumed) (2 Jul 2025)

Shay Brennan: I commend the Senator and her team on their persistence over the last seven years. We are hopefully in the final stretch. I am hopeful that we get this across the line with both goods and services. On that, I want to turn to the Attorney General. Obviously we are awaiting an opinion from the Attorney General about how he would advise the Government to proceed with services. This question...

Joint Oireachtas Committee on Foreign Affairs and Trade: General Scheme of Israeli Settlements in the Occupied Palestinian Territory (Prohibition of Importation of Goods) Bill 2025: Discussion (Resumed) (2 Jul 2025)

Shay Brennan: How likely might a potential legal challenge be? Is that more likely to come from one of the EU institutions or is it likely to come from a domestic business, for example? What would that mean? That is the legal question. The policy question is for Senator Black. How would Senator Black feel about this Bill getting caught up in a legal challenge? I do not want to use the word "success"...

Joint Oireachtas Committee on Foreign Affairs and Trade: General Scheme of Israeli Settlements in the Occupied Palestinian Territory (Prohibition of Importation of Goods) Bill 2025: Discussion (Resumed) (2 Jul 2025)

Shay Brennan: How would the witnesses feel about putting in a run-off clause - if that is even the word for it - that would give businesses time to adapt once this legislation comes into effect? I am thinking particularly on the services side. I guess the goods side could be implemented pretty quickly but on the services side there may be Irish businesses depending on Israeli occupied territory-produced...

Joint Oireachtas Committee on Foreign Affairs and Trade: General Scheme of Israeli Settlements in the Occupied Palestinian Territory (Prohibition of Importation of Goods) Bill 2025: Discussion (Resumed) (2 Jul 2025)

Shay Brennan: I have two questions in the limited time I have. Staying on the postcode issue or the enforcement issue, I understand physical goods are produced in a certain postcode, there is a database and clear labelling. That makes sense. However, I will go back to the software provider I mentioned earlier. If you have three or four customers in Ireland and you are charging about €1 million a...

Joint Oireachtas Committee on Foreign Affairs and Trade: General Scheme of Israeli Settlements in the Occupied Palestinian Territory (Prohibition of Importation of Goods) Bill 2025: Discussion (Resumed) (2 Jul 2025)

Shay Brennan: I appreciate what Mr. O'Neill is saying and certainly with respect to the large multinationals this legislation may cut off a small piece of their market and their business and they can easily absorb that. My concern is for Irish SMEs. They do not necessarily have the luxury of changing their software system overnight. On a macro level, whatever the cost of this legislation to the economy...

Joint Oireachtas Committee on Foreign Affairs and Trade: General Scheme of Israeli Settlements in the Occupied Palestinian Territory (Prohibition of Importation of Goods) Bill 2025: Discussion (Resumed) (2 Jul 2025)

Shay Brennan: To be clear, I am not suggesting that any companies should be given an exception or exemption. I am suggesting, however, that where this enforces hardship, perhaps there is scope for the State to assist. As Mr. O'Neill said, it might not actually arise.

An tOrd Gnó - Order of Business (8 Jul 2025)

Shay Brennan: With the rapid advancement of commercial drone technology, Ireland is witnessing increasing interest from companies seeking to launch drone delivery services. I note in particular a proposed operation in Dundrum which has generated significant public attention and raised questions about the adequacy of our current regulatory framework. Given concerns around safety, privacy, noise and the...

Written Answers — Department of Foreign Affairs and Trade: Ukraine War (10 Jul 2025)

Shay Brennan: 12. To ask the Minister for Foreign Affairs and Trade if he expects that the Special Tribunal for the Crime of Aggression against Ukraine will be able to investigate and prosecute senior government and military leaders responsible for the crime of aggression, up to and including heads of state; and if he will make a statement on the matter. [38074/25]

Written Answers — Department of Foreign Affairs and Trade: Ukraine War (10 Jul 2025)

Shay Brennan: 20. To ask the Minister for Foreign Affairs and Trade if he is confident that current EU support for Ukraine can withstand internal criticism from some members and external pressure from other countries; and if he will make a statement on the matter. [38073/25]

Joint Oireachtas Committee on Foreign Affairs and Trade: General Scheme of Israeli Settlements in the Occupied Palestinian Territory (Prohibition of Importation of Goods) Bill 2025: Discussion (Resumed) (9 Jul 2025)

Shay Brennan: I thank the witnesses for kindly joining us. I apologise for being in and out which meant I did not hear them read their statements into the record but I read them all beforehand. As a non-legal person, I was struck by one thing. Professor Butler can correct me if I am wrong in this. He seems to be saying the Bill is at risk of legal action if we include even trade in goods. He is also...

Joint Oireachtas Committee on Foreign Affairs and Trade: General Scheme of Israeli Settlements in the Occupied Palestinian Territory (Prohibition of Importation of Goods) Bill 2025: Discussion (Resumed) (9 Jul 2025)

Shay Brennan: That is an important point and perhaps one the committee should cover in our recommendations. I missed some of Professor Tridimas's comments on this. Professor Butler seems to rely on the Confédération paysanne case in his interpretation and that seems to be at odds with what Professor Tridimas said as I was leaving. Without wanting to open a debate, I ask Professor Butler to...

Joint Oireachtas Committee on Foreign Affairs and Trade: General Scheme of Israeli Settlements in the Occupied Palestinian Territory (Prohibition of Importation of Goods) Bill 2025: Discussion (Resumed) (9 Jul 2025)

Shay Brennan: I appreciate that. I ask Professor Butler to expand on the discriminatory aspect to other occupied territories, a point which I found interesting.

Joint Oireachtas Committee on Foreign Affairs and Trade: General Scheme of Israeli Settlements in the Occupied Palestinian Territory (Prohibition of Importation of Goods) Bill 2025: Discussion (Resumed) (9 Jul 2025)

Shay Brennan: While I do not expect an answer to this question now, if we get another round of questioning, I would like to ask this of all the witnesses. Professor Butler made a very good point about needing to include indirect importation. If any-----

Joint Oireachtas Committee on Foreign Affairs and Trade: General Scheme of Israeli Settlements in the Occupied Palestinian Territory (Prohibition of Importation of Goods) Bill 2025: Discussion (Resumed) (9 Jul 2025)

Shay Brennan: If that is the intention, of course-----

Joint Oireachtas Committee on Foreign Affairs and Trade: General Scheme of Israeli Settlements in the Occupied Palestinian Territory (Prohibition of Importation of Goods) Bill 2025: Discussion (Resumed) (9 Jul 2025)

Shay Brennan: Of course. If another opportunity arises, I will probably ask what other clauses or items should be included if we want to think that way. If we have another round, I can come back to that.

When he says it could raise a problem, is that something ancillary and not the main point worry about here?

Ceisteanna Eile - Other Questions: Tax Collection (15 Jul 2025)

Shay Brennan: I note June is a non-VAT-due month yet receipts so far have been relatively robust, with cumulative VAT up by €0.6 billion at €11.6 billion, albeit reportedly about €100 million below profile. Will the Minister comment on the significance of these figures?

Ceisteanna Eile - Other Questions: Tax Collection (15 Jul 2025)

Shay Brennan: While the increase of €0.6 billion in cumulative VAT receipts is encouraging, there are signals of underlying volatility. VAT is approximately €100 million behind profile, as I stated. Although modest in percentage terms, that may indicate emerging trends. Will the Minister elaborate on what the Department interprets as the trend in VAT collection so far this year?...
