Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: Banking Sector in Ireland: Central Bank of Ireland (20 Dec 2016)

Pearse Doherty: Can it be provided in that time?

Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: Banking Sector in Ireland: Central Bank of Ireland (20 Dec 2016)

Pearse Doherty: I seek clarity on the figures. Does the figure of 8,200 cases include the 3,916 Bank of Ireland customers who have been overcharged by 0.15%? Bank of Ireland released two figures, the first of which - 3,916 - refers to the number of people who had been overcharged by 0.15%, and the second of which - 602 - refers to the number of people who should be restored to an appropriate tracker rate...

Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: Banking Sector in Ireland: Central Bank of Ireland (20 Dec 2016)

Pearse Doherty: It would be included in the scope of the examination.

Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: Banking Sector in Ireland: Central Bank of Ireland (20 Dec 2016)

Pearse Doherty: I seek further clarity on the numbers on behalf of the committee. The figure of 8,200 does not include the figure of 1,400 in respect of Permanent TSB and Springboard or the 2,100 cases that were restored in 2011.

Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: Banking Sector in Ireland: Central Bank of Ireland (20 Dec 2016)

Pearse Doherty: In that case, the figure for the period in question is 11,700. Representatives of the banks informed the joint committee that the overall figure is in excess of this figure. Based on their figures, we anticipate that a further 3,000 customers have been affected. As such, the total figure is probably around 15,000 when one includes the 2,100 mortgages restored by Bank of Ireland in 2011.

Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: Banking Sector in Ireland: Central Bank of Ireland (20 Dec 2016)

Pearse Doherty: It is appropriate to point out that much of this occurred before Professor Lane became the Governor of the Central Bank. In addition, much of this occurred in 2010 when the country was experiencing a severe financial crisis and the Central Bank was dealing with many serious problems in the banking sector. While I appreciate that, this does not take away from the complete failure of the...

Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: Banking Sector in Ireland: Central Bank of Ireland (20 Dec 2016)

Pearse Doherty: While I appreciate that, the thousands of customers to whom these figures relate - the individuals and families affected - will take a different view of the way in which the Central Bank dealt with its responsibility in respect of consumer protection. For the record, the Central Bank has been quoted in publications such as the Irish Independent as saying it had been aware of this issue since...

Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: Banking Sector in Ireland: Central Bank of Ireland (20 Dec 2016)

Pearse Doherty: I am glad to hear Professor Lane's answer to my question. We need to look back and learn lessons, but we also need to look forward to make sure this never happens again. Professor Lane believes that because the Central Bank has more powers now, a different approach would be taken if this were to happen today. I know some of these customers and I have an understanding of what they have gone...

Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: Banking Sector in Ireland: Central Bank of Ireland (20 Dec 2016)

Pearse Doherty: When 2,100 individuals had their tracker rates restored by Bank of Ireland in the 2010-11 period, any money that was taken off them as a result of them being on the wrong rate was given back to them. Am I correct in my understanding is that no compensation was offered to those customers?

Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: Banking Sector in Ireland: Central Bank of Ireland (20 Dec 2016)

Pearse Doherty: It is more of a question. Was compensation paid as part of a redress scheme? Perhaps Professor Lane's colleague might be in a position to answer this question. The Central Bank has to sign off on the redress schemes that are being put forward by Permanent TSB, AIB and so on. When the Central Bank took action in the Bank of Ireland case in 2011, was there a redress scheme that included the...

Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: Banking Sector in Ireland: Central Bank of Ireland (20 Dec 2016)

Pearse Doherty: Is the Central Bank going to ensure that the 2,100 individuals will be part of a redress scheme? Will the 3,916 customers who had money taken off them by a financial institution - Bank of Ireland - that should not have taken this money off them have a redress scheme as well? The problem is that the banks, deliberately or otherwise, are basically stealing from their customers. They are...

Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: Banking Sector in Ireland: Central Bank of Ireland (20 Dec 2016)

Pearse Doherty: I am sure the Central Bank is aware of numerous complaints by individuals about the rates that are being applied to their mortgages when their tracker mortgages are being restored. Permanent TSB, for example, has restored some individuals back to their right tracker rates. Individuals are complaining that they are being restored onto the wrong tracker rates. I will give an example. A...

Joint Oireachtas Committee on Finance, Public Expenditure and Reform, and Taoiseach: Banking Sector in Ireland: Central Bank of Ireland (20 Dec 2016)

Pearse Doherty: I understand there is an appeal mechanism. I am asking the Central Bank to be hands on. The Central Bank is the only organ of the State that will have access to the prevailing tracker rates at that time. No one else will. People who are representing customers, such as Padraic Kissane and the Irish Mortgage Holders Organisation, do not have the information that is available to the Central...

Planning and Development (Housing) and Residential Tenancies Bill 2016 [Seanad]: Report Stage (Resumed) (16 Dec 2016)

Pearse Doherty: In terms of designation of a rent pressure zone, where notice has been given after the commencement of the Act, the designation will void the notification.

Planning and Development (Housing) and Residential Tenancies Bill 2016 [Seanad]: Report Stage (Resumed) (16 Dec 2016)

Pearse Doherty: It is. I wish to be associated with the words of my colleagues about the Home Sweet Home campaign. I believe it is remarkable and tremendous. We need more communities to rise up and take action in the absence of the Government listening. That is linked to this. Deputy O'Brien spelt out very clearly what we are dealing with when we are talking about the algorithms, the t/12 and what they...

Planning and Development (Housing) and Residential Tenancies Bill 2016 [Seanad]: Report Stage (Resumed) (16 Dec 2016)

Pearse Doherty: No. I spoke on a point of information yesterday.

Planning and Development (Housing) and Residential Tenancies Bill 2016 [Seanad]: Report Stage (Resumed) (16 Dec 2016)

Pearse Doherty: I will be brief because we dealt with quite a part of this on Committee Stage and I appreciate the clarifications the Minister has given on the amendments. Will the Minister address a query I have about amendment No. 55? Another Deputy raised a matter relating to the new subsection (6). This subsection deals with notices served, prior to the enactment of this legislation, under section...

Planning and Development (Housing) and Residential Tenancies Bill 2016 [Seanad]: Report Stage (Resumed) (16 Dec 2016)

Pearse Doherty: To be very clear, I do not want to delay these proceedings, and the issue has been well rehearsed by my colleague, Deputy Ó Broin, but there is genuine concern about the definition of tenancy. I listened to what the Minister said and I know he stated his understanding. It will be a considerable time before we vote on this amendment. I ask that the Minister uses this time to get a...

Planning and Development (Housing) and Residential Tenancies Bill 2016 [Seanad]: Report Stage (Resumed) (16 Dec 2016)

Pearse Doherty: I would appreciate that. All it would take is a minor amendment regarding the date rent became last set under a tenancy, which would be consistent with what was stated earlier and which would allow-----

Planning and Development (Housing) and Residential Tenancies Bill 2016 [Seanad]: Report Stage (Resumed) (16 Dec 2016)

Pearse Doherty: I thank the Minister.
