In the case of the banking inquiry, there is a potential for criminal cases which would involve juries down the line. The Taoiseach is well aware of that. No such potential exists in this case. There is a suggestion that Guerin may have caused the resignation of a Minister. That is not correct because the former Minister said he resigned because he did not want to embarrass the Government parties at the time. Standing Order 57(3) provides that "a matter shall not be raised in such an overt manner so that it appears to be an attempt by the Dáil to encroach on the functions of the Courts or a Judicial Tribunal".
