I move amendment No. 51:

In page 37, to delete lines 15 to 23 and substitute the following:“28. Where the court is determining whether a co-decision-maker should continue to act as co-decision-maker for an appointer, it shall have regard to all of the circumstances of the case, including in particular—

(a) the capacity of the appointer,

(b) the appointer’s willingness to continue to participate in the co-decision-making agreement concerned,

(c) the suitability of the co-decision-maker,

(d) the performance by the co-decision-maker of his or her functions, and

(e) the views of the Director.”.

The amendment proposes the substitution of section 51 with amended text. The amendments to the text are purely technical and simplify the text to provide clarity. The amendments have no policy implications.
