Questions on Proposed Legislation (3 Nov 2016)

Dessie Ellis: I am sure the Tánaiste is aware of the serious problem with regard to the use of rickshaws on our streets. Many operate with no rules, regulations, training or insurance. Some even receive revenue from clients. In reply to a recent parliamentary question, the Minister for Transport, Tourism and Sport acknowledged some form of legislation is required and will be forthcoming. Will the...

Joint Oireachtas Committee on Housing, Planning, Community and Local Government: Annual Report and Accounts of An Bord Pleanála for 2015 (27 Oct 2016)

Dessie Ellis: I thank Dr. Kelly for her presentation and her staff for coming before the committee. There are a few things I wish to ask. I notice that An Bord Pleanála generally tries to make a decision on an application in 15 or 16 weeks. The one thing that stood out was the number of wind farm applications that were receiving refusals. I know that may be down to the court case and the court...

Joint Oireachtas Committee on Housing, Planning, Community and Local Government: Annual Report and Accounts of An Bord Pleanála for 2015 (27 Oct 2016)

Dessie Ellis: In many cases, it goes back to the local authority. Is there scope with An Bord Pleanála to insist on this happening? Does the board just make a decision as happened in the case to which I have referred?

Joint Oireachtas Committee on Housing, Planning, Community and Local Government: Annual Report and Accounts of An Bord Pleanála for 2015 (27 Oct 2016)

Dessie Ellis: However, people drop their guard once they think a development has been refused permission.

Joint Oireachtas Committee on Housing, Planning, Community and Local Government: Annual Report and Accounts of An Bord Pleanála for 2015 (27 Oct 2016)

Dessie Ellis: I asked about the cost of judicial reviews. If An Bord Pleanála is fast-tracking the process, I assume the judicial review option is still open, even with that fast-tracking process in place. Will Dr. Kelly give us some idea of what that would cost a citizen because it may be the only way to proceed if he or she has an objection of any description?

Joint Oireachtas Committee on Housing, Planning, Community and Local Government: Annual Report and Accounts of An Bord Pleanála for 2015 (27 Oct 2016)

Dessie Ellis: I assume a judicial review is still part of the new fast-tracking arrangements in the planning for housing and that a person can still take a judicial review.

Joint Oireachtas Committee on Housing, Planning, Community and Local Government: Annual Report and Accounts of An Bord Pleanála for 2015 (27 Oct 2016)

Dessie Ellis: Okay. I just wanted to get that clarification.

Planning and Development (Amendment) Bill 2016: Second Stage (Resumed) (19 Oct 2016)

Dessie Ellis: As we all know, planning issues have been a huge area of contention and concern for many years. In the eyes of most people, the planning process represented one of the most corrupt areas where politicians and planners had a huge influence over zoning and development. To remind the House and to put in context what the Mahon tribunal meant to people living in my constituency, many working...

Financial Resolutions 2017 - Financial Resolution No. 2: General (Resumed) (18 Oct 2016)

Dessie Ellis: This budget is another missed opportunity to move towards a fairer society. Fianna Fáil and Fine Gael have colluded in forging this budget between them. It once again represents the failed politics of a failed class and a failed system and one with no vision. It is also a mean budget especially when we consider that politicians will be paid an increase in January which is totally...
