- Veterinary Practice Bill 2004 [Seanad]: Report Stage (Resumed) and Final Stage. (29 Jun 2005)
John Browne: Following the raising of these issues by Deputy Upton on Committee Stage, the Minister undertook to return to this matter again when the legislation came back into the House. She has given further consideration to it and had consultations with the Office of the Attorney General. She believes the Bill as drafted strikes the correct balance. An example by way of illustration is a practitioner...
- Veterinary Practice Bill 2004 [Seanad]: Report Stage (Resumed) and Final Stage. (29 Jun 2005)
John Browne: Having consulted the Office of the Attorney General, the Minister believes the amendment is not necessary and has advised as such.
- Veterinary Practice Bill 2004 [Seanad]: Report Stage (Resumed) and Final Stage. (29 Jun 2005)
John Browne: Deputies Naughten and Crawford have again proposed amendments covering the carrying out by veterinary nurses of minor medical or surgical procedures. The effect of these amendments would be that ministerial regulations would be required before nurses could become active in this area. When this matter was discussed on Committee Stage, the Minister drew attention to the amendment she had agreed...
- Veterinary Practice Bill 2004 [Seanad]: Report Stage (Resumed) and Final Stage. (29 Jun 2005)
John Browne: The Minister has considered this issue since Committee Stage. The Bill defines certain functions which may only be performed by a veterinary practitioner, while all other functions may be undertaken by a veterinary practitioner, veterinary nurse or layperson. The Minister is satisfied, particularly following her acceptance of amendments in the Seanad which further clarified the position, that...
- Veterinary Practice Bill 2004 [Seanad]: Report Stage (Resumed) and Final Stage. (29 Jun 2005)
John Browne: I move amendment No. 27: In page 78, line 11, to delete "Notwithstanding section 109, where" and substitute "Where". This is purely a technical amendment which arises from the amendments made to this and related sections on Committee Stage. Arising from the earlier amendments, the reference "Notwithstanding section 109" in paragraph (i) of section 107 is redundant and, on the advice of the...
- Veterinary Practice Bill 2004 [Seanad]: Report Stage (Resumed) and Final Stage. (29 Jun 2005)
John Browne: Arising from concerns expressed in both Houses, the Minister for Agriculture and Food, Deputy Coughlan, agreed to substantial amendments to this section under which investigations by authorised officers of the council at veterinary premises will be carried out under a search warrant. Amendment No. 28 deals with the seizure of animals in the context of investigations. The Minister explained on...
- Veterinary Practice Bill 2004 [Seanad]: Report Stage (Resumed) and Final Stage. (29 Jun 2005)
John Browne: I discussed all the amendments with the Minister and she was anxious that I would make Deputy Upton aware that she had considered this amendment seriously and discussed it with the Office of the Attorney General, but found that she could not accept it. It would be difficult to frame legislation where banned drugs might be involved and she is not prepared to accept the amendment.
- Veterinary Practice Bill 2004 [Seanad]: Report Stage (Resumed) and Final Stage. (29 Jun 2005)
John Browne: I thank Deputies Upton and Naughten in particular for their contributions on the Bill. I was here on Second Stage of the Bill and I know they made important suggestions on how the Bill could be improved. The Minister for Agriculture and Food acted on many of the proposals put forward by Deputies on all sides of the House. I thank them for their co-operation and support. There were 104...
- Grocery Industry. (12 Oct 2005)
John Browne: I am here to take Deputy Naughten's Adjournment matter.
- Animal Diseases. (12 Oct 2005)
John Browne: I thank Deputy Naughten for raising this important issue. An outbreak of foot and mouth disease in cattle and pigs was confirmed on a farm in the Eldorado district of Mato Grosso do Sul in the southern part of Brazil on 8 October 2005. This development was communicated to the OIE, the World Organisation for Animal Health, on 9 October 2005. The OlE indicated that the disease virus type is...

John Browne: Deputy Penrose watches "The Simpsons".
- Land Bill 2004 [Seanad]: Order for Report Stage. (19 Oct 2005)
John Browne: I move: "That Report Stage be taken now".
- Land Bill 2004 [Seanad]: Report and Final Stages. (19 Oct 2005)
John Browne: The Minister for Agriculture and Food has reconsidered the amendment. It has been previously stated in the House that 13 July 2004 is the date on which this Bill was published and that it was deliberately inserted in the Bill to ensure that no artificial annuities could be created after the measure was announced to circumvent the Bill's declared intention. Consequently, I oppose this amendment.
- Land Bill 2004 [Seanad]: Report and Final Stages. (19 Oct 2005)
John Browne: This amendment seeks to spread out the payment of the discounted buy-out figure over a much longer time. The scheme will be available for a defined period and if this amendment was to be accepted, it would enable annuitants to accept the scheme and then defer part of the payment until after the scheme was closed. This would seriously undermine the Bill's intended purpose, namely, a closure on...
- Land Bill 2004 [Seanad]: Report and Final Stages. (19 Oct 2005)
John Browne: I understand the point the Deputy is making.
- Land Bill 2004 [Seanad]: Report and Final Stages. (19 Oct 2005)
John Browne: I understand the Minister, following Committee Stage, gave serious consideration to the suggestions made then. Obviously, both the Minister and the Department are anxious to bring closure to this scheme, as are many of the farmers. It has been decided not to accept the Deputy's amendment and to proceed as laid out in the Bill.
- Land Bill 2004 [Seanad]: Report and Final Stages. (19 Oct 2005)
John Browne: Section 3 of the Bill provides for the Minister having the statutory powers to introduce a scheme for the purpose of section 3. It is not unusual that an administrative scheme provided for in primary legislation and introduced by way of regulation is made subject to the consent of Dáil Ãireann being obtained in advance of its introduction. Therefore, there is no need for this amendment.
