Radiological Protection (Miscellaneous Provisions) Bill 2014: Report and Final Stages

I move amendment No. 13:

In page 25, between lines 9 and 10, to insert the following:“Amendment of section 27 of the Act of 1991

44. Section 27 of the Act of 1991 is amended by the insertion of the following new subsection after subsection (2):
“(3) In executing functions under the Protection Convention nothing the Institute or the Minister shall do shall affect other rights, obligations and responsibilities of States Parties under international law, in particular the purposes and principles of the Charter of the United Nations and international humanitarian law.”.”.
These amendments allow Ireland to ratify fully the 2005 changes to the convention on nuclear materials and ensure the institute may not violate any international agreements, in particular the Charter of the United Nations, in carrying out its functions. I do not know why this part was omitted from the legislation as it was already a function of the Radiological Protection Institute of Ireland, RPII.
