I must now deal with a deferred division relating to amendment No. 4 by Sinn Féin to the motion re the conflict in Israel and the occupied Palestinian territory. Yesterday, on the question "That the amendment be made" a division was claimed and that division must be taken now.

I move amendment No. 1:

To delete all the words after "agrees to:" and substitute the following: "— insist on an immediate ceasefire and full, safe, and unhindered humanitarian access to Gaza and support the UN in their efforts to increase the flow of humanitarian goods into Gaza;

— support any decision of the ICJ on preliminary measures, which are final and binding on the parties concerned, and urge all parties to the Genocide Convention to also do so;

— make an intervention in the South Africa v Israel case at the ICJ, as a matter of urgency after the Court has made its order on preliminary measures and the filing by South Africa of its memorial in the case, which is the only appropriate process to do so and following the necessary legal and policy analysis;

— continue to underline the independence and impartiality of the ICC and to support its work; insist that all States, whether they are parties to the Rome Statute or not, cooperate with the ICC investigation into the situation in Palestine and Israel; and

— drive efforts at European Union level to institute a sanctions regime against violent settlers in the West Bank who are attacking and displacing Palestinian communities, differentiating between Israel itself and the illegal settlements that are illegal under international law.".

I move amendment No. 3:

To insert the following after "appropriate process to do so and following the necessary legal and policy analysis;" "— appoint a senior team of legal officials chaired independently to assess questions of the risk of, and/or ongoing genocide and/or failures to prevent and punish incitement to genocide by Israel and Ireland’s obligations under the Genocide Convention;

— ensure that the above-mentioned assessment will include consideration of Israel’s apparent use of 2,000lb bombs and other explosive weapons in the densely populated areas of Gaza, bearing in mind Ireland’s leadership on this specific issue internationally;

— examine the question of Israel’s compliance with the EU-Israel Agreement as part of the above-mentioned assessment;

— acknowledge South Africa’s use of the ICJ to determine questions of compliance with the Genocide Convention is appropriate;".

To delete "strongly consider an intervention in the South Africa v Israel case at the ICJ, as a matter of urgency after the Court has made its order on preliminary measures and the filing by South Africa of its memorial in the case, which is the only appropriate process to do so and following the necessary legal and policy analysis;" and substitute the following: "commit to an intervention and an immediate public statement supporting South Africa's case against Israel at the ICJ and supporting South Africa's request for provisional measures to protect against further, severe and irreparable harm to the rights of the Palestinian people under the Genocide Convention, which continue to be violated with impunity".
