- Select Committee on Jobs, Enterprise and Innovation: Companies Bill 2012: Committee Stage (5 Nov 2013)
Jonathan O'Brien: Are they exempt from scrutiny?
- Select Committee on Jobs, Enterprise and Innovation: Companies Bill 2012: Committee Stage (5 Nov 2013)
Jonathan O'Brien: I am willing to leave it. This relates to the area of Irish-registered non-resident companies and I have a particular concern in several areas, not only in this area. Perhaps I will sit down with someone from the Department before Report Stage and explain exactly the issues I have.
- Select Committee on Jobs, Enterprise and Innovation: Companies Bill 2012: Committee Stage (5 Nov 2013)
Jonathan O'Brien: It is my understanding that subsections (2), (3) (4) and (5) are new subsections. It was always the case that if a director was made insolvent, he or she could not become a director again for a period of five years. It is now proposed to change this. Perhaps the Minister of State would elaborate on the reason for this.
- Select Committee on Jobs, Enterprise and Innovation: Companies Bill 2012: Committee Stage (5 Nov 2013)
Jonathan O'Brien: I am seeking an explanation for the change from current practice whereby a person cannot become a director again within five years. I assume the amendments follow on from this.
- Select Committee on Jobs, Enterprise and Innovation: Companies Bill 2012: Committee Stage (5 Nov 2013)
Jonathan O'Brien: As I understand it, subsections (2), (3), (4) and (5) are new subsections. They are all new.
- Select Committee on Jobs, Enterprise and Innovation: Companies Bill 2012: Committee Stage (5 Nov 2013)
Jonathan O'Brien: It is fine if we deal with the amendments first.
- Select Committee on Jobs, Enterprise and Innovation: Companies Bill 2012: Committee Stage (5 Nov 2013)
Jonathan O'Brien: Are we saying that subsection (2) is being included as a bit of a carrot so that there is full co-operation, that it is in the best interests of the company to co-operate fully with the liquidator?
- Select Committee on Jobs, Enterprise and Innovation: Companies Bill 2012: Committee Stage (5 Nov 2013)
Jonathan O'Brien: Can it be changed?
- Select Committee on Jobs, Enterprise and Innovation: Companies Bill 2012: Committee Stage (5 Nov 2013)
Jonathan O'Brien: If a figure is inserted here and somewhere down the line the class A fine is changed, then this figure remains the same.
- Select Committee on Jobs, Enterprise and Innovation: Companies Bill 2012: Committee Stage (5 Nov 2013)
Jonathan O'Brien: That is what I mean. If we put in a figure here and the level of class A fine changes in other legislation, it will not be reflected in this Bill. It makes sense, therefore, to leave it as it is and not put in a monetary value.
- Select Committee on Jobs, Enterprise and Innovation: Companies Bill 2012: Committee Stage (Resumed) (6 Nov 2013)
Jonathan O'Brien: I was late coming in and I missed the discussion on amendment No. 110, which is similar except this relates to public limited companies. Will the Minister of State offer some clarity? The amendment proposes to insert the words "and prohibition of certain activities" and this provision is being disapplied in respect of section 18. What type of companies is one talking about in this regard?...
- Select Committee on Jobs, Enterprise and Innovation: Companies Bill 2012: Committee Stage (Resumed) (6 Nov 2013)
Jonathan O'Brien: We support Deputy Wallace's amendment, which seems to be a good, progressive and practical measure. I do not know why the Minister of State would be against something like this.
- Leaders' Questions (7 Nov 2013)
Jonathan O'Brien: The programme for Government promised to increase the stock of social housing, but this morning, like every morning, we heard the real human stories of the families who were left to languish on the housing waiting list by this Government and its predecessor. Mothers are struggling to feed their children and pay their bills because they are forced to live in poor-quality and overpriced rental...
- Leaders' Questions (7 Nov 2013)
Jonathan O'Brien: On the basis of the figures provided by the Tánaiste, we are looking at an additional 7,000 units over the lifetime of the Government. As the housing list has 112,000 families, the additional units represent a drop in the ocean. Announcing €15 million here and €15 million there will not compensate for the massive cuts the Government has overseen. Some €233 million...
- Leaders' Questions (7 Nov 2013)
Jonathan O'Brien: The housing budget was cut by €233 million.
- Order of Business (7 Nov 2013)
Jonathan O'Brien: The Tánaiste will be aware that figures released this week show that the number of people accessing the services of moneylenders has increased since 2007 by 20%. There are approximately 360,000 people in the State who access either legal or illegal moneylenders. The Tánaiste will also recall that my colleague, Deputy Pearse Doherty, brought forward a Private Members' Bill to try to...
- Order of Business (7 Nov 2013)
Jonathan O'Brien: That is ridiculous.
- Access to Credit: Motion [Private Members] (12 Nov 2013)
Jonathan O'Brien: Since my election, there has been much talk about those high-technology jobs for which multinationals are crying out. One should remember the economy and jobs across this island are predominantly to be found in the SME sector. I understand that 99% of all companies registered and approximately 78% of all employment can be found within the SME sector. In essence, this is a nation of small...

- Written Answers — Department of Education and Skills: Student Support Schemes Issues (12 Nov 2013)
Jonathan O'Brien: 148. To ask the Minister for Education and Skills if he will reverse the decision of Student Universal Support Ireland which has refused to pay the contribution fee in respect of a person (details supplied) in County Cork who was enrolled in a social work degree in USI, having previously moved back to his parents' house due to ill-health; if he feels that it is sufficient that grown adults...
