I move amendment No. 18:

In page 4, between lines 23 and 24, to insert the following:

“Amendment of section 57CP of Principal Act

7. Section 57CP of the Principal Act (as inserted by section 16 of the Act of 2004) is amended by substituting the following for subsection (2):“(2) The High Court may not grant an application under subsection (1) unless it is of the opinion that the conduct sought to be restrained is likely to prejudice or negate the effect or implementation of a decision that the Financial Services Ombudsman might make under this Chapter if that Ombudsman were to find the complaint to which the conduct relates is upheld or substantially upheld.”.”.
