The one difference between the examples he cited and the current example is that the appointment of Mr. Justice O'Donnell was discussed in advance of the Cabinet meeting with other elements of Government. The key issue on this occasion is that the other members of the Government did not have the faintest idea what was about to happen when they walked into the Cabinet committee meeting. They need to explain what they knew, when, where and how. That is the failing and that is why the precedents cited by the Taoiseach do not actually make sense.
