Joint Committee On Health: General Scheme of the Mental Health (Amendment) Bill 2021 (Resumed): Office of the Ombudsman for Children (25 Jan 2022)

Gino Kenny: I thank the witnesses for coming in today. This is a very complex issue with regard to updating legislation on mental healthcare for all our citizens. With regard to the opening statement, I want to get clarity on two questions. Under the section on guiding principles in regard to children, the witness stated that section 84 provides for a child under the age of 16 who is capable of...

Joint Committee On Health: General Scheme of the Mental Health (Amendment) Bill 2021 (Resumed): Office of the Ombudsman for Children (25 Jan 2022)

Gino Kenny: Is it about terminology and wording?

Joint Committee On Health: General Scheme of the Mental Health (Amendment) Bill 2021 (Resumed): Office of the Ombudsman for Children (25 Jan 2022)

Gino Kenny: If the terminology was to be replaced, how would Dr. McAuley word it?

Joint Committee On Health: General Scheme of the Mental Health (Amendment) Bill 2021 (Resumed): Office of the Ombudsman for Children (25 Jan 2022)

Gino Kenny: A second clarification is in regard to the intermediate or voluntary persons. I will paraphrase the contents of this paragraph. It states that the idea that admission of a child under 16 on the basis of parental consent constitutes a voluntary admission appears to the Ombudsman to be fundamentally flawed. Why would that be fundamentally flawed?

Joint Committee On Health: General Scheme of the Mental Health (Amendment) Bill 2021 (Resumed): Office of the Ombudsman for Children (25 Jan 2022)

Gino Kenny: What happens in the case of a child under the age of 16 with, say, an acute eating disorder, who, without medical treatment in a medical situation, will die because of a lack of food and so forth? What happens if the child says he or she does not want to go to a unit but the parents want their child to go to the unit and the doctor caring for the child says the child needs to go? What...

Joint Committee On Health: General Scheme of the Mental Health (Amendment) Bill 2021 (Resumed): Office of the Ombudsman for Children (25 Jan 2022)

Gino Kenny: I do not know if those circumstances are rare but in such circumstances, the child can be involuntarily detained in his or her best interests.

Joint Committee On Health: General Scheme of the Mental Health (Amendment) Bill 2021 (Resumed): Office of the Ombudsman for Children (25 Jan 2022)

Gino Kenny: The child could say and has the capacity to say that he or she does not want to seek treatment. Obviously, the best interests of the child, medically and legally, would then be for him or her to be involuntarily detained to seek treatment. It is quite a complex issue. I have a final question on children aged between 16 and 18 years. Assisted capacity essentially means a person of an age...

Joint Committee On Health: General Scheme of the Mental Health (Amendment) Bill 2021 (Resumed): Office of the Ombudsman for Children (25 Jan 2022)

Gino Kenny: It does. I have a final, supplementary question on that, especially around eating disorders. Again, I am not sure if Dr. Muldoon can answer this. I am sure this has happened to adults but in a situation where a child is involuntarily detained and a situation arises where the child completely refuses to eat, what happens in those circumstances?

Joint Committee On Health: General Scheme of the Mental Health (Amendment) Bill 2021 (Resumed): Office of the Ombudsman for Children (25 Jan 2022)

Gino Kenny: Okay. I thank Dr. Muldoon. We have just been joined by Senator Dolan. Does she want to contribute now or to have a few minutes before doing so?

Ceisteanna ar Sonraíodh Uain Dóibh - Priority Questions: Foreign Conflicts (27 Jan 2022)

Gino Kenny: 2. To ask the Minister for Foreign Affairs and Trade if he has discussed the ongoing war and the humanitarian crisis in Yemen with his counterparts across Europe; if consideration has been given to imposing sanctions on Saudi Arabia; and if he will make a statement on the matter. [4170/22]

Ceisteanna ar Sonraíodh Uain Dóibh - Priority Questions: Foreign Conflicts (27 Jan 2022)

Gino Kenny: My question centres on the ongoing cataclysmic humanitarian situation in Yemen. Has the Minister spoken to his counterparts in the EU and have they considered sanctions against the Saudi Government relating to the ongoing humanitarian crisis?

Ceisteanna ar Sonraíodh Uain Dóibh - Priority Questions: Foreign Conflicts (27 Jan 2022)

Gino Kenny: This is the worst humanitarian crisis in the world. This has left tens of thousands of people dead, including 10,000 children either killed or maimed. Some of the pictures that have consequently come out of Yemen are almost incomprehensible. It is grotesque to watch how a country such as Saudi Arabia, which is one of the wealthiest countries in the world, basically inflict absolute terror...

Ceisteanna ar Sonraíodh Uain Dóibh - Priority Questions: Foreign Conflicts (27 Jan 2022)

Gino Kenny: The Minister visited Saudi Arabia last summer. Did he speak to his counterpart in regards to not only the human rights violation in Saudi Arabia, but also the situation in Yemen? Has the Minister spoken to his counterparts in the EU about action against Saudi Arabia? What is going on in Yemen is war crimes, not according to me but according to NGOs and civic bodies, on the basis of the...

Ceisteanna ar Reachtaíocht a Gealladh - Questions on Promised Legislation (27 Jan 2022)

Gino Kenny: I raise the lack of capacity in autism spectrum disorder, ASD, units in secondary education. The State has made considerable progress in the capacity of ASD units in primary schools, which is a good thing. However, there is an acute shortage of ASD feeder schools, particularly for children who are leaving primary settings and moving to secondary education. I am sure these issues arise...

Written Answers — Department of Foreign Affairs and Trade: Covid-19 Pandemic (27 Jan 2022)

Gino Kenny: 89. To ask the Minister for Foreign Affairs and Trade if there were children in attendance at the event in Iveagh House on 17 June 2020; and if he will make a statement on the matter. [3923/22]

Joint Oireachtas Committee on Health: Issues Relating to General Practice: Discussion (26 Jan 2022)

Gino Kenny: I thank all our witnesses. It has been an extremely difficult two years for everybody. Hopefully, an end to the pandemic is in sight. It has probably been the most challenging two years for every medical professional. Anybody working in this field came across people in quite stressful situations. It was, and continues to be, the medical profession's greatest hour. We owe the profession...

Joint Oireachtas Committee on Health: Issues Relating to General Practice: Discussion (26 Jan 2022)

Gino Kenny: My final question is on free GP care for children. Six or seven years ago, free GP care was introduced for children under the age of six. That had an effect on capacity. The Government has introduced free GP care for children aged six and seven, which is great. Most of us will agree that universal healthcare or Sláintecare, whatever we like to call it, is very positive. I am making...

Joint Oireachtas Committee on Health: Issues Relating to General Practice: Discussion (26 Jan 2022)
