Paschal Donohoe: It is a fair point that a displacement effect could unintentionally have been created by the earlier draft of the Bill. My expectation is that the new powers granted to the NTA will be used, although that will be its choice. Section 14 seeks to create a default power that would be available to the Minister of the day to vary the charge if the NTA does not use its powers.
